Terms & Conditions
Conditions of Sale:
1. The auction shall be conducted on behalf of and for the account of a third party.
2. The bidding is carried out in euro. Calling prices are the limit prices named in the catalogues. Prices are usually augmented by about 5-10% of the previous bid in Euro.
3. All lots coming up for the auction can be inspected prior to the sale. Objects are auctioned without warranty and liability of the orderer and auctioneer for constitution and description. Complaints after the auction remain unaffected. The items are used and will be sold in the same condition as they were during the acceptance of the bid. The effective constitution of the object (even not mentioned in the catalogue or the internet specifically) is the agreed constitution (§434 Abs. 1 Satz 1 BGB).
4. The auctioneer reserves the right to auction, unite, separate and/or withdraw objects out of the order mentioned in the catalogue.
5. The auctioneer is able to withdraw or deny the acceptance of a bid on behalf of the orderer.
6. A bid is accepted if no higher bid is submitted after the third call of the auctioneer.
7. In case several persons bid the same amount and after the third bid there is no higher bid, the winner is decided by casting lots. If its not possible to immediately agree on an acceptance the object is auctioned again. This is also valid if erroneously a higher bid which was made on time has been overseen.
8. The acceptance of a bid obligates the buyer to take the object and payment has to be made within 6 days after the auction/receipt of invoice. Payments can be made by cash, bank acknowledged cheques or via bank transfer. Payments of foreign buyers who have placed bids by writing via post, email or telephone are due within 10 days after date of invoice. Payment is to be done by cash, bank acknowledged cheques or via bank transfer. Property remains with the seller until complete payment. The risk of damage turns over to the buyer immediately after acceptance of the bid. If the acceptance of the bid is reserved the bidder is bound to his bid. If the customer is new to the auction a cash depot / liquidity acknowledgment by a bank can be claimed.
9. The buyer`s premium of 20% plus valid VAT on the commission is to be paid on the successful winning bid.
10. In general no VAT on export deliveries will be charged. Within the EU this is only valid to companies with identification number. The VAT is repaid as soon as the foreign customers certifies the export permit.
11. On delay of payment the auctioneer is able to choose either performance of the contract or compensation caused by non-performance and reauction the object at the expense of the buyer. The buyer is liable to resulting losses and loses his rights caused by the former acceptance of his bid. He cannot claim optional additional returns and is not permitted to submit a new bid.
12. The auctioneer is able to raise / sue purchase money, payment delays and collateral services on his own behalf representing the deliverer.
13. Buyer and seller are able to receive the address of each other after the end of the auction by the auctioneer.
14. Place of fulfillment and exclusive jurisdiction is the auctioneer's registered seat of commercial enterprise. .
15. German law is exclusively valid.
16. The buyer / seller's statement of account is rendered conditionally subject to verification and revision. The buyer / seller herewith acknowledges the thus resulting credit and / or debit items.
17. By submitting a bid or a written order the buyer acknowledges the conditions of sale to be obligatory.
18. In the premises of the auctioneer every visitor is liable "especially during previews" for every damage caused by him.
19. These auction conditions are also applying to all objects which remain unsold during the auction and are part of the three-week post auction sale. The post auction sale is part of the auction. During the post auction sale the bidder is able to set an order by telephone or by writing with a certain amount. In the previous mentioned cases the statements of the contracts (§§ 312b & 312d BGB) are not valid. In case one or several statements of these auction conditions are void or become void all other conditions are not effected.
20. In case the auction conditions are available in different languages the German version is standard.
Conditions for consignment
1. The auctioneer is instructed to sell the items submitted - which are in the unrestricted ownership of the Client - by public and voluntary auction.
2. The auction shall be conducted on behalf of and for the account of a third party. Clearing occurs within 14 days subject to the buyer's payment.
3. In case the object remains unsold the customer is not charged any fees except for agreed image costs.
4. Until the auction is put up the orderer is bound to the contract. If the order is withdrawn partly or wholly a fee of 25 % plus valid VAT will be charged.
5. The deliverer is liable to assured object descriptions. A fault which is not recognized during the receipt of the object results in reduction of the limit price or denial of the object.
6. The auction is based on the previous mentioned auction conditions.
7. For the auction the auctioneer receives a commission from the selling price of about 15% plus valid VAT on the surcharge. If the selling price does not exceed â?¬ 1.000 the commission amounts to 18,5 % plus valid VAT.
8. The auctioneer cannot be made liable for not gathered purchase money.
9. The proportionate insurance commission amounts to 0,83% is only charged in case the object is sold.
10. Costs caused by §26 (2,5% of the acceptance of the bid price).
11. An orderer who runs a business is obliged to pay the VAT caused by made transactions by himself.
12. Costs for catalogue images are graded by dimension.
