CREATIONS TERMS OF USE Seller agrees to provide accurate, clear and honest information about the vehicle or asset (?Creations?) advertised for auction on Bid Network Online (?BNO?). BNO does not guarantee that the Creations listed on BNO.com will be engaged in active bidding or be sold to any customer. The seller understands and agrees that BNO has the right to cancel or postpone an online auction for any reason. Once an auction on the Website has ended, the Seller understands and agrees that BNO is only responsible for providing the Seller with the contact information and bid information of the highest bidders. All items are sold AS IS. Inspections or lack thereof, are the responsibility of the bidder. BNO is not responsible for any promised services or additional parts announced available or sold with the vehicles. Seller agrees to indemnify and hold harmless BNO Auctions for any claim, damage or cost as a result of misrepresentation. Seller is responsible for any and all non-disclosed damages on creations. Creations with liens must be pre-approved by the auction office and must in all cases be accompanied by a letter from the lien holder stating the lien release conditions and payoff amount. Seller must disclose all liens and conditions that affect the transfer of title to the buyer. Seller must also disclose to a buyer all known material defects about property being sold that are not readily observable. Seller hereby acknowledges and that the BNO auction platform is primarily a forum for sellers to advertise their property and meet potential buyers. Therefore BNO does not guarantee the completion of the transaction by either party. The defaulting party is responsible for all fees due to BNO. BNO is not responsible for identifying any errors or omissions in the information provided to it by the seller. BNO is not a party to any transaction between a buyer and seller and therefore no purchase money or seller-imposed fees shall pass through the business accounts of BNO. BNO is entitled to all fees and commissions from the sale of the asset during the term of your engagement with BNO, regardless whether the vehicle is sold on BNO or outside the auction system. If your item sells successfully, complete the sale by contacting your buyer, accepting payment, and arranging for delivery or pick up of the item. Any material breach of this agreement, by either party, shall be grounds for immediate termination of this Agreement. Any nonpayment by the Seller will be grounds for immediate termination but will not absolve the seller of its obligation to pay any outstanding monies owed to BNO, as well as any attorney and other fees incurred by BNO in attempting to collect payment from the seller.
