BID PRICE:
EACH BUYER MUST REGISTER WITH LIVE AUCITONEERS BEFORE BIDDING. The highest bidder on a lot shall be the buyer of that lot. The purchase price will be the sum of 1) the price at which the item was sold, plus 2) sales tax unless the buyer is exempt by law from such taxes.
ACCEPTANCE:
The purchaser is liable to pay for the item or pay for the difference if we must resell the item for a lower price.
REGULATION OF BID:
The auctioneer will regulate the bidding and be the sole arbitrator of any disputes. We reserve the right to withdraw property before the sale and reject a bid from any bidder.
ON LINE BIDDING:
Elm Gallery will not be liable for malfunctions, errors or ommissions (hardware, software, electronic, human or otherwise), whether or not due to Elm gallery's fault or negligence, resulting in the inaccurate transmittal of bids, the failure to execute bids or any other irregularity.
PAYMENT AND PICKUP:
The payment must be paid in full and merchandise picked up or shipping arrangements made within seven days of the date of sale. A storage fee will be charged if merchandise is left more than two weeks of $10.00 per day per lot. If the property is left more than 3 weeks, it will be considered abandoned. Items on line cannot be picked up from the gallery until the following day. All sales are final-no refunds or exchanges.
RISK OF LOSS:
In the event delivery cannot be made because of loss due to fire,theft or any other reason, the gallery will not be liable for the return of any deposits made by the purchaser.
