Terms & Conditions
1. All items are sold where is,as is. The auctioneer makes no warranty, express or implied as to size, count weight, style, authenticity, period, material or manufacturer, or any other warranty except as specified below. Neither C. Downing Auctions nor its consignor will be responsible for the description, genuineness, provenance, or condition of the property. No statement contained in the catalogue or made orally at the sale or elsewhere shall be deemed to be such a warranty or representation or an assumption of liability. Purchasers should satisfy themselves as to the condition, quality and description before bidding.
2. The catalog lists are a courtesy, meant as a descriptive guide only. The buyer is cautioned to use the preview to examine all merchandise and to use his/her best judgment as to whether or not the descriptions and categories are accurate.
3. Title transfers to the customer at the fall of the hammer subject to the provisions above. From that moment the auctioneer will accept no returns. Please be sure you are bidding on the correct item and have examined it carefully before placing a bid.
4. The auctioneer reserves the right to refuse any and all bids, at her sole discretion, whether or not a reserve is in place, and will be the sole arbiter in any dispute. The auctioneer may, if she chooses, re-offer a disputed lot.
5. Absentee and telephone bids submitted in writing prior to the auction will be executed for the convenience of bidders not present at the auction. C. Downing Auctions will not be responsible for failing to execute such bids or for errors relating to the execution of such bids. Telephone bids must open at one half of the low estimate. In the event of equivalent absentee bids, preference will be given to the first received.
6. The purchase price payable by the buyer shall be the sum of the final bid plus a premium of 15% of the final bid. All purchases are subject to a 6% Connecticut sales tax. Sales tax numbers from other states are accepted, but the resale tax form must be fully and completely filled out and received prior to time of purchase. A service charge of $35.00 will be imposed on any returned checks.
7.No auction lot may be removed during the sale or at any time until the full purchase price has been paid.
8. Condition reports are statements of opinion by the staff of C. Downing Auctions. It is not a warrantee. C. Downing Auctions is not liable or responsible for any errors in the condition report or failure to deliver the same.
9.All shipping is to be arranged and paid for by the successful bidder. C. Downing Auctions will direct successful bidders to shipping agents , or successful bidders may make their own arrangements for pick-up and delivery of property.
10.Purchases made at C. Downing Auctions must be removed from the gallery within ten business days following the date of the sale, or they become subject to a storage fee of $10.00 per item per day. C. Downing Auctions will not be held responsible for loss or damage to items left on premises over ten business days.
Taxes
Winning bidders within Connecticut pay 6% sales tax if they do not have a valid re-sale number.
Important Information
1)C. Downing Auctions usually auctions items at approximately 90-100 lots per hour. On some occasions Live Auctioneers software or the Internet may not be able to keep up with the pace of the auction. We recommend placing a realistic absentee bid now as insurance to avoid disappointment. Occasionally the auctioneer may eliminate or reject a Live Auctioneers bid, and the auctioneer may also reopen a lot after the close of the Live Auctioneers bidding (usually because we missed an audience bid), and may reject your bid even if it shows you as the winning bidder. By bidding via Live Auctioneers, you agree that C. Downing Auctions may award the lot to another bidder at its sole discretion under the circumstances described above or any other reasonable circumstances. Since the Live Auctioneer bids are not shown to us until we open the lot on the floor, we treat those bids just like floor bids. In most cases the floor responds before the Live Auctioneers bid is presented to us, due to Internet lag time, so for consistency we have made it a policy that floor bids are always considered first over tie Live Auctioneers bids. Please make sure you read the Terms and Conditions before you bid. This lot is being auctioned in conjunction with a live floor auction by C. Downing Auctions. All final auction and invoice information will be supplied by C. Downing Auctions, and all other information should be considered preliminary.
2) Please note: This is a Lot from a Live Auction, it is not a regular eBay listing. There are MAJOR differences between Live Auctions and regular eBay listings. If you have never participated in this style of auction before, we respectfully request that you call us before you bid so that we may assist you. 3) The end time shown is wrong Live Auctioneers is showing the anticipated end of the entire auction session. The auction starts in Connecticut at 6:00 pm EST. LA shuts down the proxy (absentee) bidding about 1 hour before the Start time shown. If you wish to place a bid after LA closes the proxy bidding, call us at 203-642-3771 no later than 5:30pm EST on day of auction. If you are registered, you may also bid while the auction is in progress by going to www.liveauctioneers.com. In case of any technical difficulty, the best way to ensure that your bid is received and registered is to leave an absentee bid on Live Auctioneers before the auction starts or by calling us at 203-642-3771.
4) CONDITION NOTES: We try to accurately reflect the items in this auction with extensive images. Do not assume that no mention of condition means there are no problems. Good condition means generally good, some signs of normal use, no significant breaks or repairs. The colors shown in the images are accurate to our computer, but may not be accurately reflected on your monitor. Do not rely on the Live Auctioneers Category an item is listed in. They are assigned automatically and may not be accurate.
5) A persistent PENDING registration means there is a problem. If you have incomplete contact information, have negative feedback, or are a first time bidder, please contact us through the email link above or by calling 203-642-3771. We want you to be able to bid and will try and resolve any problem.
