Terms of Service 1. General "Alma Auctioneers" (hereinafter: "the Auction House") conducts public auctions (hereinafter: "the Public Auction" or "the Auction"), in which the Auction House acts as a representative and/or agent on behalf of the seller/consigner. The Auction House will appoint an agent as the auction manager, who will have the sole authority to determine who may participate in the auction and/or who has won an item and/or to cancel the sale of any item completely and/or to add an item to the auction and/or to reintroduce any item for sale and/or to add or remove information regarding an auctioned item, all at the absolute and sole discretion of the auction manager. 2. Participation Terms Participation in the auction is subject to prior registration by the participant and approval by the Auction House. The criteria for approval are at the discretion of the Auction House. The Auction House may request potential buyers to provide guarantees in the form of identification documents, a credit card, or a financial guarantee if deemed necessary. 3. Auction Catalog Prior to each auction, the Auction House will present a catalog detailing the known information about each item (hereinafter: "the Auction Catalog"). The catalog includes, among other things, the items offered for sale, their serial numbers, the creators of the items, their names, the technique of creation, estimated value, item photographs, and additional details about the items to the extent known to the owner of the item and/or the Auction House (hereinafter: "Item Data"). Item Data is provided for informational purposes only and should not be regarded as a representation, promise, or guarantee by the Auction House. The Auction House shall not be liable for any inaccuracy in the Item Data. Item Data is provided by the Auction House in its capacity as an agent of the seller and is based on information given by the seller and the Auction House expertise. Display stands and accessories are not part of the item unless explicitly stated otherwise. 4. Buyer's Responsibility Each potential buyer or their authorized agent must inspect the item's condition, origin, quality, and value during the preview period before the auction (hereinafter: "the Preview"). In cases where a preview is not available, the buyer must contact the Auction House to obtain item details. All items are sold "As Is." By purchasing the item, the buyer agrees that they have examined its condition prior to the sale and found it satisfactory. The Auction House bears no responsibility for the item's physical condition if it does not match the Item Data. 5. Pre-Auction Bids A buyer may submit an absentee bid in writing, by phone, or online. Once submitted, the bid is binding and cannot be revoked unless otherwise agreed upon between the bidder and the Auction House. 6. Reserve Price Some auctioned items may be subject to a minimum reserve price set between the seller and the Auction House. This reserve price is not disclosed. The Auction House may start bidding below the reserve price, but an item that does not reach its reserve price during the auction is not considered sold. The Auction House has the right to protect the reserve price to ensure it is met on behalf of the seller. 7. Winning a Bid The auction manager will announce the bidder's paddle number for the highest offer received for each item, including bids submitted in writing, by phone, or online. If multiple bidders offer the same amount (potentially through different platforms), the decision regarding the winning bid is at the discretion of the the auctioneer/Auction House. A winning bid--the last bid accepted by the Auction House for an item--constitutes a binding purchase agreement. The item will become the property of the winning bidder (hereinafter: "the Winning Buyer"), subject to full payment. The Winning Buyer, whether bidding for themselves or on behalf of a third party, is irrevocably obligated to pay for and collect the item. 8. Payments The total payment for an item includes the hammer price (winning bid) plus the Auction House commission of 25% and 5% live fee. VAT will be added to the Auction House's commission according to Israeli tax laws and where applicable. The winning bidder must complete payment within 7 days of the auction. Late payment constitutes a breach of the auction terms, and the Auction House may cancel the purchase, offer the item to an underbidder, or take any legal action necessary to recover losses. Auctions are conducted in U.S. dollars. Payments from buyers will be accepted in Israeli Shekels based on the exchange rate at the time of the auction or the payment date, whichever is higher. Foreign currency payments require prior approval by the Auction House. Accepted payment methods: cash (within the Israeli tax laws), credit cards, PayPal, and bank transfers. Checks are accepted only with prior approval and must be cleared before item release. Credit card payments incur a 0.8% fee for Israeli buyers and a 3.5% fee for international credit cards. PayPal transactions incur an additional 5.8% service fee. 9. Returns If a buyer believes there is an error in the Item Data of a purchased item, they may submit a written claim to the Auction House within 7 days of the auction ("Claim Period"). If the Auction House determines, to their satisfaction, that an error occurred, the buyer will be refunded upon returning the item in its original condition. Once refunded, the buyer waives any further claims against the Auction House or the item's owner. Jewelry cannot be returned once it has left the Auction House offices unless specifically agreed upon. After 7 days, no claims regarding Item Data errors will be accepted. 10. Collection and Shipping The buyer must collect the purchased/won item at their own expense from "Alma" within 10 days of the auction. The Auction House offers shipping services as a courtesy service only and is not responsible for delays, loss, or damage once an item leaves its premises. Shipping is done via third-party couriers for domestic and international deliveries. Costs depend on the item's size, nature, and value and are the sole responsibility of the buyer. For safety reasons, the Auction House may ship paintings without frames or glass. Frames are not an integral part of the purchase. If a buyer wishes to keep a frame, they must contact the Auction House after the auction to arrange this. If the buyer does not collect the item within 10 business days after full payment, storage fees will apply. Items not collected within 30 days may be resold at any price deemed appropriate by the Auction House without recourse for the buyer. 11. Jurisdiction The courts of Tel Aviv-Yafo shall have exclusive jurisdiction over any disputes arising from or related to item purchases or deliveries between the Auction House and the buyer. All previous agreements between the parties are hereby canceled. This agreement applies equally in singular and plural forms and to both individuals and corporations.
