Terms and Conditions 1. Prior to sale, all bidders must register with liveauctioneer.com. Or in person at the auction site. 2. All property is sold As Is. Neither the Auctioneer nor the Consignor make any warranties or representations of any kind or nature, expressed or implied, with respect to the property, its merchantability or fitness for use or for any particular purpose as it relates to description genuineness, attribution, provenance, safety, reliability or condition of the property. 3. The Auctioneer will not be held responsible for any variations in appearance of online photographs. Notwithstanding the preceding condition, if within 14 days of the sale of any lot the purchaser of any painting or lot gives notice in writing to the Auctioneer that the lot sold is a counterfeit and, if within 7 days after such notice the purchaser returns the lot purchased to the Auctioneer in the same condition as when sold, and gives written proof from a recognized impartial expert which establishes beyond reasonable doubt that the returned lot is in fact a counterfeit and that this was not indicated by a fair reading of the catalog or the Auctioneer?s comments at the time of the sale, the Auctioneer as agent for the Consignor will rescind the sale and refund the purchase price. 4. The Auctioneer reserves the right to withdraw any property at any time before the actual sale and shall have no liability. 5. The Auctioneer reserves the right to reject a bid from any bidder. The highest bid acknowledged by the Auctioneer shall be the purchaser. In the event of any dispute between bidders, the Auctioneer shall have the sole and final discretion either to determine the successful bidder, or to re-offer and re-sell the lot in dispute. The Auctioneer reserves the right to bid; and if, having acknowledged an opening bid the Auctioneer decides that any advance is not sufficient, the Auctioneer may reject the advance. The Auctioneer reserves the right to acknowledge an auction floor bid before acknowledging an internet and/or phone bid regardless of the maximum bid amount provided by the bidder before and/or during the auction. 6. Any damage to or loss of any item purchased which is left with the Auctioneer after the day of purchase is the purchaser?s sole responsibility. 7. Unless the sale is advertised and announced as an unrestricted sale or sale without reserve, the consignor has the right to bid through the Auctioneer as agent on their own consignments. 8. By bidding a bidder will fully accepts of the terms and conditions herein. 9. Payment will be accepted in the form of Credit Card to Live Auctioneers. Cash or check will be accepted on site. 10. PLEASE NOTE, ALL ITEMS ARE SOLD AS IS, WITH NO RETURNS! Please make sure you read all terms and conditions before placing a bid. The Art will not be insured between the Goddard Center and until it is insured at the UPS Store. 16. Preview Dates and Times: Preview beginning October 11th until the conclusion of auction. Tuesdays, Wednesdays and Thursdays 10:00 AM - 6:00PM. Fridays 9:00AM -5:00PM and Saturdays 1:00PM - 4:00PM 17. Checkout Date and Times: Thursday, November 11, at the Conclusion of the auction. 18. Pickup Date: Friday November 12, 9:00AM - 5:00PM. 19. Nothing shall be removed without a paid receipt. EVERYTHING NOT PICKED UP BY FRIDAY NOVEMBER 12th AT 5:00 PM WILL BE SUBJECT TO STORAGE FEES UNTIL PICKED UP EITHER BY OWNER OR SHIPPER. 20. The successful high bidder is responsible for the lot purchased from the time the Auctioneer calls it sold. Neither the seller not the auctioneer assumes any responsibility for any loss, damage or theft occurring after the hammer falls. 21. Neither the seller nor the auctioneer assumes any responsibility for any injuries suffered while inspecting or buying.
