Items must be picked up within 7 days after the auction ends. After 14 days buyer is liable for the storage fee of $50 per day. All disputes with the gallery involving auction transactions must be filed with the NYC court system. David Killen Gallery does not guarantee works of art for artist. We remove hundreds of paintings, watercolors and drawings out of NYC estates and they are sold as is. Anyone unsure of the authenticity of any work of art sold in our auctions should consult an expert.Whether or not a particular artist created a work of art is debatable and we cannot guarantee that an artist created any work of art and we don't.We do not guarantee the age of an item, we give an opinion but the opinion in the description should not be taken as fact.We do not guarantee the materials of an item, we give an opinion but the opinion should not be taken as fact.We guarantee precious stones, and precious metals, as diamonds, rubies sapphires and 18k, platinum and silver.We do not distinguish between natural and synthetic material so that if we guarantee a colored stone as ruby or sapphire we are not saying that it is not a synthetic ruby or synthetic sapphire.Basically all items except for precious stones or precious metals are sold as is, and cannot be returned for issues of age, material, authorship, artist, or other issues that conflict with the catalogue description, which should be taken as an opinion and not fact or a guarantee.Buyers are responsible for coming to the exhibition or emailing questions, if they have any, before the auction, and not doing their research or examination after they have bought the item just because they were too busy to attend the exhibition, or too busy to ask questions before the sale. If David Killen Gallery accepts your return, returned items are subject to restocking fee of $100 per item.

If you have not contacted David Killen Gallery to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
