General: Proto Cultures Art Ltd. is the auctioneer and acts only as the appointed agent for the owner of the lot (the seller). We shall have sole discretion as to the conduct of any sale and its decision shall be final in all matters. Every effort is made to ensure the accuracy of any statement as to authorship, attribution, origin, date, age, provenance and condition of any lot whether or not such statement forms part of the description of any such lot. Whether any such statement is made orally or in the catalogue it is an expression of opinion given after careful consideration and research. Each buyer by making a bid for a lot acknowledges that they have satisfied themselves fully as to the attribution and condition of the lot. Expressions and wording relating to the condition are used to briefly describe our opinions of the lots and will not fully list minor blemishes, scratches, small repairs or slight restorations. Potential bidders are strongly advised to contact us 24 hours before the auction date for condition reports, this can be done by email. Proto Cultures Art makes no guarantee with respect to age or authenticity, therefore we strongly advises potential bidders to do their own research before placing bids. Dating: A variety of expressions may be used to describe an opinion of the date(s) of origin attributed to lots offered at auction. An unqualified statement e.g. 'Ancient China' or circa 200-700CE means that in our opinion and of the actual owner of the lot, the lot dates to the mentioned period. The phrase 'Possibly XYZ period? means that in our opinion the lot may date to the mentioned period but there is a strong element of uncertainty in this attribution. The terms 'Archaistic''Style' or if there is not mentioned of specific date or period mean that the lot may be of recent origin, replicating an ancient style or design for decorative purposes. Internet Bidding: Proto Cultures Art is not responsible for any technical or other failure that might result in bids not being received. Therefore, we advise any bidders to leave an absentee bid for a lot you are interested prior to the start of the auction. Estimates: Estimates are for general guidance only and Lots may sell outside their indicated range(s). Bidders must make their own assessment as to the value of any Lot and conduct their bidding accordingly. Reserves: Lots may be subject to a Reserve Price set by the Seller, Proto Culture Art reserves the right to bid on behalf of a Seller, up to the amount of any Reserve Price. Registering and Approval to Bid: Prospective bidders must register 24 hours before the sale date. Due to the ever increasing internet fraudulent activities, Proto Cultures Art will request a form of identification such as a photocopy of a government issued I.D such as passport or driving license which can be sent via email. We reserve the right to refuse to register any bidder or to refuse any bid at their sole discretion and without stating any reason. Payments: Proto Cultures Art will only accept payments in British Pounds (GBP) within three (3) days of the date of the sale. Cash payments of any amount will NOT be accepted. Our preferred payment method is Wire Transfer (see bank details at the bottom of the page). NON-UK issued Credit Card payments are accepted and carry a 3% additional charge. UK-issued Credit or Debit cards do not carry extra charges. Card payments will be processed offline and may take a while to processed whilst verifying the necessary checks with the card company. Premium and Value Added Tax (VAT) The buyer shall pay the hammer price together with a premium of 20% plus 5% VAT (totalling 25%) for UK residents. NON-UK residents pay the hammer price plus 20% premium. Packaging and Shipping Proto Cultures Art will not accept any lots to be picked up in person. Shipping can be arranged either in-house for small non fragile lots or use Mail Boxes (Romford) for large and/or fragile lots. Please email us your preference. Overseas Import Regulations and Endangered Species: Lots which are made of or contain material of endangered species, regulations, import tariffs, taxes, restrictions or other related criteria where the buyer resides are the sole responsibility of the buyer. Proto Cultures Art will not be responsible for any delays or other actions arising from any customs import procedures. CITES Regulations: Please note that lots marked with * may be subject to CITES regulations when exported. Prospective buyers are strongly advised to check if the lot(s) are subject to CITES Regulations which may be found on at /ahvla-en/imports-exports/cites/ Disputes: In the unlikely event of a dispute, the buyer must notify Proto Cultures Art Ltd. immediately but no later than fourteen (14) days after the date of the sale, in writing and stipulating fully the grounds for such dispute. We will consider all the grounds for dispute and will have the final decision. During the progress of any dispute, Proto Cultures Art Ltd. shall hold any and all monies paid by the buyer until such time as the matter is finalised. No claim will be considered unless the item is first returned to us in the same condition as at the time of sale. Shipping costs are no refundable. Your Personal Data: Where Proto Culture Art processes any personal data, it will comply with the requirements and obligations under the U.K. Data Protection Legislation. Acceptance of Buying/Bidding Terms: Any person bidding at any sale is deemed to have read and accepted these terms in full and undertakes to fully indemnify Proto Cultures Art Ltd. against any claims.
