TERMS AND CONDITIONS OF SALEBIDDER / BUYER TERMS AND CONDITIONS OF SALEThe following, as amended by any posted notices or announcements during the sale, constitutes the entire Terms and Conditions of Sale on which property listed in the catalog shall be offered for sale or sold by Lacantus Auction & Antique Store LLC (LACANTUS). PLEASE READ THIS ENTIRE AGREEMENT.
These Terms and Conditions of Sale or Bidder / Buyer Terms and Conditions of Sale use the words Lot(s), Object(s), Product(s), Item(s), as synonyms and in this particular case they are interchangeable, meaning the same thing in each case and only representing the extensive variety of types of sales that a LACANTUS auction can offer.
Be advised that by placing a bid, you are entering into a legally binding contract with LACANTUS. If you are the successful and winning bidder, you have a legal obligation to purchase the property bid from the seller. Place a bid only if you are serious about buying the item. LACANTUS reserves the right to withdraw or combine any Lot(s), Object(s), Product(s) or Item(s) listed in the catalog at any time with no liability.
1. FINAL SALE. All Item(s), Lot(s), Object(s) or Product(s) are final sale.ALL SALES ARE FINAL. NO REFUNDS / RETURNS or EXCHANGES.
Shipping, handling, packaging (and insurance), and Buyer Premium are not included in the final sale price of the auction. It will be included separately on the invoice sent by email to the Buyer / Bidder with the Shipping, packaging, handling (and insurance) details.
The email / invoice will be sent by LACANTUS (from SALES@LACANTUS.COM or INFO@LACANTUS.COM or LACANTUS.STORE@GMAIL.COM.) 2/3 business days after the auction ends to the Buyer / Bidder. If the Buyer / Bidder does not receive this email, it is the Buyer / Bidder's responsibility to contact LACANTUS to complete the transaction. This email / invoice will be sent by LACANTUS from SALES@LACANTUS.COM or INFO@LACANTUS.COM or LACANTUS.STORE@GMAIL.COM. We strongly recommend buyers to check the Spam folder of their email inbox.
International buyers (outside the United States), customs duties or any other taxes related to the Buyer / Bidder's country are the sole responsibility of the Buyer / Bidder.
LIABILITY AND DISCLAIMER:All items are sold as is, where is, with all faults, all sales are final. No refunds and no exchanges are accepted. All items are sold "as is" and neither the auctioneer nor the consignor makes any warranties or representations of any kind with respect to the items, and in no event shall they be responsible for the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, period, source, origin, signatures or historical relevance of the items and no statement anywhere, whether oral or written (even if Lacantus Auction & Antique Store LLC provide Authenticity Certification for most Item(s), Object(s), Lot(s) or Product(s), read more below), shall be deemed such a warranty or representation.
While LACANTUS representatives, to the best of their ability, describe the items for sale, any statement, whether oral or written, by any LACANTUS representative are mere opinions and shall not be deemed a warranty or representation regarding the property offered for sale. The bidder is responsible for determining the age, size, condition and value of the property before bidding. By placing a bid, you signify that you have examined the property to your satisfaction or have chosen not to examine it.
Lacantus Auction & Antique Store LLC, and any consignor as applicable, disclaim any and all warranties, expressed or implied, including but not limited to the implied warranty of merchantability or fitness for any particular purpose. No warranties are made that the merchandise or property offered for sale is what it is described to be by LACANTUS or the catalog and no warranties are made that any of the merchandise or property offered for sale complies with any applicable governmental rules, regulations or ordinances of any kind or nature whatsoever.
TOTAL SALES PRICE: The total sales price of an Item(s), Object(s), Lot(s) or Product(s) is the highest bid (made by the bidder = buyer) plus a 15% buyer's premium. ALL SALES ARE FINAL. Packing, handling, shipping, and insurance are not included in the sales price and will be added to the final invoice after the conclusion of an auction.
RESERVE PRICE:Most of the lots in this sale are offered subject to a reserve. This reserve is a confidential minimum price agreed upon by the consignor and Lacantus Auction & Antique Store LLC below which the lot will not be sold. In any event when a lot is subject to a reserve, we reserve the right to reject any bids placed before or after the auction has concluded. A representative of Lacantus Auction & Antique Store LLC will execute such reserves by bidding for the consignor. LACANTUS, and consignors, reserve the right to bid on any lots. Unless specifically stated otherwise, all lots are subject to reserve price that shall be hidden from bidders. LACANTUS shall act to protect the reserve by bidding in the auction process if needed. LACANTUS may open bidding on any lot below the reserve by placing its own bid. LACANTUS may continue to bid on behalf of itself up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. In the event of any dispute between the bidder or in the event of any doubt by LACANTUS as to the validity of any bid, LACANTUS will have the final discretion to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises, after the sale, LACANTUS's sale record is conclusive of the event. While LACANTUS will make every effort to guarantee accuracy,
BUYER'S PREMIUM: All Propertie(s)/Object(s)/Item(s)/ Lot(s) or Product(s) offered at the Auction is subject to 12% Buyer's Premium which will be added to the successful bid price and is payable by the purchaser as part of the total purchase price to LACANTUS for LACANTUS's own account. The Buyer's Premium is earned by LACANTUS as part of the administration process and is non-refundable. All Properties/Object(s)/Item(s)/ Lot(s) or Product(s) are subject to a 12% buyer's premium regardless of bidding or payment method. In many cases, as a courtesy, LACANTUS will share a percentage of the BUYER PREMIUM to help buyers amortize the shipping price.
DESCRIPTION, DETAILS, INFORMATION:Any description of the Item(s), Object(s), Product(s) or Lot(s) contained in this auction is for the sole purpose of identifying the Item(s), Object(s), Product(s) or Lot(s), and no description of Item(s), Object(s), Product(s) or Lot(s) has been made part of the basis of the bargain or has created any express warranty that the goods would conform to any description made by Lacantus Auction & Antique Store LLC.
In the unlikely event that we lose our internet connection or Item(s), Object(s), Product(s) or Lot(s) have inappropriate data due to technical errors in the system such as images mismatched or not available, Item(s), Object(s), Product(s) or Lot(s) with incorrect information, price or certificate, Lacantus Auction & Antique Store LLC reserves the right in its sole and absolute discretion to cancel the remainder of the auction and/or rescind all winning bids.
CERTIFICATE OF AUTHENTICITY
Lacantus Auction & Antique Store LLC, nor any consignor, as applicable, make any representations and/or warranties of any kind with regard to the property being sold or its value, and in no event shall be responsible for the correctness of description, genuineness, provenance, authenticity, authorship, attribution, and/or completeness, estimates of value or condition of the property. All estimates or evaluations provided are solely for the convenience of the Bidder and LACANTUS does not make any warranties of any kind relating to them. Estimates may include valuations that reflect the full, higher price at retail of an item in a specific geographic region. The term estimates or estimated value as used herein may be an arbitrary value and may not represent an actual retail value or insured replacement value or cost of similar goods. Also, no estimated value should be considered to represent the actual resale value, insurance replacement value, or cost of similar goods. No statement whether oral or written shall be deemed to be such a warranty or representation, or any assumption of responsibility in no circumstances will a vastly different appraisal, valuation or estimate of any third party given on behalf of a purchaser in any Company conducted auction be grounds for a return, cancellation or refund. All measurements given are approximate and within industry standards and customs.
As a courtesy, Lacantus Auction & Antique Store LLC provides its own Certificate of Authenticity in the description of most Item(s), Object(s), Lot(s) or Product(s) offered for sale during the auction. As explained above this Certificate of Authenticity does not offer any guarantee or warranty expressed or implied to the Buyer / Bidder, meaning (that this Certificate of Authenticity) it's only a confirmation that the object comes from Highly Reliable sources and that it has been reviewed, analyzed, inspected and/or tested by outsourced specialized expert partners of LACANTUS, who legitimize the authenticity of all the characteristics and details of the object offered at auction. "Authenticity" means here, and in this case, that the description and details of the Item(s), Object(s), Lot(s) or Product(s) will try to be as accurate and real as possible for the satisfaction and comfort of the Buyer / Bidder, but LACANTUS assumes no responsibility for any inaccuracies, errors, or lack of information on any Item(s), Object(s), Lot(s) or Product(s) offered for sale in the auction. The Authenticity Certification is only a guide, orientation and help to the Buyer / Bidder that LACANTUS will always do its best to offer the Best Service and the Highest Quality to its customers.
This Authenticity Certification could be shipped / delivered on different dates, independently or separately of the Item(s), Object(s), Lot(s) or Product(s). If you didn't receive the Authenticity Certification after 7 business days of receiving your Item(s), Object(s), Lot(s) or Product(s), feel free to contact us at sales@lacantus.com.
BIDDERS, BIDDING & SALE:Bidder's bids always represent an irrevocable offer by bidder to enter into a binding contract to purchase the Item(s), Object(s), Product(s) or Lot(s) in accordance with the specific provisions of the listing and these general Terms and Conditions of Sale as applicable, even if a higher bid was received by Lacantus Auction & Antique Store LLC. All bids are binding, irrevocable and non-cancellable by the bidder. Lacantus Auction & Antique Store LLC has final discretion on sale of an Item(s), Object(s), Product(s) or Lot(s). The decision of Lacantus Auction & Antique Store LLC is final.
No Bid Retraction. YOU may not retract a bid that has been acknowledged by Lacantus Auction & Antique Store LLC or that has been submitted online. YOU acknowledge and agree that Lacantus Auction & Antique Store LLC is acting in reliance on tendered bids in the conduct of the Auction, and that bid retraction is disruptive and interferes with the Auction, and that, as an inducement for Lacantus Auction & Antique Store LLC to accept YOUR Bidder Registration and for YOU to bid at the Auction, YOU agrees not to withdraw or to attempt to withdraw any tendered bid by YOU or on your behalf.
Prospective bidders should inspect the merchandise thoroughly before bidding to determine its condition, size and whether or not it has been repaired or restored based on the description details of the Item(s), Object(s), Product(s) or Lot(s). Lacantus Auction & Antique Store LLC reserves the right to reject any opening bid which it feels is unacceptable or too low and reserves the right to withdraw any property from the sale. In the unlikely event that we lose our Internet connection, Lacantus Auction & Antique Store LLC reserves the right, in its sole and absolute discretion, to cancel the remainder of the Internet Auction.
If the bidder requires absolute certainty in all areas of authenticity, and the results of the evaluation leave uncertainty in the bidder's mind, do not bid on the lot in question. Items sold by us are sourced from multiple channels and highly reliable sources and there are no assurances that any of the items being sold have been seized. LACANTUS is not authorized dealers of Rolex, Cartier or other watch brands that are sold at auction. We carry pre-owned watches from secondary markets in exceptionally excellent condition.
Winning Bid. The highest bidder shall be the buyer and if any dispute arises between two or more bidders, the auction coordinator shall decide the buyer. We are not responsible for any technical issues or bids placed by accident. All sales are final & refunds will not be given. Successful bidders must pay for the entire invoice before any Item(s), Object(s), Product(s) or Lot(s) are removed or shipped from our gallery / catalogue. After the auction ends, all items must be paid for and removed within THREE (3) BUSINESS DAYS after LACANTUS send the invoice to the winning bidder / buyer.
Each entity (i.e., corporation, limited liability company, or other organization) registering to bid represents that it has the power and authority to register, to bid, and to complete the purchase transaction if it is the Winning Bidder. Bid(s) made by or on behalf of a corporation, limited liability company, or any other entity, must be personally guaranteed by one or more officers of the entity. If bids are made by or on behalf of an entity, the entity and any individual making the bid will be jointly and severally liable on account of the bid.
Responsibility for Online Bids. YOU are responsible for all bids transmitted from YOUR computer or device, or from YOUR Bidder Account. If a Winning Bid is sent from YOUR computer or device, or from YOUR Bidder Account, YOU will be the BUYER.
LACANTUS reserves the right, at our complete discretion, to refuse admission to the premises or participation in any auction and to reject any bid, as well as the right to refuse to acknowledge any bidder. The highest bidder acknowledged by the auctioneer will be the purchaser. LACANTUS has the right at his absolute and sole discretion to advance the bidding in such a manner as he may decide, to withdraw or divide any lot, and to combine any two or more lots. In the event of error or dispute between bidders, or in the event of doubt on our part as to the validity of any bid, whether during or after the sale, LACANTUS has final discretion to determine the successful bidder, to continue the bidding, to cancel the sale, or to re-offer and resell the lot in dispute. If any dispute arises after the sale, the LACANTUS sale record shall be conclusive.
LACANTUS may, in LACANTUS's absolute discretion, receive bids from a person or entity that has not registered to bid, and/or who has not satisfied all requirements for Bidder Registration, and/or that has not previously been granted bidding privileges, and, by bidding, such person or entity will be bound by these Bidder Terms and Conditions, any and all other terms and conditions posted on LACANTUS's website(s), and the terms and conditions posted on the websites of any Online Auction Platform Provider(s) used by LACANTUS.
YOU acknowledge and agree that YOU have read, understand, and agree to be bound by, these Bidder Terms and Conditions of Sale, any and all other Terms and Conditions posted on the Lacantus Auction & Antique Store LLC website(s), and the Terms and Conditions posted on the websites of any Online Auction Platform Provider(s) used by Lacantus Auction & Antique Store LLC.
DATA, COMUNICATION, EMAIL: By registering to bid with Lacantus Auction & Antique Store LLC you have elected to receive email communications from Lacantus Auction & Antique Store LLC including auction news and/or announcements. If you do not want to receive auction news and/or announcements from Lacantus Auction & Antique Store LLC you may unsubscribe at any time by selecting the "Unsubscribe" link at the bottom of the email or by contacting us at info@lacantus.com.
TECHNOLOGY FAILURES & DISRUPTIONS:Technology Disruptions. Lacantus Auction & Antique Store LLC will not be responsible for technology disruptions, errors, or failures (including disruptions to bidding or the failure to execute, recognize, or record online bids), whether caused by loss of connectivity, breakdown, disruption, or failure of the Online Auction Platform, breakdown, disruption, or failure of a Bidder's internet connection, computer, or system, or otherwise. Lacantus Auction & Antique Store LLC may, but will not be required to, continue, suspend, delay, extend, reschedule, or close the Auction because of disruptions caused by technology failures, even after bidding has commenced.
Failures by Online Auction Platform Provider and its Affiliates or Contractors. Lacantus Auction & Antique Store LLC will use an Online Auction Platform Provider to facilitate the Auction. Under no circumstances will Lacantus Auction & Antique Store LLC be liable for any failure of the Online Auction Platform Provider to perform all or any of its obligations, or for the failure of any affiliates, employees, agents, representatives, or contractors of the Online Auction Platform Provider to perform their obligations.
SHIPPING AND INSURANCE:
All shipping charges will be borne by the successful Bidder. The Buyer assumes full risk and responsibility for the purchased property, including all costs and expenses of handling, materials, shipping, carrier fees, insurance and export (if aplicable), and is liable for the full purchase price. Item(s), Object(s), Product(s) or Lot(s) must be paid for in full before they will be released to be shipped. Any risk of loss during shipment will be borne by the buyer following Lacantus Auction & Antique Store LLC's delivery to the designated common carrier. Regardless of domestic or foreign shipment, risk of loss shall be borne by the buyer following Lacantus Auction & Antique Store LLC's delivery to a shipper.
Shipping & Packing: Lacantus Auction & Antique Store LLC is pleased to offer to ship on Most Item(s), Object(s), Product(s) or Lot(s) offered in our Auctions. We ship Worldwide. For multiple Item(s), Object(s), Product(s) or Lot(s) purchases, we will always do our best to combine shipments in order to save our customers as much money as possible. We offer shipping service through reliable third party partners, so our customers can relax knowing we are taking care of everything on our end and simply requiring their signatures upon delivery. In most cases, Winning bidder will receive an email from the courier site or from LACANTUS with tracking information for their package(s). Please allow a maximum of 2-3 weeks (or a minimum of 10 business days) for organizing, preparing and shipping your Item(s), Object(s), Product(s) or Lot(s) after purchase.
Lacantus Auction & Antique Store LLC has made arrangements with a variety of trusted third party shippers to provide the best shipping service for you. Lacantus Auction & Antique Store LLC will not use lower classes of mail to ship sold merchandize due to increased risk of loss. All charges for shipping, handling, packaging, signature delivery and insurance will be added to the buyer's invoice after the auction is complete. Any shipping estimates given are only estimates and cannot be construed as the final shipping cost.
Special shipping and handling requests may be accommodated on a limited basis at Lacantus Auction & Antique Store LLC's sole discretion and may incur additional handling charges. All costs charged to a Bidder's original invoice are estimates and LACANTUS reserves the right to charge additional amounts if such estimates are exceeded. By acknowledging this Agreement, Buyer agrees to any additional charges as may be necessary to accommodate special shipping and handling requests. Shipping and handling charges to Hawaii, Alaska, US Territories and Foreign Countries are higher and often require registry or express mail.
All U.S. domestic shipments and Worldwide shipments are insured. For most items, we pay for extra insurance services at our own expense as a security for both our Bidders and Lacantus Auction & Antique Store LLC. We also require a Direct Signature from the Bidder once the merchandise is received. Large, heavy, fragile or otherwise unusual Item(s), Object(s), Product(s) or Lot(s) will incur additional charges. Refusal to accept merchandize delivered by LACANTUS to the bidder constitutes an unauthorized return in direct violation of these General Terms and Conditions of Sale.
Please contact Lacantus Auction & Antique Store LLC (to sales@lacantus.com or info@lacantus.com) if you need extra time to complete the transaction. It is the responsibility of the Buyer to contact Lacantus Auction & Antique Store LLC to arrange payment If we did not contact the Buyer during 1 or 3 business days, after the auction ended. We will do our best to give honest and trustworthy buyers extra time to complete the transaction, but we will take severe decisions with untrustworthy buyers who intend to harm and obstruct the LACANTUS commercial process. That being clarified, if after that extra time the transaction has not been completed, LACANTUS will start the dispute on the platform and possible legal proceedings.
PICK-UP AND REMOVAL OF GOODS:
Customers / Buyers are not obligated to use Lacantus Auction & Antique Store LLC's shipping partners and the estimate may be removed at the purchaser's request, but LACANTUS strongly recommends insuring your items for their full value during shipping and / or use trusted shipping companies and Customers / Buyers understand that LACANTUS will charge you a $400 fee for obstructing the setup, preparation, packing and shipping process offered by LACANTUS as courtesy, plus additional costs like $50 per day for storage.
YOU are responsible for pick-up and removal of Item(s), Object(s), Product(s) or Lot(s) purchased by YOU. Pick-up location and removal dates and times will be notified to the Customers / Buyers. YOU are solely responsible for the disassembly, rigging, removal, shipping, and transportation of each Item(s), Object(s), Product(s) or Lot(s) purchased by YOU. Disassembly and removal must be done in a professional and workmanlike manner, and YOU will indemnify and hold harmless both Lacantus Auction & Antique Store LLC and Seller(s) against any and all damage caused by YOU or YOUR employees, agents, representatives, or independent contractors in connection with the disassembly or removal of any Item(s), Object(s), Product(s) or Lot(s). Any and all damage, including, without being limited to damage to land or buildings, caused by YOU or by YOUR employees, agents, representatives, or independent contractors, will be repaired by YOU, or at YOUR expense, to the satisfaction of LACANTUS and Seller(s). Possession and risk of loss will pass to you at the point of shipment. YOU are responsible for insuring all Item(s), Object(s), Product(s) or Lot(s) purchased by YOU.
Failure Pick-up or Arrange for the Delivery; Abandoned Property; Storage. If YOU are certified as the Winning Bidder on one or more Item(s), Object(s), Product(s) or Lot(s), and, after paying the Contract Price for such Item(s), Object(s), Product(s) or Lot(s), YOU fail to pick-up or remove such Item(s), Object(s), Product(s) or Lot(s) within ____ten______ ( _10_) days after the payment of the invoice and within the dates and times notified by LACANTUS, YOU will be deemed to have abandoned such Item(s), Object(s), Product(s) or Lot(s), and any interest therein, to LACANTUS, and YOU will give up any and all rights with respect to such Item(s), Object(s), Product(s) or Lot(s). Item(s), Object(s), Product(s) or Lot(s) that have been abandoned to LACANTUS may be retained by LACANTUS, sold at a subsequent auction, or otherwise disposed of. YOU will not be entitled to any proceeds from the sale of any abandoned Item(s), Object(s), Product(s) or Lot(s). Subject to applicable law, beginning ____ten______ (_10_) days after the payment of the invoice, and continuing until the removal or other disposition of any Item(s), Object(s), Product(s) or Lot(s) not been picked-up or removed, a storage charge in the amount of ________Fifty____ Dollars ($____50______) per day will accrue, and LACANTUS will have a possessory lien against such Item(s), Object(s), Product(s) or Lot(s) that may be executed on in order to satisfy such storage charges.
PAYMENT TERMS / PAYMENT INSTRUCTIONS:
Payments will be made through our highly secure platform (https://www.lacantus.com), protected by SSL certificate, Anti-Fraud Electronic System and 3D Secure (Which is a protocol designed to be an additional security layer for online Credit and Debit Card Transactions).
We accept all major Credit Cards (MasterCard, Visa, American Express, Diners Club, Discover, JBC, Union Pay, Maestro), Wire Transfers, SEPA, AliPay, WeChat, GiroPay, Bacs Direct Debits, BECS debit, OXXO, GrabPay, Boleto, Paypal and Stripe Payments for payments between $1,000 and $2,000, for payments above $2000 only bank / wire transfer is accepted. Depending on the type of Item(s), Object(s), Product(s) or Lot(s) and its value Lacantus Auction & Antique Store LLC reserve the right to refuse certain types of payment for each case, even those stated herein, and/or offer the buyer a specific type of payment method for each case or type of Item(s), Object(s), Product(s) or Lot(s). Lacantus Auction & Antique Store LLC reserves the right to hold any purchase until all funds are cleared and received in our bank.
Within 2/3 business days of the end of the auction, you will receive a separate invoice by email (from sales@lacantus.com or info@lacantus.com) that will allow you to pay online through our highly secure platform. If you didn't receive the email within 2/3 business days, please check your spam folder. Everything MUST be paid for in full within 72 hours (3 days) of the time that invoice is sent. Bidder further agrees that under no circumstances will he/she initiate a charge-back on his/her credit card or on any other payment method that Bidder decides to use for making payments to Lacantus Auction & Antique Store LLC. Payment in full must be cleared prior to shipment of Lot(s) / Item(s). Lacantus Auction & Antique Store LLC reserves the right to hold any purchase until all funds are cleared and received in our bank.
Wire transfer will be required on all purchases over $2,000. Purchases over $5,000 or more will receive a personalized gift from Lacantus Auction & Antique Store LLC additionally of the Certificate of Authenticity if it is included in the description.

Full payment refund will be within 5/7 business days for all cancelled invoices.
Please contact Lacantus Auction & Antique Store LLC (to sales@lacantus.com) if you need extra time to complete the transaction. It is the responsibility of the buyer to contact LACANTUS to arrange payment If we did not contact the Buyer during 1 or 3 business days, after the auction ended. We will do our best to give honest and trustworthy buyers extra time to complete the transaction, but we will take severe decisions with untrustworthy buyers who intend to harm and obstruct the LACANTUS commercial process. That being clarified, if after that extra time the transaction has not been completed, LACANTUS will start the dispute on the platform and possible legal proceedings.

Lacantus Auction & Antique Store LLC sends most but not all jewelry, watches, diamonds and accessories out to a third party experts for the purpose of examining, inspecting, analyzing, testing, evaluating them. All such Item(s), Object(s), Lot(s) or Product(s) are sold as is and may have been worn, been previously repaired, altered, customized or been embellished, never worn or new with tags. With the objective of offering the highest quality to the buyer, LACANTUS is strictly demanding with the Item(s), Object(s), Lot(s) or Product(s) that it accepts to offer or sell in its auctions, and in most cases they are new with tags (except for art, antiques or antiquities), or in excellent or very good used conditions. For purposes of our auctions, the terms custom, modified, or aftermarket may be used interchangeably. such wear, repair or change may display varying levels of evidence. The bidder hereby acknowledges that the absence of any reference to the condition of an Item(s), Object(s), Lot(s) or Product(s) does not imply the absence of wear, repair or customization. While LACANTUS makes every effort to call attention to any altered or modified item of jewelry or watch, the use of new parts or stones in any Item(s), Object(s), Lot(s) or Product(s) shall not constitute a warranty or representation that the items are original in its entirety. These modifications or alterations may impair the ability of the original manufacturer to repair such an item or certify the item as 100 % authentic.
All statements and descriptions relating to such lots, including measurements, authorship, sources or origin, or other aspects are qualified opinions and do not constitute a warranty or representation and are provided for identification purposes only. Not all jewelry, watches or loose stones are appraised, and the appraisals are provided for bidders only in certain instances at the discretion of LACANTUS. Appraisals, if any, should be used to verify gemstone and or metal weights. The appraisals should not be used for valuation of any item. No guarantee, warranty or representation is intended by LACANTUS in any appraisal. All dimensions and weights of such lots are approximate and are consistent with standards and practices in the industry. Condition reports are provided as a courtesy to the prospective buyer. Bidders should take note that such descriptions are not warranties and that watches may need general service, change of battery or further repairs for which the buyer is solely responsible.
WATCHES, JEWELRY & GEMS:If the bidder requires absolute certainty in all areas of authenticity, and the results of the evaluation leave uncertainty in the bidder's mind, do not bid on the lot in question. Lacantus Auction & Antique Store LLC will provide its own Authenticity Certification when the Items sold by Lacantus Auction & Antique Store LLC are sourced from one of the Multiple Verified Channels and / or High-End Sources and there are assurances of the Authenticity and / or Legitimacy of the items. This also means that these Item(s), Object(s), Lot(s) or Product(s) have been verified by Experts and outsourced Partners Specialists of Lacantus Auction & Antique Store LLC.
For example, for Jewelry and Gemstones, Certified gemologists evaluate the weight, size, clarity, and grade of gemstone and/or metal in order to confirm the authenticity and determine the approximate value of the Item(s), Lot(s), Object(s) or Product(s) regardless of including a GIA certificate or not, or in the case of watches, if the description mentions the LACANTUS Certificate of Authenticity, it means that they were verified by specialized watchmakers who determined that the Item(s), Lot(s), Product(s) or Object(s) is not a replica, and that the qualities and characteristics described (brand, material, operation, age, etc), are authentic, regardless of including the papers and the official box of the watch. Otherwise, If LACANTUS does not offer its own Certification of Authenticity in the description of the Item(s), Lot(s), Object(s) or Product(s), LACANTUS are not able to confirm the authenticity of the Item(s), Lot(s), Object(s) or Product(s) and there are no assurances that any of the items being sold during the Auction have been seized or come from reliable and verified sources. The Certification of Authenticity provided by LACANTUS could be shipped separately from the Item(s), Lot(s), Object(s) or Product(s), and could arrive after or before the Item(s), Lot(s), Object(s) or Product(s). The certificate of authenticity provided by Lacantus Auction & Antique Store LLC does not imply any guarantee or warranty expressed or implied (returns, refunds, etc) to the Buyer / Bidder, but confirms the verification and/or in-depth analysis of the Item(s), Lot(s), Object(s) or Product(s) by specialized third-party experts associated with Lacantus Auction & Antique Store LLC.
WORK OF ART CONDITION: In regard to the works of art contained in the catalogue, Lacantus Auction & Antique Store LLC has endeavored to correctly describe and attribute authorship to the best of their knowledge and ability and through the use of outside experts; however, since authentication and/or attribution is a matter of scholarship and therefore subject to change, LACANTUS does not make any express or implied warranties, guarantees, or representations and strongly suggests that prior to bidding the buyer searches for the relevant information through their own means. LACANTUS can offer the Certificate of Authenticity if the painting or sculpture is an antique and has been dated by an associated third-party expert who will determine the country of provenance, the century, era or period of history to which it belongs, signature (form known and unknown artist) or not, and its artistic movement, confirming the legitimacy of most of the characteristics and details of the Item(s), Lot(s), Object(s) or work of art sold at the auction.
POTTERY CONDITION: We have done our best to describe each lot. If Lacantus Auction & Antique Store LLC defines in their catalog a piece being "mint" it is understood that the lot is represented as being free of damage including cracks, chips, hairlines and repairs, unless otherwise stated. The term "mint" means the lot is in the same condition that it was at time of manufacture. A mint lot may contain normal dirt or dust, crazing, base flakes or roughness from grinding, and/or manufacturing flaws including, but not limited to, clay separations, glaze misses, kiln flaws and stilt pulls. Any factory flaws that are considered, in our opinion, obtrusive will be noted. Items described as "excellent" in condition may show signs of light to typical use such as minor scratches to the glaze or base, light wear or fading to color or finish, but never overt damage. Damage, including chips, cracks, hairlines, flakes, breakage, repairs and restorations will be noted in the item's description. In most cases LACANTUS will not provide Authenticity Certification for these Item(s), Lot(s) or Object(s).
GLASSWARE CONDITION: All glassware is sold as is. Lacantus Auction & Antique Store LLC is not responsible for damage of glass covering paintings, drawings, and other works of art, or frames, regardless of cause. LACANTUS will not guarantee the authenticity of any signature unless so stated in the description of the lot that LACANTUS will provide its own Authenticity Certification, which means that the lot was verified by experts and outsourced specialists, meaning that they have corroborated the Authenticity or Legitimacy of the item sold meaning that it has been created by a real artist (known or unknown) instead of being created by an industrial process that would reduce its value and quality as a collectible. We are not responsible for typographical errors.
FAILURE TO PAY:No auction Item(s), Object(s), Product(s) or Lot(s) can be removed from the gallery / catalog until payment has been accepted and cleared. Lacantus Auction & Antique Store LLC is not responsible for bidder errors, auction platform errors, electronic device errors, internet errors and or other bidding mishaps.
If you fail to pay for your purchase(s) within time provided, YOU will be deemed to have abandoned any interest in the Item(s), Object(s), Product(s) or Lot(s) on which YOU tendered the Winning Bid, but YOU will remain liable for payment of the Contract Price for each Lot. Unpaid Item(s), Object(s), Product(s) or Lot(s) may be retained by Seller and/or Lacantus Auction & Antique Store LLC, resold at a subsequent auction, or otherwise disposed of. If unpaid Item(s), Object(s), Product(s) or Lot(s) are sold at a subsequent auction, YOU will be liable for any shortfall or deficiency on the resale of the Item(s), Object(s), Product(s) or Lot(s), plus the costs incurred in connection with reselling the Item(s), Object(s), Product(s) or Lot(s). Under no circumstances will YOU be entitled to any surplus from the resale of any unpaid Item(s), Object(s), Product(s) or Lot(s).
All Item(s) won must be paid for in full within 72 hours (3 days) of the time that invoice is sent or a dispute will be filed with the bidding platform after that period. Once a dispute is filed, claims to unpaid items are void, and Lacantus Auction & Antique Store LLC will have full title and claim to the items in order to resell them at auction. In the event of a filed dispute, the bidder will have 3 business days to contact Lacantus Auction & Antique Store LLC and arrange payment of winning bids before the dispute becomes final and Item(s), Object(s), Product(s) or Lot(s) are listed for re-sale. If payment is not received after a dispute is filed, the buyer will incur a strike on their account, may be suspended from all auctions and will be blocked from all future Lacantus Auction & Antique Store LLC Auctions.
Lacantus Auction & Antique Store LLC and/or Seller may, at any time, commence a lawsuit against YOU for the Contract Price of any unpaid Item(s), Object(s), Product(s) or Lot(s) and/or for any deficiency realized on the resale of such Item(s), Object(s), Product(s) or Lot(s). Subject to applicable law, beginning ____10______ (_10__) days after the Auction, and continuing until the removal or other disposition of any Item(s), Object(s), Product(s) or Lot(s) not been picked-up or removed, a storage charge in the amount of ______Fifty_________ Dollars ($___50______) per day will accrue, and Lacantus Auction & Antique Store LLC will have a possessory lien against such Item(s), Object(s), Product(s) or Lot(s) that may be executed on in order to satisfy such storage charges. We hereby reserve the right to report such non-payment to credit and collection agencies in our sole discretion.
Seller Remedies. If YOU breach YOUR obligations under these Terms and Conditions or under a sale contract with Lacantus Auction & Antique Store LLC of any Item(s), Object(s), Product(s) or Lot(s), such property may be resold and YOU will be responsible for any and all damages, including any deficiency or reduction in the Contract Price, along with incidental damages.
Indemnification. YOU agree to indemnify and hold Lacantus Auction & Antique Store LLC and Seller harmless from any current or future claim regarding the Auction or the Item(s), Object(s), Product(s) or Lot(s), including, without being limited to, fitness, use, damage, safety, or injuries to persons or property.
In summary, If the buyer fails to comply with any of the Terms and Conditions of Sale, we reserve the right to utilize any remedies available to us by law and/or:
I. Hold the defaulting buyer liable for the purchase price.
II. Cancel the sale.
III. Resell the Item(s), Object(s), Product(s) or Lot(s) without reserve at public auction with seven day written notice to the defaulting buyer.
IV. Pay the consignor the amount equal to the net proceeds of the purchase price less the buyer's premium and taxes.
V. If we are forced to resell the property at public or online auction or purchase the property from the consignor the defaulting buyer will be responsible for the difference between the original purchase price and the final sales price. The defaulting buyer will also be responsible for any costs incurred by Lacantus Auction & Antique Store LLC including insurance, legal fees, administration, handling, storage, attorney's fees, commissions, incidental damages and any other costs relating to this transaction. If we agree with the buyer to cancel the sale, we will impose a charge equal to 15% of the total sales price, including 15% buyer's premium.
NO STOP PAYMENT ORDERS or CREDIT CARD CHARGEBACKS: YOU agree that YOU will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the Auction. YOU further agree that if, in violation of these Terms and Conditions, a stop payment order is issued or a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and agreement not to issue a stop payment order or to initiate a credit card chargeback; and YOU acknowledge and agree that on Lacantus Auction & Antique Store LLC's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution against the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Lacantus Auction & Antique Store LLC. If, in violation of these Bidder Terms and Conditions, YOU issue a stop payment order or initiate a credit card chargeback, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys fees, incurred by or on behalf of Lacantus Auction & Antique Store LLC and/or Seller in challenging the stop payment order or credit card chargeback and/or in collecting payment. YOU acknowledge and agree that the covenant not to issue a stop payment order or to initiate a credit card chargeback is a condition to the issuance of a Bidder Number or Bidder Account to YOU, and is being made as an inducement for Lacantus Auction & Antique Store LLC to accept YOUR Bidder Registration, to issue a Bidder Number or Bidder Account to YOU, and to permit YOU to bid at the Auction. YOU acknowledge and agree that Lacantus Auction & Antique Store LLC is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting YOUR Bidder Registration, in issuing a Bidder Number or Bidder Account, and in permitting YOU to bid at the Auction.
DISPUTE RESOLUTION:
If any dispute arises between the bidder and Lacantus Auction & Antique Store LLC that cannot be resolved, then the parties agree to submit the matter to binding arbitration to be conducted under the rules, regulations and procedures of the dispute resolution process described herein and agree to the following procedures for resolution of the dispute. If either party alleges that the other party is in default under this Agreement, the dispute or allegations shall be submitted to binding arbitration in the State of Delaware. Lacantus Auction & Antique Store LLC shall select a neutral arbitrator or alternative dispute resolution organization. The arbitration process shall be initiated by either party requesting arbitration which must be served upon the other by certified mail return receipt requested. Failure to participate in the arbitration is a default. If an arbitration procedure is initiated by request of a bidder, the bidder shall bear the initial financial burden of fees paid to the arbitrator to the maximum amount available by law. Each party shall simply present their case limited to a maximum of one hour for each party to the arbitrator.
By bidding on a lot the bidder hereby agrees and acknowledges that it is completely waiving its rights to have the dispute heard in a court of law. The bidder agrees that the arbitrator shall have complete jurisdiction over the dispute and can issue an award to the prevailing party. Arbitration fees shall be paid by the party prevailing in the dispute or as seen fit by the arbitrator. Any award determined by the arbitrator shall be binding and the prevailing party shall be awarded full reimbursement of its actual paid fees in connection with the dispute. By participating in a Company auction, bidder specifically agrees to the dispute resolution specified in the foregoing paragraph as bidder's SOLE means to resolve any and all disputes which may arise with Lacantus Auction & Antique Store LLC arising out of this Agreement and bidder's bids. By bidding, the bidder specifically agrees that it will not file a dispute claim of any kind with an online venue, a credit card or any other third parties. Bidder specifically waives the right to initiate a credit card chargeback dispute on any basis of claim, and agrees that bidder will pay Lacantus Auction & Antique Store LLC a minimum of $500.00 plus hourly charges and costs for any such chargeback dispute opened due to the severe administrative burden of such disputes and their direct violation of the dispute provisions above. In the event that bidder violates this dispute resolution provisions, in consideration of Lacantus Auction & Antique Store LLC's approval of the application of the bidder to bid in Lacantus Auction & Antique Store LLC's auctions, bidder confesses judgment to fraud having been committed by bidder against Lacantus Auction & Antique Store LLC and further agrees that the bidder is liable to Lacantus Auction & Antique Store LLC for all damages, losses and costs including time charges.
The bidder hereby waives, releases, remises, acquits and forever discharges Lacantus Auction & Antique Store LLC and any consignor, and shall indemnify and hold them harmless against any claims, actions causes of action, demands, rights damages, costs, expenses or compensation whatsoever directly or indirectly known or unknown foreseen or unforeseen which the bidder now has or which may arise in the future on the account of any or in any way growing out of or connected with any defects, latent or otherwise or the physical condition of any items or lots purchased or any law or regulation applicable thereto Lacantus Auction & Antique Store LLC or consignor shall provide notice to bidder promptly of any such claim, suit or proceeding.
REFUNDS AND EXCHANGES:
Under the terms of this agreement, the buyer acknowledges that there are no refunds or exchanges. If the buyer needs an exception, he/she must write to Lacantus Auction & Antique Store LLC within 2 business days of delivery. Lacantus Auction & Antique Store LLC has the sole discretion to approve a return. In the event Lacantus Auction & Antique Store LLC approves a refund, the buyer will be responsible for a 20% restocking fee based on the item's hammer price, all shipping costs, and the buyer's premium. The restocking fee, shipping costs, and buyer's premium will be deducted from the refund. Sales tax (if applicable) will also be adjusted based on the refund. The refund will be processed within 15 business days of the product's return and the product must be delivered in the same condition as sent to the buyer.
Unauthorized returns will be rejected.
ACCEPTANCE OF BIDDER / BUYER TERMS AND CONDITIONS OF SALE: YOU acknowledge and agree that YOU have had a full and fair opportunity to review these Bidder Terms and Conditions, and that you have read these Bidder Terms and Conditions of Sale, you understand these Bidder Terms and Conditions, and you accept and agree to be bound by these Bidder Terms and Conditions.
