By registering and by bidding every bidder/buyer unconditionally accepts the terms of use and will therefore not be able to rely on his or her ignorance
In the unlikely event of disputes the court of the district, where the auction has taken place, has the jurisdiction, even in case of multiple defendants. All disputes shall solely be resolved in accordance with the Belgian law.
All goods are sold in the condition they are in, all visible and hidden flaws included. The bidders/buyers are expected to have inspected the lots/tickets thoroughly. By placing a bid the bidder explicitly acknowledges and confirms that the good(s) on which he/she bids has been previously seen and inspected, it is therefore that/whereas the articles of ?Wet Handelingspraktijken 14 July 1994? are not applicable. All goods are sold without warranty, even if the condition, nature, amount or designation is inconsistent with the description in the catalog. The catalog of a lot prevails, a photo of the ticket is merely indicative and supportive. Any mile indications/km-positions, or hours of operation of vehicles/machinery, construction years, first registration data or other technical or commercial specifications are solely indicative communicated without warranty or responsibility of the seller. Any incorrect entry in the catalog gives no cause for destruction or sale purchase dissolution. Each bidder/buyer acknowledges to be aware that no redress is possible.
The bailiff / notary has the ability to verify the identity of the bidders via external databases and to monitor the correctness of the registration. The bailiff / notary may also check/verify the location from where you are logged in through your IP address. The bailiff / notary may exclude any bidder at any time. If during the last 5 minutes before closing a lot receives another bidding, the closure will be postponed per 5 minutes and this after the initial time of closure.
Registration: credentials are also billing information, after allocating these will be unchangeable
The auction fee is 20% of the purchase price in premium including 21% VAT.
The highest bidder is the buyer. Any disputes will be resolved by the bailiff/notary. In this decision no redress is possible. At any time during the auction the auctioneer/bailiff/notary can set up a minimum bid, cancel the sale, split lots/tickets, combine lots/tickets, relist lots/tickets, turn down lots/tickets without reason, involve lots/tickets, exclude bidders from a sale/auction, etc? The auctioneer/bailiff/notary should never justify himself/herself.
Each bidder is bound by his/her bid, even if the bidder is outbid. If the auctioneer/bailiff/notary declines the bidding of the highest bidder, the preceding highest bidder will be designated as buyer.
Each is considered to buy for themselves and therefore severally responsible.
During the auction the auctioneer/bailiff/notary may/can contact bidders and immediate request them to prove their solvency and/or request an advance up to 50% of the full purchase price. By refusing a deposit and/or insolvency the auctioneer/bailiff/notary will immediately exclude the bidder from the auction and the bidding will be canceled. Attention! If during the last 5 minutes before closing a lot receives another bidding, the closure will be postponed per 5 minutes and this after the initial time of closure.
After the allocation the buyers are expected to pay the full amount immediately. The amount(s) can be transferred to the Belfius/Fortis/ING bank account of DefcomVeilinghuis.be and NocturnExclusive.com with mention of the reference number indicated on each e-mail that will be sent to you. Upon the entire payment of the goods an invoice will be electronically sent to the buyer. The bidder/buyer becomes the owner of the goods only after full payment of the purchase price including buyer`s premium and VAT. Goods can only be taken after the full payment of the purchase price, including buyer`s premium and VAT. If the payment is not made before the date specified by the auctioneer, the auctioneer may decide to relist a lot for auction or to assign it to the second highest bidder.
Smart-money: In case of refusal to proceed to payment or insolvency the auctioneer/bailiff/notary will decide whether to relist the lot for auction or assign it to the second highest bidder. The bidder, who committed smart-money, will be held responsible for the suffered damage and he/she will never be able to request the higher incidental price. The bidder, responsible for smart-money, will be excluded from the auctions and will be charged/imposed with an administrative fee equal to the premium with a minimum of 55 euros (excl. VAT). If the buyer, who committed smart-money, does not deal with the payment invitation, concerning the administrative fee, the action house will transfer the file to a collection agency.
Each remain bound by his/her purchase, even if another is specified as buyer. Goods that are not retrieved on the date, specified by the auctioneer, will, without written permission of the auction house, without notice and at the expense of the purchaser, sold or removed without a refund of the purchase price. The cost for evacuation and eventual destruction of those goods will be passed to the buyer. Late pick-ups: ? 45 per hour charge time, with a minimum of one hour, plus administration fee of ? 35 (amounts ex VAT).
EU customers who have a valid and verifiable VAT number in their country of origin, should not pay VAT on their purchase if they present a written certificate regarding the transfer of goods outside Belgium, at the time of the pick-up. Non-taxable EU customers and customers outside the EU (exports) should always pay VAT. The tax paid by buyers outside the EU (exports) will, upon presentation of a valid export document, receive a refund by the auctioneer, within 14 days after the allocation.
For rolling material purchased privately via Defcom-auctions.com, a commission of at least 10% of the sale amount is due. This amount may be lower in the case of a mutual agreement, but 10% remains due in the event of cancellation of the sale for any reason. This percentage is also due for rolling stock found by the buyer abroad, but we are asked to act as traders. (with payments through our account)
After the allocation all goods are at expense and risk of the buyer. The auction house, the seller (owner), bailiff/notary, the curatorship shall not be liable in case of theft, fire, accident, water damage, or any other damage.
Everyone is at his/her own risk present during the viewing and collection days.
Buyers should professionally remove the purchased lots at their own expense and risk, without damaging the buildings and other lots. The liability for such removal lies entirely with the buyer. The buyer is also responsible for his assistants or employees in the removal of the goods. It is forbidden to burn, weld and grind without being sufficiently insured.
Buyers who have purchased tickets that impede or prevent the removal of other lots are expected to retrieve their lot(s), and this on the first day of the collection, without interruption.
In case the owner of the premises or third parties assert rights, concerning a specific lot, before it is retrieved by the buyer, the auctioneer may cancel the contract on condition that the auctioneer has already fully refunded the amount paid, concerning the sale of a specific lot. However the buyer may not assert other rights, the buyer will not be able to claim compensation.
The client, the auctioneer, the bailiff shall not be liable if for technical reasons or malfunctions (f.e. failure of the website, disorders, no Internet access, etc?) the site is not working completely. In this case the auctioneer or bailiff will decide to whom he/she will assign the lot(s) to or to extend the auction or to put the sale back in place. Claims will not be accepted.
