Terms & Conditions
General Provisions.
1.1. Organizer of the auction is The Auction House "Anticvarium", LLC, further "Organizer" or "Auction House". The purpose of the auction is selling of artworks and collectibles to the bidders by the auction Organizer.
1.2. The Auction House "Anticvarium" in its work is guided by the current legislation of Russian Federation and by this terms and conditions.
1.3. Auction ?ouse acts as an agent of the Seller.
1.4. During the auction Organizer acts by way of the auctioneer and the secretary, any other time ? by way of its legal representatives.
Bidding
2.1. Any capable natural person, who have reached the age of eighteen, and legal entity can be Auction participants.
2.2. Auction House "Anticvarium" reserves the right to deny a participation in the auction without explanation.
2.3. Employees of the Auction House has the right to request the identity documents, account statements and other financial documents confirming the solvency, from the potential bidders.
Live bidding
2.4. For the live participation in the auction the potential bidder has to apply for participation (to register), provide a passport photocopy and get a card with number.
2.5. The card with number is the only evidence that confirms the right to live bidding in the auction.
2.6. Filling out the registration card, auction participant accepts terms and conditions of the Auction House and his liability to pay purchased items.
2.7. Bidder is responsible for any bids placed by his card.
Absentee bidding
2.8. If the participant does not intend to visit the auction in person, he can deliver to the Organizer via e-mail or in person filled application form of the absentee bidding (order), specifying the item of interest, its name and the maximum price he willing to pay for it. The bidder has to deliver the application form not later than the day before the auction. Application shall be deemed to be accepted if it has a mark of admission made by Organizer.
2.9. If there are some equal absentee bids at the same lot, than application which was accepted earlier has a priority.
2.10. In the case when a potential Buyer is not a loyal customer of the Auction House "Anticvarium", Organizer has the right to require a deposit of 10% of the amount of bid.
2.11. Organizer, received an absentee bidding application for the auction, agrees to purchase items for Buyer at the lowest possible price.
2.12. The Auction House shall not be liable for any failure of the written application and any errors or omissions of it.
Telephone bidding.
2.13. Application for the telephone bidding is performed as well as an application for the absentee participation.
2.14. Submitting the application, the bidder confirms his obligation to pay for the item in case of successful participation in the auction.
2.15. Applying to participate in the telephone bidding, bidder hereby confirms his obligation to purchase the item at a starting price.
Representation at the auction.
3.1. Bidders may submit their interests through their representatives.
3.2. Representatives must provide a notarized power of attorney for the bidding, and representatives of legal entities, in addition, - a guarantee letter of organization, addressed to the Organizer, with the obligation to pay for purchased lot.
3.3. Refusal to fulfill of an obligation to pay for the items and objections, based on exceeding the commission by representative or misinterpretation of the will of the principal, are not allowed.
Bidding Procedure
4.1. The official information source about the items offered for auction is the auction catalog.
4.2. Any claims on quality and condition of items will not be accepted after the auction, also they shall not be seen as a reason for refusal to pay for purchased lots.
4.3. Before the auction starts, participants can familiarize with all the lots at the pre-auction exhibition, whose date and venue are indicated in the catalog of the Auction House "Anticvarium".
4.4. Auction House "Anticvarium" makes all efforts in order to describe each item as fully and fairly as it's possible, but is not responsible for any errors or inaccuracies, as well as the absence of any information in the articles describing the items.
4.5. Potential Buyers are advised to review carefully the lots by themselves or with the help of competent in this area persons.
4.6. The Buyer makes purchase decision independently, on the basis of the lots review.
4.7. The order of catalog is carried out:
- by the telephone
- via e-mail
4.8. The auction is conducted by the auctioneer,
acting under a power of Attorney from the Organizer.
4.9. All the disputable situations, that may arise during the bidding, are resolved by the auctioneer, as well as the secretary of the auction, who has a priority in the final decision making.
4.10. Auction House "Anticvarium" reserves the right to withdraw any lot from the auction without explanation.
4.11. Lots are put up for the auction in the order, in which they are numbered in the auction catalog.
4.12. Auctioneer puts lot up for sale, announces its number, its name and the starting price. If a lot has an absentee bid, the auctioneer reports this fact.
4.13. After the item price is announced, auction participant raise his card with number, which means his absolute and irrevocably consent to buy this item for the price declared by the auctioneer. Each subsequent cards raising, made by participants, means the agreement
to buy the lot at a price higher than the previous on one step.
4.14. Step, which increases the price of this item during the bidding process, is about 10% of the current price of the lot. The auctioneer has the right to establish different step value during the auction.
4.15. Raising card with number by person, acting under a power of Attorney, as well as by an employee of the Auction House, participated in telephone bidding in favor of another person, causes rights and obligations directly for the person, whose interests representative or employee of the Auction House acts in.
4.16. The Buyer and the final price are determined with the last fall of the hammer. The winner is the participant, who offered the maximum price by raising his card with number, or participant, who offered the maximum price by telephone or absentee bidding. From this moment the lot is count as sold and claims of other bidders are void.
4.17. Photography, videofilming, audio recording and promotions are prohibited during the auction. Violators of this requirement are removed from the hall and denied the right to visit Organizer's auctions.
Payment procedure
5.1. The successful bidder is obligated to pay for the lot. Payment is due in Russian ruble currency. Payment amount consists of the cost of item and the commission charges ? 15%.
5.2. Payment can be made during the auction, after the auction, and during the next 7 days.
5.3. The Buyer can fulfill the payment in the following ways:
- in cash,
- cashless transfer,
- by credit card: VISA, VISA ELECTRON, MasterCard, MasterCard Electronic, Maestro, JCB, UnionPay.
5.4. If the Buyer pays in cash in 5 days the commission charges can be reduced to 12%.
5.5. If the Buyer fails to collect his purchase within 15 calendar days after the auction, regardless of the payment, the Auction House has the right to store the items at the Buyer?s expense and to give them to him only after he fulfills the payment of the costs of the storing.
5.6. If the Buyer fails to fulfill his payment obligations within 30 days after the auction the auctioneer has the right to charge interest on the unpaid amount at the rate of 0.3 % for each day of delay.
5.7. If the Buyer fails to fulfill his payment within 60 days after the auction the auctioneer has the right to cancel the transaction and require the Buyer to recover the amount of both Buyer?s and Seller?s commissions charges.
5.8. The Auction House has the right, without canceling the transaction, to bring the Buyer, who didn't pay, to responsibility in the full amount, to start a lawsuit in order to recover it together with interest, costs and expenses, according to the current legislation of Russian Federation.
5.9. All the disputes on payment between the Buyer and the Auction House have to be solved by negotiations or in the courts at the location of the Auction House.
5.10. After the Buyer fulfills the payment he can pick up his purchase at the auctioneer?s office or order the shipping of one of the shipping agencies. The cost of shipping and insurance is paid by the Buyer.
5.11. Auction House "Anticvarium" does not issue any licenses for the export of antiques from the Russian Federation and can not guarantee the Ministry of Culture will issue such licenses.
Guarantees and commitments.
6.1. Auction House "Anticvarium" undertakes to take all necessary measures to provide auction participants with accurate information about the auction items for sale.
6.2. Items sold at auction can not be returned or exchanged.
6.3. If there was an expert conclusion about the item authenticity at the time of the auction, any statements about its possible forgery are not allowed.
6.4. Statement of the auction participant that purchased item is a forgery, should be made for the Organizer within one year from the day of the auction. The bidder must provide at least two separate and independent expert opinions issued by state museums or research institutions of the Russian Federation, relevant to the auction subject.
6.5. If it will be clearly proven that purchased item is a forgery, the object must be delivered to the Organizer in the same condition, which it was sold in on the auction day, without any changes and interventions.
6.6. Funds for such an item can be paid back by the Organizer to the Buyer after funds receiving from the previous owner of the object who has delivered it to the auction.
6.7. Money-back guarantee applies only to the firsthand Buyer of the item, this fact must be confirmed by the corresponding documents. Returned item must be released from the property obligations, and that also needs to be confirmed by the object Buyer.
6.8. Auction House "Anticvarium" guarantees to its Buyers safety of the information about the names and whereabouts of clients, as well as about the purchased lots and their costs.
