All properties offered and sold through L & H Art Co. shall be offered and sold on the terms and conditions set forth below. By bidding at the auction, whether present in person or by agent, by absentee bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions. Except as otherwise stated L & H Art Co. acts as agent for the seller. The contract for the sale of the property is made between the seller and the buyer. The buyer must pay the full amount due (comprising the hammer price, buyer?s premium and any applicable taxes or resale royalty) immediately after the sale. The buyer will not acquire title to the lot until all amounts due to us from the buyer have been received by us in good cleared funds even in circumstances where we have released the lot to the buyer. For items purchased online, you will be emailed an invoice within 24 hours after the auction. The buyer should pay all the fees within 12 days after the transaction. The Company accepts Paypal and Bank Wire Transfer Payment. Invoices over $5000 require a wire transfer as do the sale of the jewelry and the well-made high-of-the-high items in our discretion. We recommend Internet bidders register at least 48 hours prior to an auction to give enough time to process and approve their registration. By registering to bid on any item, bidder agrees to all terms and conditions of the auction. 2. Description. Though all description and commentary are believed to be correct, neither the auctioneer or the consignor makes any guarantee of the authenticity of the merchandise. Any descriptions, condition reports, and any other statements are our opinions and are not to be relied upon as facts. No employees are authorized to make any warranties of any kind on behalf of L & H Art Co. and potential buyers must rely only on their own inspection of the merchandise. L & H Art Co. offers high resolution photos for potential buyers to review and make their own conclusions about the piece. 3. Estimates. A range of estimates may be given on lots with a low and a high estimate. Estimates should not be relied on as a prediction of the actual selling price but are merely an opinion as to the value. 4. Absentee Bidding. Telephone, online and absentee bidding is a convenience offered by L & H Art Co. to customers in need and while we make every effort to execute your instructions regarding your telephone or absentee bidding, L & H Art Co. is not liable or responsible for any errors or failure to execute such instructions. All telephone and absentee bid buyers must provide a credit card to secure a bidding number and L & H Art Co. reserves the right to require deposit from telephone and absentee bidders for certain items. 5.Withdrawal. We may, in our sole discretion, withdraw a lot from auction at any time prior to or during the sale and shall have no liability to you for our decision to withdraw. If the sale is undeliverable prior to departure due to theft, damage or other damage, the sale shall be deemed to be canceled and shall not be liable. 6.Bidders? Liability. When making a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer?s premium and all applicable taxes, plus all other applicable charges. Bidders bid at all times represents an irrevocable offer by bidder to enter into a binding contract to purchase the property in accordance with the specific provisions of the listing and these general terms and conditions as applicable, even if a higher bid was received by the Company. 7. Buyer. The highest bidder acknowledged by the auctioneer shall be the buyer. The auctioneer has the right to reject any bid, to advance the bidding at this absolute discretion and in the event of any dispute between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after sale, the L & H Art Co. sale record shall be conclusive in all respects. 8. Technical Issue. In the unlikely event that we lose our internet connection, L & H Art Co. reserves the right in its sole and absolute discretion to cancel the remainder of the auction. 9. Payment. In addition to the hammer price, the buyer agrees to pay to us the buyer?s premium together with any applicable value added tax. The buyer?s premium is 25%. 10. Delivery. We shall be entitled to retain items sold until all amounts due to us have been received in full in good cleared funds. All shipping and handling will be done by the company and third party licensed shippers. Charges will be included in your invoice. Additional charges may apply to oversize lots. The company will arrange shipping as soon as the payment is confirmed. Usually the packages would be sent out within 5 to 10 business days (mostly we ship before this time). Followed by their payment and upon bank clearance which may depends on the item and its value, the delivery may be delayed. Although we shall use reasonable efforts to take care when handling, packing and shipping a purchased lot and in selecting third parties, we are not responsible for the acts or omissions of any such third parties. Paying Late. If buyer fails to make payment in full in good cleared funds within 12 days after the sale, we shall have the right to exercise a number of legal rights and remedies. In addition to other remedies available to us by law, we reserve the right to impose a late charge of 1.5% per month of the total Purchase Price if the payment is not made in accordance with the conditions set forth herein. 12. Return and Refund. We support returns and refunds within 7 days of receipt. Client can return the lot at their own expense in the condition it was in at the time of sale. After such time, we will not be obligated to arrange return or refund. After we receive the auction item in the condition it was in at the time of sale, we will refund you the amount including the hammer price as well as the premium, excluding shipping costs. The incurred handling fees etc. need to be borne by the customer. In no event will L & H Art Co.?s liability to a buyer ever exceed the purchase price paid.
