General conditions of sale
1- Scope
The following ?General Conditions of Sale? apply to all legal transactions between ANTIQUITIES ONLINE and their clients. It is expressly stated that no purchase conditions differing from the following ?General Conditions of Sale? will be acknowledged. Sales conditions other than these will be valid only if they follow confirmation in writing by us. IN CASE OF SALE, 20% OF THE HAMMER PRICE REACHED DURING THE AUCTION WILL BE ACKNOWLEDGED.
2% WILL BE APPLIED TO THE AGREED UPON AMOUNT FOR INSURANCE AND STORAGE COSTS
2- Signing of the contract. The client's order is a legally binding offer on us for purposes of purchase. The purchase will come into full legal effect only if the offer is accepted by our company within 14 days after notice. The offer will be accepted by confirmation in writing or directly by shipment of the ordered items. Orders made OVER internet will be confirmed immediately by sending an email to your address. However such an confirmation of an order does not imply a final commitment by ANTIQUITIES ONLINE.
Descriptions on catalogues and on the internet are by way of indication only and no liability is assumed concerning their correctness. Nor will the company be liable in case of obvious misprints. Orders must be made out in writing. Verbal orders will not be binding. Making an order automatically implies acceptance of our ?General Conditions of Sale?.
3- Shipping and insurance costs
Shipping and insurance costs for purchased lots will be calculated based on the tables published on our website www.antiquities-online.net
4- Terms of delivery
Delivery of purchased items, especially when carried out by new clients, will be effected only against advance payment, unless otherwise agreed upon. In case of sale, the client will be sent a bill which must be paid no later than 10 days after it was received. Should we be temporarily unable to deliver the purchased goods within the set term of 14 days due to blockages, strikes, lockouts, regulatory actions or other cases of force majeure, delivery term will be automatically extended.
In this case, the client will be promptly notified, also concerning the expected duration. Should the hindrance last more than four weeks, both parties will have the right to withdraw from the contract. Risk of damage and accidental deterioration of the sold goods passes to the purchaser at the time of directly delivery of the goods. If the goods are sent by a shipping agent, liability will fall on the carrier or on the person appointed to carry out the delivery until the delivery has been effected. Purchased items will be considered to be delivered even if the purchaser delays in collecting them. Shipment is covered by suitable insurance.
5- Payment
All prices are in Euros, including added value tax current at the time of order. Any further taxes, such as import or export dues, will be paid for by the client. The client must seek information about this on his own or else get in touch with us.
Payment must be made to one of the bank accounts of ANTIQUITIES ONLINE no later than 10 days after receiving the bill.

6- Right of withdrawal
Every purchaser enjoys by law the right of withdrawal. You can exercise your right of withdrawal, without specifying any reason, in writing (for example by letter, fax or email) within 7 days from the date the order was made or the goods were delivered. In such case, the goods must be promptly returned.
(see: art. 246A (2) 2 and § 312g (1) of the German Civil Code, article 246 (3) )
In order to comply with the terms of withdrawal all that is needed is prompt delivery of the statement of withdrawal or of the goods. The statement of withdrawal must be addressed to:

Effects of the withdrawal
In case of withdrawal, to make the withdrawal effective, each party must return to the other any benefits received (e.g. interest). Should it not be possible to return the acquired items or should such items have been damaged in whole or in part, the purchasing party must provide adequate refund. The purchaser is not held to make any refund should the goods have been damaged before shipment. Goods which cannot be shipped will be picked up by ANTIQUITIES ONLINE at your address.
The refund must be made within 10 days. For the purchaser, the term starts to run from the day of declaration of withdrawal or the shipment of the goods, or for our company, from the date of return of the goods
7- Retention of title
ANTIQUITIES ONLINE has the right to sell goods in performance of its business. At the time of conferral, the seller client transfers to ANTIQUITIES ONLINE all his rights to the items on sale.
The conferrer will be entitled to payment of the agreed upon price only after the purchaser has paid for the purchased item.
ANTIQUITIES ONLINE will handle collection of the sales price until expiry of the contract payment terms.
In contracts with private individuals ANTIQUITIES ONLINE will retain title to the goods until total payment of the price. In contracts with dealers, ANTIQUITIES ONLINE will retain title to the goods until payment of all current receivables. Until total payment of the price, the purchaser must:
a) handle the goods carefully, avoiding any cleaning operation whether chemical or mechanical;
b) not allow any third party to take possession of the purchased goods for example in case of distraint, and to avoid any damage or destruction of the same;
c) immediately notify any transfer of possession of goods and any change of domicile
8- Liability for defects
Should the purchased items have evident faults, also including transport damage, the purchaser must immediately notify to ANTIQUITIES ONLINE the existence of such faults or damage. Should the purchaser be a private individual, failure to report such damage will not have any consequence on the rights acquired. Individual items may be available in several identical copies. It is not always possible to illustrate or list all the pieces on a catalogue or on the website. Supply of an identical item which was not illustrated will not be breach of contract, unless you have expressly specified in the order that you want to receive exactly the item illustrated and described.
Authenticity of all the items put up on auction is guaranteed. The principal has all the rights of warranty provided for by the law, the private purchaser has the right to demand, on his own choice and when possible, removal of the fault or the supply of equivalent faultless goods, undamaged (subsequent performance). If the kind of subsequent performance chosen should be associated with a disproportionate amount of expenses, the right of warranty will be perfected in the other way provided for. Further rights, especially that of withdrawal from the contract, may be claimed only after suitable time has elapsed for subsequent performance, or after two failed attempts at subsequent performance, or else should ANTIQUITIES ONLINE refuse to carry out subsequent performance.
Should the seller be a dealer, ANTIQUITIES ONLINE has the right to choose between removal of the fault or supply of undamaged items within one year after the date of delivery, as one year passes from the date of delivery, the rights of guarantee of the businessman will be limited to removal of the faults or to an accreditation of the current value of the goods, as chosen by antiquities online.
9- Data protection
All personal data are normally confidential and will not be delivered to any third party.
10- Limitation of liability
ANTIQUITIES ONLINE must refund any damage on the basis of contract provisions and of current law and in cases where it may be accused of intentional or grossly negligent acts or omissions or of liability for the physical integrity of clients. Objective liability laid down by law for product warranty will not be affected. Liability arising from failure to perform essential contract obligations will not be affected. Liability will however be limited, except for the cases provided for under headings 1 and 2, to foreseeable damage typical of a contract relationship. The above mentioned provisions do not imply shifting burden of proof to the detriment of the client.
11- Applicable law and competent court
The Court of Law competent for any dispute is that of Munich where the headquarters of ANTIQUITIES ONLINE are located. The law applied is German law, with the exclusions of the United Nations Convention on contracts for international sale of goods. These regulations also apply if the court of law competent for the client is not in Germany and also if the client's residence or habitual domicile in unknown at the time court proceedings began. Should one or more provisions of these ?General Conditions of Sale? be null and void, this will not affect the validity of the surviving provisions. The provisions held to be partly or totally illegitimate will be replaced by others of an equivalent economic value. Should unexpected circumstances arise, the parties hereto will draw up an agreement valid for both, in compliance with the contents of the contract.

In completing the bidder registration on www.liveauctioneers.com and providing your credit card details and unless alternative arrangements are agreed with Antiquities online
1. Authorise , if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via liveauctioneers.com, and
2. Confirm that you are authorised to provide these credit card details to Antiquities online through www.liveauctioneers.com and agree that Antiquities online are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
