Terms and Conditions
Please read before bidding:
Address Changes: If you need to change your address, please inform us in advance. Once the invoice is issued, it cannot be changed.
Sales Tax and Customs Duties: Auctions may incur customs duties and sales taxes. Unless legally exempt, the buyer is responsible for all shipping costs. If you are tax-exempt, you can submit a tax-exemption certificate to avoid taxation.
Property Removal: All items must be removed from Osaka Art Auction within fourteen business days. Under no circumstances will Osaka Art Auction be liable for any damage to property left on its premises for more than fourteen business days after the auction. If items are not removed within fourteen business days of sale, Osaka Art Auction reserves the right to move and store the items at the buyer’s expense. We will no longer accept items after this period, and all legal responsibility will be assumed by the buyer.
Organic Materials: Lots may be made from or contain (regardless of percentage) endangered and other protected species of wildlife, including but not limited to ivory, tortoiseshell, crocodile skin, rhino horn, whalebone, certain types of coral, and Brazilian rosewood. These may be subject to export controls in Japan and import controls in other countries. If you intend to export the lot from Japan, import the lot into another country, or transport it between states, it is your responsibility to check the relevant wildlife laws and regulations before bidding. You assume all risks associated with the purchase of lots containing endangered and other protected species of wildlife, including any necessary scientific tests or reports required for export or transport between states. If your lot cannot be exported, imported, or transported between states, or if it is seized by government authorities, we will not cancel your purchase or refund the purchase price.
Liability Disclaimer: Osaka Art Auction is not responsible for any costs or inconveniences arising from the condition or description of items. All property is sold "as is." The auction house does not guarantee or represent the nature or quality of any property and is not liable for any misrepresentation in descriptions, authenticity, authorship, attribution, origin, provenance, or condition of the property.
Returns and Refunds: By registering, you acknowledge that there are no returns or refunds, including for conditions, inherent defects, repairs, alterations, missing descriptors, or printing errors. The absence of condition information does not imply that the item is without wear, defects, or signs of aging. Sizes, photos, and opinions are for reference only and are approximate. Items such as clocks and electrical items are assumed to have been repaired, missing parts, or needing repair. Wiring is never guaranteed. Textiles, upholstery, carpets, and beaded jewelry are usually antique or vintage and may require cleaning or re-stringing.
Final Quality Check: We conduct a thorough final quality check before shipping any product to the buyer. If the product does not meet our quality standards during this process, we reserve the right to cancel the sale and refund the buyer. In the event of system errors (e.g., incorrect images, product information, pricing, or certificates), the company reserves the right to cancel the sale.
Shipping Arrangements: Shipment will only be arranged after full payment has been made and cleared. Any violation of these terms will result in a permanent dispute on your record and possible removal from all bidding platforms.
Legal Remedies: If the buyer violates any obligations under these terms, including full payment of the purchase price for all items as the highest bidder, Osaka Art Auction may exercise all legal rights and remedies without limitation, including canceling the sale and using any payments made by the buyer to offset losses caused by the buyer’s default, and/or re-auctioning the items publicly. The buyer is responsible for any discrepancies and all sales costs in such cases.
Packaging, Handling, and Delivery: All packaging, handling, and delivery are at the buyer’s risk, and Osaka Art Auction is not responsible for any loss or damage to such items. The buyer must pay all packaging costs in advance, including labor, materials, carrier fees, and all insurance costs. Please arrange pick-up and delivery seventy-two hours in advance.
Licenses and Permits: Osaka Art Auction is not responsible for obtaining any licenses or permits on behalf of the buyer, nor will any sales be canceled or refunded due to the buyer’s failure to comply with licensing and permitting issues.
Shipping Errors: If items are returned to Osaka Art Auction due to incorrect addresses or shipping errors provided at checkout, the buyer is obliged to pay for the second shipping cost and any additional fees and taxes associated with the item.
Bid Responsibly: If there is any uncertainty about these terms, please do not bid.
