TERMS ALL BIDDERS MUST BE AT LEAST 18 YEARS OLD TO BID. This is a legal agreement between you, the buyer and the Sunburst Trading Company, Inc. aka The Sunburst Gallery. The Sunburst Trading Company, Inc. (hereinafter referred to as The Sunburst Gallery) may at its sole discretion ban from further use any buyer that The Sunburst Gallery believes to have in any way misrepresented themselves, failed to abide by these terms, conducted any improper auction action as solely determined by The Sunburst Gallery. Any buyer who fails to complete their purchase shall be banned from any future use and may be subject to additional legal actions. PAYMENT All item(s) on which you were the high bidder must be paid for in full upon receipt of invoice prior to the item being shipped. We accept payment in the form of personal/business check, wire transfer, and PayPal. We no longer accept credit cards directly, but you may pay with your credit card thru PayPal. The Sunburst Gallery reserves the right to hold merchandise purchased by personal/business checks until the funds have cleared. Checks must be made payable to Sunburst Trading Company. All payments must be made in US funds. We do not accept checks from outside the U.S.A. All items to be auctioned are subject to the Sunburst Gallery’s acceptance or rejection of the high bid. All purchases are subject to applicable Arizona sales tax unless a valid Arizona business license is presented. Discount for cash is 3%. SALES TAX All purchases are subject to applicable Arizona sales tax unless a copy of a valid Arizona Resale license is provided. International buyers are responsible for tariffs, taxes or assessments of shipped items to the BUYER’S country. Items shipped out of state are not subject to sales tax. SHIPPING ALL SHIPPING AND RELATED COSTS ARE THE RESPONSIBILITY OF THE BUYER. Purchaser agrees that packing and shipping is done at the purchaser's risk and that the purchaser will pay in advance all packing expenses, materials, carrier fees and insurance charges. Items can be shipped via a packaging store or a shipper of your choice. The Sunburst Gallery shall have no liability for any loss or damage to shipped items. Shipping arrangements for items which have been paid for in full should be made within 14 days. TERMS All items are sold AS IS - WHERE IS WITH ALL FAULTS and with no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any goods offered in this sale. No bids can be withdrawn after the auction for any reason. BUYER agrees to these terms as well as all other terms set forth below. They may be amended or revised only in writing and posted at the beginning of the sale. Buyer also agrees that any oral representations shall not modify these "AS IS - WHERE IS WITH ALL FAULTS" terms. Buyer understands and agrees that any description given in the catalog is not guaranteed. All information and descriptions contained in advertising this sale are believed correct, but no responsibility is assumed by The Sunburst Trading Company, Inc., DBA the SUNBURST GALLERY for any errors or omissions. The Sunburst Trading Company, Inc. reserves the right to terminate any purchase, if for any reason The Sunburst Gallery is unable to complete the sale of the purchase to buyer. Buyer agrees that the Sunburst Trading Company may terminate the purchase/agreement, in which case, the company’s only liability shall be the return of any monies actually paid by buyer. In the event any legal proceedings arise from this sale, buyer consents to being subject to the personal jurisdiction of the courts of the State of Arizona. Buyer also agrees that venue shall be in Pima County, Arizona and that the laws of the State of Arizona shall govern this Agreement and the parties' transaction hereunder. BUYER expressly agrees to indemnify and hold harmless the Sunburst Trading Company from and against all claims, losses, expenses, damage or liability, (including, but not limited to, attorney's fees), directly or indirectly caused by or resulting from Buyer's negligent acts or omissions or breach of this agreement. Do not bid unless you agree to all of the above stated terms. By bidding you are acknowledging agreement with the terms above. If there is a dispute on the authenticity of an item, the only professional opinion that will be considered is from a curator of the Arizona State Museum. We do our best to represent items correctly. This is an auction with NO warranties, expressed or implied. No item may be returned.
