The lots listed in this catalogue will be offered by Bella Button Auctions, as owner or as agent for consignor(s) subject to the following terms and conditions. By bidding at auction you agree to be bound by these Conditions of Sale.
Before the Sale
Prospective buyers are strongly advised to personally examine any property in which they are interested before the auction takes place.
Condition Reports:
Condition reports are available on request.
Please request condition reports. The catalog description does not list any damage or repairs to the items. You may also request information on back marks, if they have not been included in the description. You can e-mail info@bellabuttonauctions.com, and label the email and include the lot numbers, to receive a condition report or specific information. You MUST request a condition report by the Monday before the first auction session by 3:00P.M. (PST).
All lots are sold "AS IS" and without recourse and neither Bella Button Auctions, nor its consignor(s) makes any warranties or representations, express or implied with respect to such lots. Neither Bella Button Auctions nor its consignor(s) makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, correctness of the catalogue or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold.
The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. No statement, whether written or oral, and whether made in the catalogue, in a condition report or in supplements to the catalogue, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability.

At The Sale
Starting Time:
The auction will begin on time. There will be a brief explanation of the auction process and terms and conditions before the auction begins. A round of bidding begins when the auctioneer opens the bid on each individual lot and concludes by say "going once, going twice, going three times, and sold."
Refusal of Admission: Bella Button Auctions has the right, at our complete discretion, to refuse admission to the premises or participation in any auction and to reject any bid.
Bidding as Principal - When making a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer's premium, all applicable taxes and all other applicable charges, unless it has been explicitly agreed upon in writing with Bella Button Auctions, before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to Bella Button Auctions, and that Bella Button Auctions, will only look to the principal for payment.
Registration:
Registration before Bidding - A prospective buyer must complete and sign a registration form and provide identification before bidding. We may require bank or other financial references.
Although there is no obligation to bid, all prospective buyers must register in order to bid at the auction. Each buyer will be assigned a unique number during the preview, via email, or over the telephone. Visa/MasterCard Credit cards may be used as collateral and as final payment for purchase of goods. A prospective buyer must complete and sign a registration form and provide identification before bidding. We will require bank or other financial references unless the buyer has established credit history with Bella Button Auctions.
Internet Bidders - Registration
All bidders must register their name, permanent street address and phone number prior to the auction. Internet bidders are required to register and establish and account with Bella Button Auctions. This may be accomplished by providing any of the following: your EBay user name with excellent rating, Credit Card information, a bank Letter of Credit, Certified or Bank Check, Personal/Company Check accompanied by a Letter of Guarantee or Bank Wire Transfer of Funds (contact Bella Button Auctions for instructions). You may contact Bella Button Auctions directly at 408-202-2441 if you need assistance. The auction company reserves the right to refuse service to any person.
Absentee Bids:
Many buyers find it convenient to leave their bids with the auctioneer. The auctioneer will execute your bid. Absentee bids may be submitted by phone or email 24 hours prior to the scheduled sale.
We will use reasonable efforts to carry out written bids given to us prior to the sale for the convenience of clients who are not present at the auction in person, by an agent or by telephone. Bids must be placed in U.S. dollars. If we receive written bids on a particular lot for identical amounts, and these are the highest bids on the lot at the auction, it will be sold to the person whose written bid was received and accepted first. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with the written bid.
Telephone Bids:
If a prospective buyer makes arrangements with us at least two days prior to the commencement of the sale we will use reasonable efforts to contact them to enable them to participate in the bidding by telephone. We do not accept liability for failure to do so or for errors and omissions in connection with telephone bidding.
Important Note on Internet Absentee Bid:
We will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the internet or software malfunctions related to the execution of online bids.
Items offered are part of a live auction conducted by Bella Button Auctions. Items are offered in numerical order and are auctioned at a pace of approximately 50-70 Lots per hour. Absentee bids left on Liveauctioneers ARE NOT the same as bids left with Bella Button Auctions directly. They are executed from a proxy computer terminal in the room, against other internet bidders. Other competitive bids include Bidders on the telephone, in the room, and absentee bids left with Bella Button Auctions. Tie bids may occur between Liveauctioneers absentee bids and other bidders. Tie bids are broken by the order in which the Auctioneer accepts the bids, and not by when the bids were entered with Liveauctioneers. In all cases the Auctioneer has final discretion over which bids to accept. We are not responsible for inadvertent bids, or problems arising due to internet connections, incorrect computer settings or other website related problems beyond our control.
Reserves:
Some lots in the sale may be subject to a reserve which is the confidential minimum price below which such lot will not be sold. Reserves are agreed upon with consignors or, in the absence thereof, the absolute discretion of Bella Button Auctions. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the seller. The auctioneer may continue to bid on behalf of the seller up to the amount of the reserve, either by placing consecutive bids or by placing bids in response to other bidders. With respect to lots that are offered without reserve, unless there are already competing bids, the auctioneer, in his or her discretion, will generally open the bidding at half of the average estimate for the lot. In the absence of a bid at that level, the auctioneer may proceed backwards at his or her discretion until a bid is recognized, and then continue up from that amount.
Successful Bid:
The highest bidder acknowledged by the auctioneer will be the purchaser. In the case of a tie bid, the winning bidder will determined by the auctioneer at his or her sole discretion. In the event of a dispute between bidders, the auctioneer has final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, Bella Button Auctions sale record shall be conclusive. Title passes upon the fall of the auctioneer's hammer to the highest acknowledged bidder subject to the Conditions of Sale set forth herein, and the bidder assumes full risk and responsibility.
Auctioneer's Discretion:
The auctioneer has the right at his or her absolute and sole discretion to refuse any bid, to advance the bidding in such a manner as he or she may decide, to withdraw any lot, and in the case of error or dispute, and whether during or after the sale, to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the item in dispute. If any dispute arises after the sale, our sale record is conclusive.
Any additional terms or conditions of sale, added by auctioneer, shall be announced prior to auction. Announcements made on the day of the sale from the auction block supersede any printed material or any other statements made previously.
The auctioneer reserves the right to withdraw from the sale any of the items listed or to sell at this auction items not listed. The purchaser will be the highest bidder acknowledged by the auctioneer, and at the fall of the hammer the purchaser will assume all responsibility for the lot purchased. In the event of any dispute between bidders, the auctioneer has the sole right to determine the successful bidder, or to put the lot up for resale to the highest bidder. The auctioneer also reserves the right to group one or more lots into one or more selling lots or to subdivide into tow or more selling lots. The auctioneer reserves the right to sell all of the items listed in bulk lots when the best interest of the seller will be served. The decision of the auctioneer will be final and absolute.
After the Sale
Buyer's Premium:
In addition to the hammer price, the buyer agrees to pay Bella Button Auctions a buyer's premium and the applicable sales tax added to the final total.
Buyer's Premium is 15% (Fifteen Percent) for all sales.
The Buyer must pay the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges) no later than 5 p.m. on the third (3) business day following the sale. Payment in U.S. dollars may be made with cash; bank check or cashier's check drawn on a U.S. bank; PayPal; or credit card (A 2% ADMINISTRATIVE FEE OF THE INVOICED AMOUNT IS CHARGED FOR PAYMENTS MADE BY CREDIT CARD) unless other arrangements are made with Bella Button Auctions who reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. The purchaser agrees to pay Bella Button Auctions a handling charge of $50 for any check dishonored by the drawee.
Terms of Payment:
Acceptable terms of payment are cash, cashiers check, MasterCard/Visa, personal checks with credit approval by Bella Button Auctions and payment through PayPal.
For those attending the live auction, all bills must be paid in full before leaving the premises on the day of sale, unless other arrangements have been made. All applicable sales taxes will be collected unless the buyer provides a suitable exemption or resale certificate at the time of registration. No refunds of sales tax will be made.
Refund Policy:
Under no circumstances will requests for refunds be considered. Further note that any of the Auctioneer's statements or notations, written or verbal, regarding condition of a lot are opinions only, are subject to error, are specifically excluded from all guarantees, and will not be considered as a basis for a request for a refund. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse.
Removal of Goods:
Removal shall be at the expense, liability, and risk of the purchaser. Purchases can be removed only on presentation of paid bill. No claims will be allowed after goods are removed from premises.
Shipping:
As a convenience to Buyers not present at the auction, Bella Button Auctions will arrange for packing and shipping at cost, with all packaging, shipping and insurance costs to be borne by the purchaser. We cannot ship to P.O. Boxes via FedEx. All shipments are mailed FedEx Ground and are insured. We ship internationally at cost.
Contract:
Your bid is a contract. Place a bid only if you're serious about buying the item. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from Bella Button Auctions. You should contact Bella Button Auctions to resolve any questions before bidding.
