USER TERMS AND CONDITIONS AGREEMENT Welcome to Casa de licitatii Chintovan. By placing a bid, you shall be deemed to have accepted these Conditions notice in full. This User Agreement governs your use of our services. In the event of a dispute, this User Agreement will guide the dispute resolution process and define your and our remedies. In particular, we call your attention to the sections below. PLEASE READ THIS AGREEMENT IN ITS ENTIRETY PRIOR TO BIDDING Casa de licitatii Chintovan requires consent to these Terms and Conditions before every purchase. All offers, purchase agreements, deliveries and services based on and in connection with auctions organized by Casa de licitatii Chintovan, including through the website shall be governed by these General Terms and Conditions. Casa de licitatii Chintovan reserves the right to exclude customers from an auction if their residence/delivery address is located in a country in which the goods that are being offered cannot be imported and Casa de licitatii Chintovan has knowledge of this or if doubt exists about the customer?s identity or his creditworthiness. DESCRIPTION AND QUALITY MANAGEMENT: All items are sold AS IS, WHERE IS WITH ALL FAULTS. ALL SALES ARE FINAL - NO REFUNDS AND NO EXCHANGES. WE AND THE CONSIGNOR, AS APPLICABLE, DISCLAIM ANY AND ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. NO WARRANTIES ARE MADE THAT ANY OF THE MERCHANDISE COMPLIES WITH ANY APPLICABLE GOVERNMENTAL RULES, REGULATIONS OR ORDINANCES OF ANY KIND OR NATURE WHATSOEVER. All items are available for inquiries prior to bidding. Written and oral descriptions are the opinions of Casa de licitatii Chintovan srl, and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, do not bid on the lot in question. BIDDING: Bidder's bid at all times represents an irrevocable offer by bidder to enter into a binding contract to purchase the lot in accordance with the specific provisions of the listing and these general terms and conditions, as applicable. The bidder assumes full responsibility for items at the fall of the hammer (or expiration of time in an online auction). A bid entered by mistake on the part of a bidder is NOT grounds for a cancellation of the bid. Each bidder is responsible for his or her own account and bids. By allowing access to another who enters a bid without your knowledge will NOT be grounds for a rescission of the bid(s). Therefore, any bid made on your account will bind you to the bid in accordance with these terms. If an entity places a bid on a lot, then the person executing such bid on behalf of the entity hereby agrees to personally guarantee payment for any successful bid. The successful bidder is the highest bidder acknowledged by Casa de licitatii Chintovan srl . In the event of any dispute between bidders, or in the event of doubt on Casa de licitatii Chintovan? s part as to the validity of any bid, the Casa de licitatii Chintovan srl will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, Casa de licitatii Chintovan's sale record is conclusive. While Casa de licitatii Chintovan srl makes every effort to guarantee accuracy, in the event of a mistake on the part of auctioneer, and a lot is accidentally declared sold by mistake of the auctioneer, Casa de licitatii Chintovan srl reserves the right to cancel the sale and relist the lot in its sole discretion. Bids may be received by Casa de licitatii Chintovan srl through the internet or in person. Casa de licitatii Chintovan srl reserves the right to reject any bid at any time and at his sole discretion. Casa de licitatii Chintovan srl additionally reserves the right in its sole and unlimited discretion at any time prior to, during, or even after the close of the auction to exclude any person or individual bid and to award any lot to the highest accepted bid. Casa de licitatii Chintovan srl reserves the right to withdraw any lot at any time before, during, or after the auction without liability. TEHNICAL PROBLEMS: Casa de licitatii Chintovan srl does not guarantee the technical feasibility of internet connections or the on-time transmission of bids during auctions. It is advised to place bids early to ensure that bids can be considered for the auction. In the case that technical problems prevent the continuation of an already running auction the following shall apply: All winning bids that were made before the arising of the technical problems shall remain valid. If an auction is affected, the auction shall be continued at a later point in time. PAYMENT: At this time we accept ONLY bank wire transfers . Credit/debit card or paypal transfer is NOT accepted. Additional to the hammer price the buyer must pay 3% to Liveauctioneers and a buyer's premium of 15%. At auctions that don't have a buyers premium you must pay 5% to Liveauctioneers. There is a 25 euro packaging and handling tax. The packaging and handling tax will be payed only once per auction, regardless of how many lots you won. We don't pay any transfer commission. It's the buyer's duty to pay commissions on wire transfer, in order for us to receive the full amount stated on the invoice. Payment is expected within 5 days after receiving the invoice. Deliveries to non-EU countries are subject to additional custom duties and import tax. Romanian buyers pay 24% VAT. Payment on delivery is excluded. The customer may effect payment by bank transfer. A buyer shall enter into payment default if he has not rendered payment within 10 days after the payment due date and receipt of an invoice; the relevant date is the date that Casa de licitatii Chintovan receives the payment into its account. GOLD MEMBERS: Gold members pay only 10% buyers premium. Whenever you complete a successful transaction with us you will have a 1% discount to the next auction. The bonus is stackable down to 10% buyer?s premium. At this point you become Gold member. The Gold member status is not transferable in any way and to be maintained you must complete a transaction with us every year. At the end of the year if you haven?t completed a transaction with us, you status will be reset to new client with no additional discount. Al bonuses that doesn?t cap into Gold member will be reseted at the end of the year. So if you have a 3% discount this year and you haven't made it to Gold member in 01 of January the discount will be erased and you will appear in our data base as a new client. You are only awarded a 1% discount per auction, regardless of how many lots you have won and payed successfully. This is applicable only to auctions that have premium bid. SHIPPING: We will contract a private and independent courier for you. Fees will be communicated after you have send to us your shipping address at the end of the auction. Please observe your country`s import regulations. We will ship the package within 5 working days after we receive FULL PAYMENT. Other clauses This agreement once is accepted represents the law of the parties. In addition, the present contract is governed by the laws of Romania. Each bidder is responsible for his or her own account and bids. All bids are binding, irrevocable and non-cancelable by bidder. In the event that you bid and you are deemed the winner of an item auctioned by Casa de licitatii Chintovan srl, but fail to make payment in accordance with the invoice sent to you, you will be assessed a charge of 20% of the hammer prices as liquidated damages. The possible litigations between the parties that cannot be solved amicably shall be finally settled by the competent law court of the place where de Auction House has its registered office. BY BIDDING, THE BIDDER AGREES TO CASA DE LICITATII CHINTOVAN?S SHIPPING AND HANDLING POLICY AND OTHER CHARGES, WHETHER KNOWN OR NOT TO BIDDER AT THE TIME OF BID. BIDDER FURTHER AGREES THAT NEITHER DELIVERY OF AN ITEM AFTER THE DATE DESIRED OR EXPECTED BY BIDDER OR LOSS OF AN ITEM BY A THIRD-PARTY DELIVERY ENTITY GIVES RISE TO A CAUSE FOR A CHARGEBACK CLAIM AND BIDDER SPECIFICALLY AGREES TO REFRAIN FROM THE FILING OF ANY SUCH CLAIM.
