General sales terms ARTICLE 1 These conditions apply to all buyers who are both present in the auction room, who have made a written offer by e-mail or via a purchase order (receipt), make an offer by telephone or online via our own or other website during the online bidding. ARTICLE 2 The sale takes place against cash payment. The cost to buyers above the allotment price is 25% (VAT included). For the online bidders via providers, the extra costs of these will be charged on top of the surcharge. ARTICLE 3 The auctioneer Cnock NV cannot be held responsible for technical defects of any kind (such as problems with the internet connection, or a technical defect of the online bidding platform). ARTICLE 4 The purchased goods can be collected by the buyers themselves or sent by a transport company of the buyer's choice and at the buyer's expense. Jewelry can be sent via a specialized courier service and can be insured - against payment - during transport. All transport and shipping is at the risk of the buyer. ARTICLE 5 The auctioneer has the right to increase the bids by +/- 10% more or less. He can also change the order of the sale, merge lots, split or drop or withhold. ARTICLE 6 Jewelry is sold with an accompanying certificate and guarantee of authenticity. The guarantee of the jewels concerns authenticity and name of the gemstones with +/- the size of the stones and the authenticity of the gold content. Jewelry can be adjusted as desired: rings can be custom made, as well as bracelets or necklaces. Wrist watches are sold with a guarantee of authenticity regarding the manufacture or brand. All paintings oil on canvas and oil on panel were checked by the expert of the auction room. The paintings in the catalog that are marked with "signed" are in our opinion original works and are therefore sold with a warranty that is valid for 1 month after sale. ARTICLE 7 The possible resale right has not yet been included in the 25% costs on top of the supplement. Resale right is payable on works by contemporary artists who are still alive or who have died less than 70 years ago. The resale right is 4% and is calculated from a hammer price of 2.000 euros, up to and including 50.000 euro 3% of the part of the sales price of 50.000 to 200.000 euro. ARTICLE 8 All our sales are subject to the "VAT on profit margin" system. VAT non deductible. ARTICLE 9 Personal info Cnock NV undertakes to maintain the personal data of the clients in accordance with the legislation. ARTICLE 10 The goods must be paid either after the auction has ended or at the latest 3 days after the auction day. In the event of non-payment on the due date, the principal sum will be increased by operation of law and without notice of default, with an additional compensation, conventional and without prejudice, 15% annually. Bank checks are accepted. Payment in cash up to ? 3,000.00 per lot. Above ? 3,000.00 per lot, only by bank card (Bancontract, Visa, Mastercard), bank checks or by transfer to the account of Cnock NV BE14 2800 5812 7083. In case of dispute, only the courts of Bruges will have jurisdiction.
