Property listed for sale in this auction will be sold in accordance with the following terms and conditions. 1. Every effort has been made by Frank & Frank Sporting Collectibles LLC to describe articles offered for sale accurately. However, all property offered is sold ?as is? and all sales are final. It is suggested that prospective bidders inspect the property before bidding or call this office for a detailed condition report. Any condition statement given as a courtesy our clients is only an opinion and should not be treated as a statement of fact. Title passes on the fall of the auctioneer?s hammer to the highest acknowledged bidder subject to these conditions of sale. At that time, that purchaser assumes full risk and responsibility for that lot, including liability for damage. 2. A ?Buyer?s Premium? in the amount of 23% (discounted to 20% for cash or check) shall be added to the successful bid price and is payable by the purchaser as part of the total purchase price. 3. Frank & Frank Sporting Collectibles, LLC reserves the right to withdraw any property or alter any catalog description prior to the sale and shall have no liability for such action. 4. Frank & Frank Sporting Collectibles, LLC reserves the right to reject any bid. The highest bidder acknowledged by the auctioneer will be the purchaser. Should there be a dispute between bidders, the decision of the auctioneer will be binding. 5. The auctioneer may reject any opening bid which he deems is insufficient and withdraw the article from the sale. The auctioneer may also reject any advance which he decides is insufficient. 6. All items purchased are subject to sales tax, unless the purchaser possesses a valid tax exemption number. 7. Payment is due at the time of purchase. No property will be released without payment in full. Methods of payment are cash, approved check, and Visa or MasterCard. Payment not received within 30 days of the receipt of an invoice will be subject to 1.5% late payment fee which will continue to accrue and compound per each additional 30-day period. 8. Frank & Frank Sporting Collectibles, LLC offers in-house shipping as a convenience to our clients. . Items deemed to be too fragile for in-house shipping may be professionally wrapped and insured by UPS. However, purchasers have the option to provide for their own shipping arrangements. All shipping, wrapping and insurance charges are the responsibility of the purchaser. All packaging, handling and shipping is at the sole risk of the purchaser, and the auction house shall have no liability for any loss or damage to such items. Purchases will be shipped to the address listed on the purchaser?s invoice and the auction house shall have no liability for misdirected shipments. Please allow four to five weeks for shipping. 9. Unless otherwise noted, decoys are not sold with stands. All measurements are approximate. 10. In the event of a dispute between bidders, the auctioneer reserves the right to determine the successful bidder, or re-offer and resell the disputed item. 11. Any legal conflict arising from this auction will be heard and judged by the court system in the state of New Jersey. NJSA applies to the auction and participants. 10.
