1. BID PRICE Each buyer must register with Daboseong Gallery prior to bidding. The highest bidder on a lot shall be the buyer of the lot. The purchase price shall be the sum of 1) the price at which the item is sold, plus 2) A BUYER'S PREMIUM OF 15% ON THE FIRST $ 50,000 BID PRICE ON ANY LOT AND 13% ON ANY AMOUNT OVER $ 50,000, plus 3) sales tax unless the purchaser is exempt by law from such taxes. 2. RESERVE PRICE The Reserve Price is the confidential minimum Price the consignor will accept and below which a lot will not be sold. The reserve will not exceed the low presale estimate. 3. REGULATION OF BID The Auctioneer shall regulate the bidding and shall be the sole arbiter of any disputes. We reserve the right to withdraw property at any time before the sale and reject a bid from any bidder. 4. ONLINE BIDDING Daboseong Gallery will not be liable for malfunctions, errors or omissions (hardware, software, electronic, human or otherwise), whether or not due to Daboseong Gallery's fault or negligence, resulting in the inaccurate transmittal of bids, the failure to execute bids or any other irregularity. 5. PAYMENT We accept Cash(In House Only), Wire(bank) Transfer and Paypal. IN THE EVENT THAT YOU REFUSE PAYMENT FOR A WINNING BID, YOU WILL BE SUBJECT TO 8% LIQUIDATED DAMAGES CHARGE OF THE HAMMER PRICE 6. PAYMENT AND PICKUP The invoice must be paid in full and merchandise picked up or shipping arrangements made within seven days of the date of sale. A storage fee will be charged if merchandise is left longer than two weeks of $10.00 per lot per day. If the property is left longer than 3 weeks, it will be considered abandoned. Items cannot be picked up until we confirm a payment. 7. RISK OF LOSS In the event delivery cannot be made because of loss due to fire, theft, or any other reason, the Gallery shall only be liable for the return of any deposits or payments made by the purchaser. 8. NO WARRANTY ALL ITEMS SOLD "AS IS AND WHERE IS" THE GALLERY, ITS AGENTS AND EMPLOYEES, AND THE CONSIGNOR DO NOT WARRANT ANY LOT TO BE MERCHANTABLE OR TO BE SUITED FOR ANY PURPOSE AND THEY DO NOT ASSUME ANY RISK, LIABILITY OR RESPONSIBILITY FOR ANY PERSON AS TO AUTHENTICITY, GENUINENESS, CULTURE, SOURCE, ORIGIN, ATTRIBUTION, PERIOD, PURPOSE OR MEASUREMENTS OF ANY LOT. THESE CONDITIONS MAY NOT BE ALTERED OR MODIFIED EXCEPT BY AN INSTRUMENT IN WRITING, SIGNED BY AUCTIONEER AND BUYER. 9. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. The Gallery shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. 10. RIGHT OF RESCISSION AS YOU HAVE ACKNOWLEDGED BY AGREEING TO THE TERMS AND CONDITIONS OF THIS AUCTION, THERE ARE NO REFUNDS OR EXCHANGES. IN THE EVENT THAT YOU REQUEST AND ARE GRANTED BY DABSEONG GALLERY, A RETURN OR REFUND, YOU AGREE THAT YOU ARE STILL RESPONSIBLE FOR PAYING A 10% RESTOCKING FEE BASED ON THE HAMMER PRICE OF EACH ITEM THAT IS RETURNED, LESS APPLICABLE TAXES, PLUS THE ENTIRE BUYER'S PREMIUM FOR EACH ITEM AS WELL AS ALL OF THE SHIPPING/HANDLING CHARGES. ACCORDINGLY, THE RESTOCKING FEE, BUYER'S PREMIUM, AND ANY SHIPPING AND HANDLING COSTS ARE NEVER ELIGIBLE FOR A RETURN OR REFUND. 11. For Chinese Porcelain and Works of Art 1) A piece catalogued with the name of a period, reign or dynasty without further qualification was, in our qualified opinion, made during or shortly after that period, reign or dynasty (e.g. "a Ming vase"). 2) A piece catalogued "in the style of" a period, reign or dynasty is, in our qualified opinion, quite possibly a copy or imitation of pieces made during the named period, reign or dynasty (e.g. "a vase in Ming style"). 3) A reference to a "mark and of the period" means that, in our qualified opinion, the piece is of the period of the mark (e.g. "Kangxi six-character mark and of the period"). 4) A reference to a mark without reference to "and of the period" means that, in our qualified opinion, although bearing the mark, the pieces were possibly not made in the period of the mark (e.g. "Kangxi six-character mark"). 5.)Where no date, period, reign or mark is mentioned, the lot is, in our qualified opinion, of uncertain date or 19th or 20th century manufacture. 12. CATALOGUE EXCHANGE RATE: The rate of exchange was established at the latest practical date prior to the printing of the catalogue and may therefore have changed by the time of the sale. Bidders should bear in mind that estimates are prepared well in advance of the sale and are not definitive. They are subject to revision. 13. Jurisdiction and governing law These Auction Terms shall be governed by the laws of Republic of Korea. The courts of Republic of Korea shall have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Auction Terms. 14. TRANSLATION In the case of any ambiguity or discrepancy between the English, Chinese and/or Korean text in this catalogue, the English version shall prevail.
