TERMS & CONDITIONS OF SALE
1. Bidding at this auction means that the bidder has read and fully understands the terms and conditions of sale for this auction and all future auctions and agrees to be bound thereby.
2. A premium of 15 percent (15%) will be applied to each item sold, to be paid by the buyer as part of the purchase price. Live internet bidding available through eBay® Live Auctions is offered with a 20 percent (20%) premium. 5% Virginia Sales tax will be charged when necessary.
3. Auction bidders must register for the auction. Bull Run Auction, Inc. reserves the right to reject the bid of anyone not registered.
4. Admission to the auction by catalogue is $10 each, $14 by priority mail, catalogue admits two to all auction sessions.
5. If any dispute arises between two or more bidders, the decision of the Auctioneer shall be final and absolute.
6. Bull Run Auction, Inc. has the right to: (1) reject any and all bids, (2) bid on behalf of the buyer or the seller, (3) divide any lot, to combine any two or more lots, or withdraw any lot or lots from auction.
7. All property is sold AS IS/WHERE IS and all sales are final. While Bull Run Auction, Inc. may attempt to describe the items for sale and give pre-sale estimates, there are no warranties, expressed or implied, that the property offered for sale is as described by Bull Run Auction, Inc., the catalog, bill of sale, receipt or elsewhere. The bidder is solely responsible for determining the age, size, use, condition and value of the property before bidding. Neither the Auctioneer nor the Consignor will be held responsible for any descriptions of the rarity, quality, condition, size, use, merchantability, fitness for purpose, importance, or provenance of the property, and no statement, whether oral or written by the Auctioneer or by any representative of Bull Run Auction, Inc. shall be deemed an express or implied warranty by representation regarding the property offered for sale.
8. Time for inspection of the items being sold is provided prior to auction. Bidders are cautioned not to bid on or Purchase items they have not inspected to their satisfaction. When the item is sold it becomes the complete responsibility of the buyer. ALL SALES ARE FINAL.
9. Payment is due in full the day of the auction. Nothing is to be removed from auction premises without payment and proof of receipt. Payment for successful absentee, phone bids and eBay® bids is required within three (3) business days of the auction.
10. Payment must be made by cash, approved check, wire transfer, MasterCard, Visa or American Express. We reserve the right to require bank checks for purchases. Buyers not known to us who wish to write a check must provide a current letter of credit from their bank guaranteeing funds for that account. Credit arrangements must be made by the Friday prior to the day of auction so bank statements can be verified.
11. Bull Run Auction, Inc. is not responsible for personal injury or damage to property. Registered bidders are responsible for themselves, as well as their employees, associates, or family members.
12. In certain situations where items purchased have not been paid for, or left on the auction premises without making specific arrangements with the auction company, the items may be resold at the financial risk of the original successful bidder.
13. A fee of $50.00 will be charged for any returned check. Bull Run Auction, Inc. reserves the right to impose a storage fee of $15.00 per day commencing on the 8th day after the auction for any property left on the premises, reverting back to the auction date.
14. Absentee, Telephone and Internet Bidders. Bidding on items in this auction indicates acceptance of the following terms and conditions for this auction and all future auctions: Bull Run Auction, Inc. is hereby authorized to bid on the following lots up to the price entered and will obtain the item as reasonably as possible within the amount left. Bids are to be secured with Credit Card. We assume no responsibility for failure to execute bids for any reason whatsoever. Bull Run Auction, Inc. encourages all to place absentee and telephone bids as soon as possible and cannot guarantee the implementation of bids left after 12 Noon the day of the first session of the sale. In the event absentee bids of identical amounts are submitted, the earliest bid received takes precedence. In the event of a tie bid, live bidders and telephone bidders, respectively, take precedence over absentee and internet bids. A successful bid results in a purchase price which is the aggregate total of the final bid, a fifteen percent (15%) buyer’s premium of the final bid price is added to the hammer price on all lots sold, twenty percent (20%) for internet bidders, together with any sales tax due on the item. The bidder is responsible for calling Bull Run Auction, Inc. for sales results during the week after the sale. Dealers purchasing for resale must supply appropriate Dealer Resale Number and provide Bull Run Auction, Inc. with proper documentation.
15. When the purchaser defaults on any of the terms and conditions of sale, Bull Run Auction, Inc. reserves the right to: (1) hold the purchaser liable for the purchase price and buyer’s premium and sales tax; (2) to cancel the sale and retain any payments made by the purchaser as liquidated damages; (3) to resell the property at public auction without reserve or to sell privately after five days notice to purchaser and the purchaser will be liable for all damages, or (4) take any and all legal action Bull Run Auction, Inc. deems necessary and appropriate. The purchaser shall at all times be liable for the payment of the full purchase price, buyer’s premium, sales tax, storage expense, reasonable attorney’s fees and expenses, interest at rate of 1 ½% per month of the purchase price and buyer’s premium from the date of the auction, and all other charges due.

I understand that Bull Run Auction, Inc. will execute bids as a convenience and will not be held responsible for any errors or failure to execute bids. I understand that my bids are placed subject to the TERMS & CONDITIONS OF SALE as stated above as paragraphs 1 through 15, and that I will be responsible for the purchase price and buyer’s premium, as well as all applicable local and State taxes and shipping costs. Delivery of goods will not be made until full payment has been received.
