Descriptions & Terminology
If an item is materially different than was described by the Seller, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered "as is", without recourse.
A work cataloged with the name or recognized designation of an artist, without any qualifications, is, in our opinion, a work by the said artist. In other cases, the following expressions will be used.
Attributed to, Studio of, & Workshop of is a work created by the artist in whole or in part, and may have been done under the supervision of said artist.
Circle of is a work of the period of the artist and showing his or her influence.
Follower of is a work executed in the artist's style but not necessarily a pupil.
Style of is a work executed in the artist's style but made at a later date of said artist.
After is a copy of an original work by a different artist with extreme similarities in color, stroke, etc.
Signed, Dated, Inscribed indicates that the work has been signed, dated, and/or inscribed by the artist.
Size of each lot is listed in an appropriate manner. Some liberties have been taken by rounding sizes.
Note: Condition reports, images and estimated values are provided as a courtesy and should not be used as a substitute to viewing the items firsthand. All items including frame, canvas, glass, backing, physical condition, etc.) are sold 'as is' in accordance to the conditions of sale.

* All lots are sold "AS IS". BE SURE TO READ THE COMPLETE DESCRIPTION AREA FOR CONDITIONS OF LOT. Be aware of any and all items noted as 'style of' 'manner of' 'attributed to' etc. - Please read/research any and all information before making a bid on any lot in the sale. Your bid is a binding contract and false bidding, or retracting bids due to incomplete research on your part, not only interrupts the complete sale of the item, keeps other serious bidders from purchasing the item, but hinders any future sale of that lot. PLEASE read each condition report (which is based on our opinion of said item and should be regarding as such) and if enough information is not provided, then please call or email with any questions you may have that were not listed in advance. Many lots could very well be part of an estate that needs to end at the point of sale, so bidding irresponsibly only complicates the appropriate closure needed by said party. All items are framed in this sale, but Condition Reports primarily reflect the graphic or painting and not the frame, unless specifically noted. You will find this information in the Description Area of each respective lot.
* All items, with the exception of bronze sculptures, are being sold Framed, even if a particular item is shown without its frame. Unless specifically noted, condition reports are directly related to the artwork and not the frame and are considered. Frames may contain minor scratches, defects or discolorations not visible through the image(s) provided.
* Buyer's Premium: A buyer's premium will be added to each purchase to reach the total sales price. The buyer's premium is 15% of the final hammer price.
* Total Sales Price: The total sales price of an item includes the final hammer price, the 15% buyer's premium, any applicable sales or other taxes due on account of the sale, packing & shipping costs, and any applicable insurance charges (also any customs fees, charges or duties, if applicable). Buyer's within the state of Oklahoma will pay 8.375% Oklahoma sales tax.
* Online Bidding: By registering to bid through Colonial Art Gallery's Live Auction, you agree to accept Colonial Art's policies of bid history disclosure, including the policy that live online bidder's increments are not reported when bidding against an absentee bid until the absentee bid is surpassed. Please register to bid well in advance of the start time. Neither Colonial Art Gallery nor its suppliers or affiliates will be held responsible for errors or failure to execute bid(s). Absentee bids must be submitted electronically during the preview period at http://www.ebayliveauctions.com or http://www.eBay.com.
* Methods of Payments: Acceptable forms of payment include all major credit cards, money order, and personal checks. If paying by credit card, you must supply a fax number. **Personal Check's If paying by check, your lot(s) will be held until payment is cleared**
* Payment Due: Buyer shall communicate with Seller/Colonial Art Gallery within three (3) days of the completion of the auction. Complete payment is due upon receipt of notification of a successful bid and shall be received by the Seller/Colonial Art Gallery no later than 7 days following the auction. All crating, packing, shipping and insurance charges will be paid by the Buyer. Any risk of loss during shipment will be the responsibility of the Buyer following delivery of the purchased item to the designated common carrier.
* Winning Bid: The highest bidder will win the lot being auctioned and if any dispute arises between two or more bidders, the live, on-site auctioneer shall decide the buyer.
* Record of Sale: The record of sale, posted through the Colonial Art Gallery's Live Auction, will be taken as absolute and final in all disputes.
* Reserve Price: Some lots are offered subject to a reserve. A reserve is a confidential minimum price below which such a lot will not be sold. The Colonial Art Gallery will act to protect the reserve by bidding through the auctioneer. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the Seller and may continue to bid on behalf of the Seller up to the amount of the reserve. This may be done by placing consecutive bids or by placing bids in response to other bidders.
* Inquiries: All inquiries regarding lots must be sent directly to Colonial Art Gallery via email and received 24 hours prior to the start of the auction.
* Withdrawals: The Colonial Art Gallery reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal.
* Guarantee Terms: All items in the catalog are sold as described by the Seller of the item. No statement regarding condition, kind, value or quality of a lot shall be construed to be an expressed or implied warranty, representation or assumption of liability by The Colonial Art Gallery. If an item is materially different than was described by the Seller, Buyer shall have 48 hours from the date the property is received to notify the Seller. After the 48 hour period all items are considered "as is", without recourse.
* The foregoing guarantee is only valid to the original buyer. The item(s) must be returned in the same condition as when purchased. Discrepancies of description shall be decided by mutually agreed upon experts whose determination must be in writing and is at the expense of the Buyer.
* Waiver. This Agreement, including the Colonial Art Gallery User Agreement and all exhibits and other documents incorporated by reference, set forth the entire understanding and agreement of the parties and supersedes any and all other written or oral agreements or understandings between the parties as to the subject matter of this Agreement. In the event of an inconsistency between this Agreement and any other document, which is part of this Agreement, the terms of this Agreement shall govern. From time to time during the term of this Agreement, Colonial Art may amend this Agreement (including any incorporated documents) by posting the amended terms on the Colonial Art Gallery website, emailing notice of the amendment to the Buyer, or otherwise communicating such amendment to the Buyer. Each amendment will be effective immediately after it is initially posted by Colonial Art, emailed to the Buyer, or otherwise communicated to the Buyer. The waiver of a breach of any provision of this Agreement will not operate or be interpreted as a waiver of any other or subsequent breach. The laws of the State of Oklahoma shall govern all transactions.
