CONDITIONS OF SALE
The following Conditions of Sale and Terms of Guarantee are with Fisher’s Auction and the Consignor’s entire agreement with the purchaser relative to the property listed in this catalogue.
The Conditions of Sale, Terms of Guarantee, the glossary, if any, and all other contents of this catalogue are subject to amendment by us by the posting of notices or by oral announcements made during the sale. The property will be offered by us as agent for the Consignor, unless the catalogue indicates otherwise.
By participating in any sale, you acknowledge that you are bound by these terms and conditions.
BUYING AS IS
Goods auctioned are often of some age and may have signs of normal wear. The authenticity of the Authorship of property listed in the catalogue is guaranteed as stated in the Terms of Guarantee and except for the Limited Warranty contained therein, all property is sold “AS IS” without any representations or warranties by us or the Consignor as to merchantability, fitness for a particular purpose, the correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, provenance, exhibitions, literature or historical relevance of any property and no statement anywhere, whether oral or written, whether made in the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, or elsewhere, shall be deemed such a warranty, representation or assumption of liability. We and the Consignor make no representations and warranties, express or implied, as to whether the purchaser acquires any copyrights, including but not limited to, any reproduction rights in any property. We and the Consignor are not responsible for errors and omissions in the catalogue, glossary, or any supplemental material.
INSPECTION
Bidder acknowledges as follows: Grading is an art and not a science. The grade and estimated value herein represents the opinion of Fisher’s Auction or its Consignor(s). It is possible that two people will not always grade the same item alike. Also, as market conditions change, grading standards change, and will most likely continue to do so in the future. Each Bidder's own examination of the item(s) is the criterion and not the grade represented by another.
Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. All photographs in this catalogue are of the actual items being sold but may not be the actual size or to scale.
BUYER'S PREMIUM
A buyer’s premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price. The buyer’s premium is 15% of the successful bid price up to and including $100,000; and 12% on any amount in excess of $100,000.
WITHDRAWAL
We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal.
PER LOT
Unless otherwise announced by the auctioneer, all bids are per lot as numbered in the catalogue.
BIDDING
We reserve the right to reject any bid. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion to determine the successful bidder, cancel the sale, or to reoffer and resell the article in dispute. If any dispute arises after the sale, our sale record is conclusive. Although in our discretion we will execute order or absentee bids or accept telephone bids as a convenience to clients who are not present at auctions, we are not responsible for any errors or omissions in connection therewith.
When identical bids are received for a lot, preference is given to the first bid received as determined by the Auctioneer. A mail bid (internet bidder) will take precedence over an identical floor bid; a Floor Bidder and Telephone Bidder must bid higher than the highest mail bid to be awarded any lot. Auctioneer reserves the right to refuse any bid, to reduce any mail bid received, to open the bidding of a lot at any level deemed appropriate by the Auctioneer and to determine the prevailing bid, at his sole discretion. FISHER’S IS NOT RESPONSIBLE FOR ANY ERRORS IN BIDDING. A Bidder should make certain to bid on the correct lot and that the bid is the maximum (plus the fifteen percent 15% Buyer's Premium) that he or she is willing and able to pay. Once the hammer has fallen and the Auctioneer has announced the winning Bidder, the Bidder is unconditionally bound to pay for the lot, even if the Bidder has made a mistake.
RESERVE
All lots in this catalogue are offered subject to a reserve, which is the confidential minimum price acceptable to the Consignor. We may implement such reserve by opening the bidding on behalf of the Consignor and may bid up to the amount of the reserve, by placing successive or consecutive bids for a lot, or bids in response to other bidders.
If the auctioneer decides that any opening bid is below the reserve of the article offered, he may reject the same and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance.
TAX
Unless exempted by law, the purchaser will be required to pay the combined State and local sales tax, any applicable compensating use tax of another state, and if applicable, any federal luxury or other tax, on the total purchase price. The rate of such combined tax is 6.75%.
PACKING AND SHIPPING
All packing, shipping & insurance is payable by the buyer. We are not responsible for the acts or omissions in packing or shipping of purchased lots or of other carriers or packers of purchased lots, whether or not recommended by us.

OUTAGE POLICY
In the event of an Internet and/or Server outages during which Bidders cannot participate or place bids. If such outage occurs, we may at our discretion extend bidding for the auction up to 24 hours. This policy applies only to widespread outages and not to isolated problems that occur in various parts of the country from time to time.
PAYMENT
All sales are strictly for cash in United States dollars. Cash includes: U.S. currency, bank wire, cashier checks, travelers checks, and bank money orders, all subject to reporting requirements. All major Credit Cards (Visa, Master Card, Discover & American Express). Personal or corporate checks may be subject to clearing before delivery of the purchases. Absentee Billing: Fisher’s Auction will invoice all successful bidders within 48 hours after the close of the auction. Successful bidders are expected to pay for their purchases immediately. IF PAYMENT IS NOT RECEIVED WITHIN 5 (FIVE) DAYS AFTER receipt of an electronic, or paper invoice, ABSENTEE BIDDERS AUTHORIZE Fisher’s Auction TO CHARGE THEIR PURCHASES TO THEIR CREDIT CARD LEFT ON FILE WITH THEIR ABSENTEE BID.
Fisher’s Auction reserves the right to require payment in full in good funds before delivery of the merchandise to the buyer.
HOW DO I BID?
Internet bidding through Live Auctioneers and ebaylive auctions is offered as a service to our customers, and prospective bidders shall not hold Fisher’s Auction, the auctioneer or staff responsible for any errors or failures in executing bids, nor shall they hold Fisher’s Auction and the auctioneer responsible for any failure due to the loss of the auction applet supplied to Fisher’s Auction by ebaylive auctions.
Absentee Bidding. Absentee bids left through ebaylive auctions and/or Live Auctioneers are automatically bid electronically by the computers of eBay.
These electronic bids often compete against absentee bids left directly with Fisher’s Auction staff by prospective bidders who are not participating in the internet component of the auction, but have contacted Fisher’s Auction directly and left a bid. These bids are executed competitively by a member of Fisher’s Auction staff at the time of the live auction, and are often in direct competition with the internet bids.
In the event that there is a tie absentee bid, the earliest recorded bid shall be the winner. IMPORTANT! - The auctioneer may be offered floor bids of the same value as your absentee or live bid. It is at the auctioneer's discretion which of these bids he/she chooses to accept during the auction.
