For shipping to these areas call the auction house at (718) 402-8600 The conditions stated below constitute the Terms and Conditions on which all property is offered at auction. Bidding at auction, whether present, absentee bidding or phone bidding, the buyer agrees to these terms. Ebay Live Auction Buyer's Premium of 20% will be added to the hammer price. Buyer’s are required to pay sales tax on the total sale price, including "Buyer’s Premium. Sterling Auction House DOES NOT SHIP any large items such as furniture, chairs, tables, etc. However, once you have made prior agangments with UPS, we will bring item(s) to a UPS store. Shipping, handling and packing are the sole responsibility of the buyer. All property must be removed from SAH by the purchaser at their expense no later than 7 (seven) days after the auction. A fee of $10.00 per day will be charged for any item(s) not picked up after 7 (seven) days. After 15 (fifteen) days SAH will dispose of item(s) in any manner and by any means in discretion, including re-auctioning the item(s) at SAH auction, private sale(s) or otherwise. SAH will have no liability for any damage to item(s) once item(s) changes hands (after hammer falls indicating highest bid is accepted by the auctioneer.) As a convenience to bidders, SAH publishes pre-sale estimates of the value of each lot for most auctions. Estimates are intended as a guide and should not be considered a prediction of the selling price. Estimates are subject to revision without notice. Payment must be made on the day of purchase unless prior arrangements have been made with SAH. Payments accepted are: Cash, Traveler’s check, MasterCard, Visa, Personal or Business check. SAH reserves the right to hold item(s) until check clears. This applies to first time buyers paying by check. The purchaser is legally responsible for payment. Potential buyer’s of expensive lots may wish to discuss payment prior to auction. Failure to complete payment may result in legal proceedings and most definitely will result in non-issuance of a bidding number in the future. A $20.00 fee will be added for any returned checks. If a check fails to clear after the second deposit, the purchaser will be responsible for any and all fees incurred during the collection process. All auction sales and telephone bidding are recorded. All purchases are subject to the New York sales tax unless the purchaser possess a Tax Exemption/Resale Number. A NYS ST-120 form must be completed along with a copy of Tax Number to be kept on file. All items are sold to the highest bidder as acknowledged by the auctioneer. The auctioneer has the right to reject any bid; to advance the bidding at his discretion; and in the event of a dispute between two bidders, determine the successful bidder, or to re-offer and resell the lot in dispute. Should there be any dispute after the sale, the recorded final sale shall be conclusive. Some items offered may be subject to reserve, which is the confidential minimum price below which such item(s) will not be sold. We may implement such reserves by bidding on behalf of the Consigner. All item(s) are sold "AS IS", "WHERE IS", and all sales are final. Detailed condition reports are not included in the catalog. The condition of any item(s) is based on the opinion of SAH, and no guarantees, warranties are made or implied. It is the responsibility of the prospective bidders to examine each item(s) in person, or through an agent to determine the condition of any item(s) of interest. All counts, weights and measurements are approximate. Neither SAH, the auctioneer, nor the consigner are responsible for the accuracy of any printed or verbal description. SAH has the right to withdraw any lot before or at the time of the auction. Absentee bids will be executed as a convenience to the customer, however, SAH will not be responsible for any errors or failure to execute bids. Prospective absentee bidders should consult their ‘bid increment’ to ensure their bids conform to the SAH bidding increments. A minimum bid of $25.00 is required for each absentee bid. In the event a left bid is higher than competing bids in the auction house, the left bid will win the item(s) at the next bidding increment, not necessarily the full amount of the left bid. Returns will be accepted, if it is determined SAH has erred in their catalog description within 14 (fourteen) days from auction date (under no circumstances will this time period be extended, unless arrangements have been made within the 2 (two) week period). However, if SAH or the auctioneer should make verbal additions, corrections or modifications to the catalog at the point of sale, this disclosure formally amends the printed catalog description. All sales are audio and video taped to validate any changes made by SAH or the auctioneer to the catalog description. Returns must be accompanied by a written statement from a mutually agreed upon third party confirming the discrepancy. These terms do not apply to any item(s) identified in the catalog as "In the Manner of, Style of, Circle of, After, or Attributed to." Auctioneers do not warrant any verbal accounts of integrity or condition offered for telephone or absentee clients
