TERMS AND CONDITIONS
1. The lots are knocked down to the highest bidder. If any dispute arises
between two or more bidders, the disputed lot may, at the sole discretion
of the Auctioneer, immediately be re-offered and resold.
2. Americision reserves the right to withdraw any lot in its absolute
discretion and without need of any notice. During the auction, the
auctioneer in its absolute discretion is entitled to change the order of
sale, to join and/or separate any two or more lots. Americision, moreover,
shall also withdraw lots if the bids do not reach the reserve price, as
agreed between Americision and the Seller.
3. Items that are not claimed, and paid for within 10 days of the auction
will be subject to storage charges and/or forfeiture. Storage fees will be
assessed at $25 per item, per day on items that remain at stock as of the
10th day from the auction date.
4. Everything is sold AS IS and WHERE IS. While we do our best to describe
the items properly, neither Americision, nor the consignors make any
guarantees or warranties to the accuracy of these descriptions.
5. Written and oral descriptions are our opinions and should in no way be construed as
a guarantee of any kind as to authenticity, age, condition, materials or
any other feature of items being sold.
6. Americision will assert best effort to catalog every lot correctly and
will attempt to point out any defects, but will not be responsible or
liable for the correctness of the catalog or other descriptions of the lot.
7. We recommend the prospective bidders examine all items in which they
have an interest. By placing a bid, either in person, by phone, absentee or
via the Internet, the bidders signify that they have examined the items as
fully as possible, or that they have chosen not to examine the items.
8. If your item(s) are damaged in shipping, you will need to contact the
shipper to file a claim. If your item(s) are being shipped and there is a
condition problem upon receipt, you are expected to notify us immediately
by phone at 909-786-1706. Any condition concerns will be null and void
after the 10th business day following the end of the auction. Please note
that if you pay late and thus receive your item(s) late, this does not
qualify you for special privileges.
9. NO REFUNDS! ALL SALES ARE FINAL!
10. If the auctioneer determines that any opening or later bid or any
advance bid is not commensurate with the value of the Property offered, he
may reject the same and withdraw the Property from sale.
11. In no event shall it be responsible for the correctness, nor deemed to
have made any representation or warranty of description, genuineness,
attribution, provenance or condition of the property and no statement by
anyone or in the catalog, in any advertisement, or which is made at the
sale, in the bill of sale or invoice, or elsewhere, shall be deemed such a
warranty or representation or an assumption of liability. Without in any
way waiving the foregoing, any complaint regarding authenticity,
genuineness, attribution or provenance shall be made within twenty-five
(25) days of the day of sale or such complaint shall be waived. All bidders
acknowledge their right to have made or requested full inspection of any
and all properties prior to sale and agree to be charged with all matters
such inspection may have disclosed or indicated. Inspection on the day of
sale will be permitted only upon prearrangement with the COMPANY.
12. Upon the fall of the hammer, title to any offered lot or article will
immediately pass to the highest bidder as determined in the exclusive
discretion of the auctioneer. Such bidder thereupon assumes full risk and
responsibility for the property sold, agrees to sign any requested
confirmation of purchase, and agrees to pay the full purchase price
therefore or such part upon such terms as the Company may require. All
property shall be paid for and removed by the purchaser at his/her expense
within 15 days of sale and, if not so removed, may be sold by the Company,
or sent by the Company to a public warehouse, at the sole risk and charge
of the purchaser(s), and the Company may prohibit the purchaser from
participating, directly or indirectly, as a bidder or purchaser in any
future sale or sales. The Company will not be responsible for any loss,
damage, theft, or otherwise responsible for any goods left in the Company's
possession after 15 days. If the foregoing conditions or any applicable
provisions of law are not complied with, in addition to other remedies
available to the Company and the Consignor (including without limitation
the right to hold the purchaser(s) liable for the bid price) the Company,
at its option, may either cancel the sale, retaining as liquidated damages
all payments made by the purchaser(s), or resell the property. In such
event, the purchaser(s) shall remain liable for any deficiency in the
original purchase price and will also be responsible for all costs,
including warehousing, the expense of the ultimate sale, and the Company's
commission at its regular rates together with all related and incidental
charges, including legal fees. Payment is a precondition to removal.
13. Unless the sale is advertised and announced as "without reserve", each
lot is offered subject to a reserve and the Company may implement such
reserves by bidding through its representatives on behalf of the
Consignors. In certain instances, the Consignor may pay less than the
standard commission rate where the Company or its representative is a
successful bidder on behalf of the Consignor. Where the Consignor is
indebted to the Company, the Company may have an interest in the offered
lots and the proceeds there from other than the broker's Commissions, and
all sales are subject to any such interest.
14. No "buy" bids shall be accepted at any time for any purpose.
15. All property is sold to the highest bidder as is, where is without warranty or guarantee of any kind whether expressed, implied or statutory including without limitation any warranty or guarantee as to character, fitness for a particular purpose, merchantability, and physical condition. Prospective buyers must rely solely on their own knowledge before bidding to determine such as age, quality, character, condition. There is no return privilege, and all sales are final.
16. All items are available for your examination prior to bidding. 17. Americision will communicate with all successful online bidders within three days after auction to arrange payment method and shipping details. All sales are final.
All items sold online are subject to a buyers premium of 20%.
Items purchased in California are subject to 9.25% sales tax.
18. All purchases are subject to the California 9.25% sales tax unless the purchaser possesses a Massachusetts sales tax exemption number. Exemption numbers from other states are accepted in California if presented with a business card or letterhead. Dealers, museums, and other qualifying parties can apply for a California exemption number prior to the auction.
19. For any item that is approved to be return, we will not provide any full refund. We will ONLY refund the hammer price.
REGULATION OF BID
The Auctioneer shall regulate the bidding and shall be the sole arbiter of any disputes. We reserve the right to withdraw property at any time before the sale and reject a bid from any bidder.
RISK OF LOSS
In the event delivery cannot be made because of loss due to fire, theft, or any other reason, the Gallery shall only be liable for the return of any deposits or payments made by the purchaser. NO WARRANTY ALL ITEMS SOLD "AS IS AND WHERE IS"
CONDITIONS OF SALE
Lots are sold without guaranties or recourse and « as is
». The Americision's decisions are final (all
information are approximate). Items purchased at the
auction must be paid for immediately. A charge of
20% over and above the hammer price, as well as
taxes (when applicable) are added to all lots purchased
at the auction.
PAYMENT
1. We accept PayPal in US Dollar, bank wire transfer, money order, and check. (Please notes bidder will be responsible for the 4% transaction fee if paying by Paypal)
2. Payment must be due in 15 days after the auction date. Americision reserves the right to refuse selling the lot if not receiving the payment
on time.

Condition Report: We strive to provide accurate, objective and fair information on all lots for sale, and we are happy to provide condition statements as a courtesy to our clients. Please keep in mind that any condition statement is merely an opinion, not a statement of fact, and all lots are sold "as is." Americision Inc. have no responsibility for any error or omission and neither Americision Inc. nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. We advise that you or someone on your behalf inspect the lot personally before purchase.
SHIPPING
Buyer to pay actual shipping cost through UPS. Americision Inc Antiques will not be RESPONSIBLE for loss or damages caused by shipping or packaging. Shipping of purchased property is the responsibility of the buyer. All shipping arrangements and payment for shipping should be made directly with the shipper of your choice.
Shipping is the responsibility of the purchaser. Upon request, our staff will provide the list of shippers who deliver to destinations within the United States and overseas. Some property that is sold at auction can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots
Packing, shipping and insurance (including reimbursement for damage or loss) of purchased loss is the sole responsibility of the purchaser.
