GENERAL CONDITIONS
1. General Information.
The information given in our catalogs and announcements is made by experts, who graduated in Art and specialists, antiques, ivories, jewelry, decorative objects, and all kinds of art; especially in ancient Chinese art. Making your assessment for our more qualified experts in each subject.
2. Data protection law.
In compliance with current Spanish legislation on data protection of a personal nature and of the European regulation RGPD 679/2016 we inform you that the personal data collected on the occasion of contracting the services of mediation offered by the Chamber, both vendors, bidders, and successful bidders, will be incorporated into a file, your data is being processed by
the part of Darley Arts s.l. with CIF B98606007, for the purpose of maintenance and management of commercial and administrative relations. The legal basis of the treatment is compliance with tax, legal-mercantile, and accounting legislation. Are not foreseen international assignments and/or transfers of data. To exercise your rights You can contact Darley Arts s.l., domiciled at Av. Men?ndez Pidal 13 Pl Bj, 46009, Valencia, Spain. Being able to exercise at any time the rights of access, rectification, cancellation, or opposition of your personal data by requesting it in writing and attaching a photocopy of your ID, to the email: info@subastasdarley.com or by contacting us.
3. Rules.
Auctions Darley will carry out the auction of objects, works of art, jewels, etc. in accordance with the applicable and current regulations, as well as the commercial uses that traditionally the government indicates in this type of operation.
However, the sale of a lot may be rescinded and its price returned to the buyer, if the buyer notifies Darley Auctions in writing, before the fifteen calendar days following the auction, which in his opinion the lot is a deliberate forgery, having to prove it in a way reliable.
The responsibility in case of litigation on the authenticity, state or origin of a lot presented or sold by Darley Auctions will only be given when there is an express lack of personnel or evidence of having been able to avoid it with the usual means available to us.
The seller, the successful tenderer or buyer is responsible for obtaining and contributing where appropriate, to your exclusive account and position, legal and administrative documentation, licenses, and permits of any class, including those of import or export, which are eventually required by public authorities and administrations, either national or international, for the legal transport and commercialization of the objects or lots that are deposited for sale and/or the lots that have been awarded or acquired at Darley Auctions. If said documentation is not obtained it will not affect the sale or acquisition made, the successful bidder have to pay the price of the lot and the Buyer's Premium accorded and other possible amounts accrued to Auctions Darley.
4. Specific conditions regarding identification.
The identification data of the lots relative to the author, provenance, and status are included after careful investigation, verification and advice, although on its final accuracy Darley does not accept any responsibility. The valuation is made according to the most loyal and good understanding. Interested parties should form their own opinions regarding the pieces during the days prior to the auction, using one of the means that offers Darley Auctions; photographs of the lot on the website, printed catalog (for face-to-face auctions), exposure prior to the face-to-face auction ... ?In the lots that the existence of a certified study or publication carried out by a specialist outside this room, it is considered that the buyer accepts as the validity of this document in terms of the guarantee of authenticity. Any manifestation or declaration that appears in an Auction of the Platform, referred to authorship, attribution, date, age, and provenance, corresponds to the expression of an opinion that is governed by the interpretive terms.
RULES FOR THE BUYER.
1. Identification.
Once bidders solicit be registered as a bidder Darley Auctions are accepting these General Conditions and the privacy policy of Darley Auctions, providing the following documentation, which must be authentic and valid. Any falsehood, denial, or manipulation of details given to the Darley Auctions team will cancel the buyer registration.
-Individuals: Must have complete and authentic details filled in the user account.
Darley staff can solicit ID or any other accrediting legal document, valid and provided with photography at any moment. In case the property is bid by a third party, it will be necessary for the written authorization of the final buyer together with their valid ID or accrediting legal document, assuming the person making the bid has the veracity of the documentation provided.
2. The exhibition and cataloging of the auction.
During the period of exposure prior to the auction, the buyer will be able to check by itself, the status of the lots as well as check that the cataloging is reliable and establish his own opinion regarding said lots. The data and information contained in the catalog represent a good faith opinion fruit of the study and investigation of the auction experts and taking into account the declarations of its owners and/or sellers. However, Darley Auctions does not assume any responsibility with respect to the certainty and the accuracy of the same, not being responsible for the accuracy of the author, origin, date, seniority, or origin.
Considering the catalog as orientation.
The lots are auctioned in the state in which they are, not accepting Darley Auctions any claim related to restorations, damage, breakage, etc. Already it existed during the exhibition despite not being described or indicated in the catalog. The lots to be auctioned will be exhibited, at least ten days in advance, at the Darley Auction premises, in order to allow a perfect examination of them to potentially interested buyers.
Darley Auctions reserves the right to catalog lots, change or subdivide to their expert judgment or if they are to be withdrawn for justified reasons.
3. Bid online.
People wishing to bid on Darley Auctions (using any way available for each lot and conditions described in the catalog) are accepting the auction conditions at the tables destined for this purpose. Each user has his corresponding pallet number. In the event that several written bids of the same amount are received for the same lot, the oldest offer is given priority.
Likewise, in the event of a tie between a bid made in the Room or by phone and an offer made in writing, the latter will take precedence.
Absentee bids will be defended by Darley to the limit indicated, trying to award the lot offered at the lowest price possible. The Chamber reserves the right to refuse written bids received 24 hours prior to the auction, without the need for justification or any explanation.

All customers at Darley Auctions must solicite to bid a pre-register only on preferred lots. It is compulsory to send the application at least two working days before the sale. To bid on this lot via Telephone or Online at any platform you must complete the registration process at least 24 hours prior to the sale. Darley Auctions reserve the right to don't accept any application completed after the present deadline. For more detailed information email info@subastasdarley.com.
The Spanish State reserves the right to detain or to retract the lots that are auctioned and may exercise the right of first refusal in the act of the auction itself or that of withdrawal within the terms established by law. bidders as a requirement to participate in the auction that will never exceed 30%
of the starting price of the lot. The surety of the successful bidders, in the case of awarding of the lot, will be considered as payment on account of the amounts accrued. The deposit will be returned to the bidders who are not successful, within three (3) days following the auction date. The Chamber may also require bidders, when deemed appropriate, to reference banking in order to ensure their solvency.
All bidders bidding in a live auction agree that each bid submitted is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted (including the liability to pay in full and on time in accordance with the Bid Conditions for any lot that is the subject of a successful bid submitted from your account).
Bidders agree that Online Bidding can have technical issues. The platform is dependent upon, among other things, the availability of the internet and the speed and quality of internet connections, or clerking manage issues or external causes to Darley.
4-Commission as an intermediary.
The Buyer's Premium to be paid by the awardee to Darley Auctions for the concept of mediator in the operation is 27% plus VAT. The full amount of the invoice, costs of advice, packaging, storage, and transportation will be paid by the successful buyer before the removal of the goods acquired at Darley Auctions.
5- Payment methods. The successful bidder must pay and withdraw the lots purchased during the 15 working days after the auction. The damages caused to the awarded lots, after said period, will be the sole responsibility of the winner unless they have expressly agreed to contract insurance through Darley Auctions. The full amount plus Buyer's Premium of all awarded lots during the auction will be fully paid to Darley using a Bank Transfer.

For customers carrying out the bank transfer from abroad countries (not Spain), it will be mandatory to use ? euros for the transaction and be sure that choose the free of charge to Darley Auctions.
Other methods:
- Secure Card Payment is available after request. Our bank will send a payment link with access to our online POS. This payment method could be under a charge of the total amount (bank commission for card use 3%). We can refuse the card payment method if we consider it and do not guarantee the effectiveness of this method. Not all cards are available for this method. Ask us here: info@subastasdarley.com
- Bank check of Spanish entities formed.
- Money in cash for amounts exceeding ?1000, can't be accepted in accordance with (Ley 11/2021, de 9 de julio). If the payment is made in foreign currencies outside the European Union (not the euro) will be applied moment exchange rate. If this payment is carried out from abroad, not presential will be compulsory to use a bank transfer in euros (free of charge for Darley Auctions).
6- Delivery.
Darley Auctions will only proceed to manage the delivery process of the awarded lots once these, and the amounts accrued on account of them, have been paid in full.
1. Storage.
The buyer or awardee must withdraw the awarded lots once they have been paid in full after 15 calendar days after the award day. If the delay in the collection of the lots exceeds the period the storage and custody expenses are (euro 2) per day and lot.
2. Shipping, collection, and transportation.
Once the full payment is completed, the awardee can choose between the following shipping options:
- Collect the lot personally at Darley Auctions.
You may send to a duly accredited third party by signed authorization, identity document, and copy of the invoice for the payment of the lot/s to be collected at the Darley Auction facilities. If you choose to pick it up yourself, it is important that you organize it as soon as possible since, after 15 calendar days from the day after the auction, Darley Auctions charges a fee of two ? 2 per day per lot.
- Home delivery
Auctions Darley will manage the transportation of the lot, advising you on the best shipping method (postal or courier, or transport) with the most suitable company for it. Shipping and insurance will always be borne by the Buyer. Once the Lot leaves the Facilities, Darley Auctions is not responsible for their condition and, therefore, the Purchaser will be solely responsible for any damage or loss that the Lot could suffer during this phase of transport. But, if desired, may contract through Darley Auctions insurance to cover the possible damages that the Lot could suffer during the transport, assuming the Buyer the cost of said coverage.
3 Export permits and licenses.
The successful bidder or buyer is responsible for obtaining, solicite and providing, where appropriate, at their sole expense, legal and administrative documentation, licenses, cites, and permits of any kind. Including those of import or export, which may be required by the authorities, and administrations, whether national or international, for the legal transport and commercialization of the lots that have been awarded in Darley Auctions. Failure to obtain such documentation will not affect the sale or acquisition made, and the winner must pay the price of the lot in full and other amounts accrued to Daley Auctions. In the case of requesting authorization, Darley Auctions warns its customers that such a request will mean, for all intents and purposes, an irrevocable sale offer in favor of the Spanish State.
The client must bear the customs costs and the expenses that the export permits may cause, as well as the administrative costs of the management. Please, check in advance if any of the lots must be able to require an export permit to ship outside the European Union.
7 Law on prevention of money laundering and terrorist financing. (LAW 10/210).
Darley Auctions is obliged to comply with the provisions of Law 10/2010 and specifically with regard to persons with public responsibility, (ie: being or having been in a high position of the State Administration or the Autonomous Administration o Spanish local, senior management of trade union organizations, business, or political departments and/or have a close family or business relationship with any of them). The assumption of the buyer and/or seller of the contracting conditions of Darley Auctions implies the express declaration by the buyer and/or seller of not being considered a person with public responsibility in accordance with the provisions of the Law.
8 Modification of General conditions or standards.
Darley Auctions reserves the possibility to modify at any time and without prior notice, the content of these General Conditions, as well as the Service and any aspect of the design, presentation or configuration of the Platform. These modifications are applicable for Online Users from the moment they are published on the Platform and for Presence Users since the new text of the General Conditions is made available to them. If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only said provision or the part of it that is null or ineffective, the General Conditions remaining in everything else, having such disposition, or the part of it that is affected, by not put.
