The property listed in this catalogue will be offered by Antique Carpets on Line, herein referred to as the "Gallery" as owner or as agent for consignor(s) subject to the following terms and conditions:
The highest bidder, acknowledged by the auctioneer shall be the purchaser. The auctioneer reserves the right to reject any bid and to advance the bid at his/her sole discretion to determine the successful bidder, or to re-offer a lot in dispute. Should there be any dispute after the sale; the Gallery's record shall be accepted as conclusive.
The Gallery reserves the right to withdraw, combine, or divide any lot at its sole discretion prior to the commencement of bidding.
Title will pass on the fall of the auctioneer's gavel to the highest acknowledged bidder in accordance with conditions set forth herein, and such bidder therefore assumes full risk and responsibility. A bidder may be requested to give their name, telephone number, identification, place of residence and pay the full purchase price or any part thereof. The Gallery reserves the right not to accept any bids from anyone who has not established himself or herself with the Gallery prior to the auction.
The purchase price payable by the buyer shall be the sum of the final bid plus a twenty percent (15%) buyer's premium of the final bid. All purchases are subject to state and local taxes where and when applicable.
All estimates are based on similar merchandise offered for sale in past auctions. No auction lot may be shipped during the sale or at any time until the full purchase price has been paid.
All lots must be so paid and removed at the buyer's expense within five business days after the auction.
If the forgoing conditions or any other applicable conditions are not met, in addition to remedies available to the Gallery by law, the Gallery may:
A. Cancel the sale and retain any payments made by the buyer as liquidated damages.
B. Resell the property for the account or, and at the risk of the buyer. In such a case, the buyer shall be liable for any and all losses or costs sustained by the Gallery, including warehousing, the commissions for both auctions and any other related costs.
C. Remove the property to a public warehouse for the account, and at the risk and expense of the buyer.
All items are sold AS IS, WHERE IS with all faults. There are no warranties or guarantees of any kind, express or implied. All items are available for your examination prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. The Gallery attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question. If your item(s) are damaged in shipping, you will need to contact UPS or the United States Postal Service, or specific carrier to file a claim. We do not give refunds! All sales are final! There will be no returns!. All property is sold AS IS, WHERE IS and neither the Gallery does not make any warranties or representations of any kind or nature with respect to property or its value, and in no event shall be responsible for the correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of property or estimate of value. No statement (oral or written) in this catalog, at the sale, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. All measurements are approximate. The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on the Gallery's part as to the validity of any bid, The Gallery will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, the sale record is conclusive. The purchaser assumes full responsibility for items at the fall of the hammer. All items must be immediately insured by the buyer at the time of purchase. Shipping and packing are not included. All items purchased must be paid for within 72 hours of sale. We will accept MasterCard, Visa, and American Express, Personal checks or Bank Transfers. See below for additional penalties. SHIPPING Terms: Allow 10 to 15 days shipping. The fee to the buyer will include actual shipping charges, insurance. There is a $15.00 minimum fee per package. The Gallery will make every effort to ship your items within 14 days of our receipt of full payment and all shipping information. Any successful bidders will have the shipping charges applied to their MasterCard or Visa at the time of shipping. We do not ship to P.O. Boxes. The Gallery reserves the right to withdraw any lot at any time before the auction without any liabilities. A range of estimates is given on each lot with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price. This is an absolute auction and ALL items will sell to the HIGHEST bidder. There are NO reserves. In the event a buyer initiates litigation against The Gallery for any reason, then buyer agrees to reimburse The Gallery for reasonable attorney's fees and/or costs incurred in any such action. In the event The Gallery is required to initiate litigation and/or collection actions against a buyer, then the buyer agrees to reimburse The Gallery for reasonable attorney fees and/or costs incurred in any such action. All international bidders are responsible for taxes (VAT) and duties imposed by their own governments upon receipt of the items.
The waiver of a breach of any provision of this Agreement will not constitute or be interpreted as a waiver of any other or subsequent breach. The laws of the State of New York shall govern all transactions.
