Terms & Conditions
GENERAL TERMS:
All persons desiring to bid must be registered prior to the auction and must have obtained a Bidder's Number.
BC Auction Co. and staff, herein after referred to as the Auction Co, reserves the right to add to or withdraw from the auction any items listed or not listed. Changes to or additional terms and conditions, additions or deletions may be announced by the Auctioneer before ordering the course of the auction.
BC Auctioneers, neither conducts an appraisal nor has any association with the appraiser for our auctions.
All items are sold AS IS, WHERE IS with no warranty, expressed or implied. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the merchandise and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment solely. We do not aunthenticate ANY items of ANY kind even if said item was presented to us with a Certificate of Authenticity from that consignor.
Security for purchases is the responsibility of the Buyer and begins immediately upon the sale of each lot. Removals are at the expense, liability and risk of the Buyer. Auction Co shall not be responsible for goods not removed within the specified time period. Auction Co shall not be responsible for non-delivery or for any other matter or thing to any purchaser of any lot, in any event.
The Auction Co is acting as Agent for the Seller and all representations made by Auction Co are made on behalf of the Seller. The Auction Co is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auction Co.
Items sold to internet bidders will be held and handled by Auction staff. These items will be cared for until the item is shipped or picked up.
Settlement must be made in full immediately upon the completion of the auction by cash or check accompanied by a current original Bank Letter of Guarantee (to be presented upon registration). Seller shall retain full security interest in all merchandise until full and complete payment is made to Seller or BC Auction Co. Shipping, handling, insurance, storage and security charges will be calculated and paid at the time of payment.
Merchandise not paid for and removed within the specified time period may be resold without notice. Items sold to floor bidders must be removed within 5 days of Auction. Internet purchases must be removed by pick up or shipping arrangement made within 10 days of Auction.
Upon the sale of each lot, the Auctioneer announces the final sale price and successful Buyer's number. All questions or disputes regarding Buyer, lot identity, price or quantity must be resolved immediately upon the sale of said lot. No changes or adjustments will be made at any later time. The record of the sale kept by the Auctioneer and sale clerk will be taken as final in the event of any dispute.
All persons attending preparation, inspection, sale or removal of merchandise assume all risks whatsoever of damage or loss to person and property and specifically release the Auction Co formal liability therefore. The Auction Co shall not be liable by reason of any defect in or condition of the merchandiser premises on which the sale is held.
All descriptions of items for sale contained herein or provided orally or in writing at the time of the auction are believed to be correct, but the Auctioneer or Auction Co makes no representation or warranty, express or implied, as to the accuracy of any such description, and hereby specifically disclaims any such warranty. The Buyer hereby agrees to rely solely on his/her own expertise to determine the value of any item purchased rather than the description of any article contained in the catalog or announced by the Auctioneer or Auction Co.
The Buyer agrees that any item successfully bid upon will be paid for by the Buyer immediately following the conclusion of the auction and before departing the auction premises by delivery of cash or a check drawn on an account containing sufficient immediately available funds. To the extent that the bidder is an individual acting on behalf of a corporation registered as the bidder, the individual bidder shall be jointly and severally liable with the corporation for payment of the purchase price. The Buyer acknowledges and agrees that no "stop payment" order shall be issued or honored. The Buyer further agrees that a stop payment order or a check returned marked "insufficient funds" shall be considered prima-facie evidence of intent on the part of the buyer to defraud the Auctioneer at the time of delivery of the check. $50 service charge on returned checks. The buyer agrees that a recognized bid is an agreement to purchase.
The buyer agrees that a winning bid is a binding purchase agreement. The Buyer agrees that the act of submitting a bid shall constitute acceptance of each and every term and condition contained herein and of any additional terms and conditions which may be posted at the auction or which may be announced by the Auctioneer. The Buyer agrees that in any dispute between the Seller and the Buyer or between competing bidders arising in connection with any sale at the auction, the Auctioneer shall have the right but not the obligation to settle such dispute, and the Buyer shall abide by the decision of the Auctioneer, whose decision shall be final with respect to such matter. The Buyer further agrees to indemnify the Auctioneer for all liabilities, damages, costs, and expenses including attorneys fees incurred in connection with any such dispute or in connection with any claim, litigation, controversy, dispute or proceeding arising from any purchase of an article by the Buyer or from any subsequent sale of such article to any third party.
Special Internet Terms
?Bidders are bound by BC Auction Co. Auction terms and conditions and the terms posted for the auction for which the bids are placed.
?All sales are final upon award of bid by the auctioneer.
?Bidders will not have any claim against BC Auction Co for failure to submit bids to the auctioneer.
?All descriptions/ serial numbers are not warranted and are subject to bidder/ buyer verification.
?A 10% buyer's premium will be added to the final gavel price.
?Internet bids are a contract and the bidders are responsible for honoring them. Every legal remedy available will be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys' fees and expenses related to, arising from or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder.
?Full payment is due the day following notice of successful bid. Cash, Wire transfer, Master Card, Visa, or Discover excepted through PayPal.
?All purchases must be removed from the auction site in accordance of the terms for that sale.
?ALL SALES ARE FINAL. All items are sold "As Is, Where Is", with all faults and without any warranties as to merchant-ability of fitness for a particular purpose. The Auctioneer, principal, employees, or any of their agents make no warranties, expressed or implied.
?Announcements made by the auctioneer at the time of sale take precedence over printed matter. All information was from sources deemed reliable but not guaranteed. Although every precaution has been taken to ensure accuracy, Auction Company or their agents shall not be responsible for any errors or omissions therein.
?SHIPPING AND HANDLING INFORMATION: All shipping and handling charges will be paid for by the Buyer. Any risk of loss or damage during shipment will be borne by the Buyer. BC Auctions and staff will package and ship items at the expense of the Buyer. Buyer will be required to pay insurance on all shipments over $20. Auction Co and staff will take all precautions to carefully handle and ship all items. BC Auctions will ship items using USPS, UPS, and FedEx. Shipping items for those companies will apply.
?If you register and leave an Absentee Bid Form and then attend the Live Auction you will need to register to bid at the Live Auction. BE AWARE THAT YOUR ABSENTEE BIDS WILL BE EXERCISED BY THE AUCTIONEER. YOU ARE WELCOME TO BID IF YOU ATTEND BUT IT IS YOUR RESPONSIBILITY TO REMEMBER WHAT YOU HAVE BID ON AND THE AMOUNTS OF THE BID AS WELL AS THE MAXIMUM AMOUNT YOU HAVE BID ON ANY ITEMS.
If items are not paid for you WILL be Black Listed, given NEGATIVE FEEDBACK, and no longer able to join our Auctions.
