Please read carefully these conditions of sale of EBID corp. By placing a bid, registering, or participating in the auction, whether in person, proxy/representation, telephone, internet, email, etc., you accept and agree to be bound by these terms and conditions of sale. These conditions may be subject to change depending on certain circumstances; notices regarding the changes shall be posted online before the beginning of each auction. EBID Corp. shall be here on referred to as, we, or auctioneer, or our. 1. The property sold in our auction are sold AS IS and neither the auctioneer nor any consignor, whether express or implied, makes any warranty or representation with respect to the property auctioned. No statement, either oral or written, shall be deemed such a warranty or representation. 2. It is the responsibility of the prospective bidders/buyers to inspect the item first before placing a bid to determine its condition, size, and your level of interest to the item. Additional photos or condition reports may be requested prior to the sale. By placing a bid, you signify that you have examined the items as fully as you desire or that you have chosen not to examine them. The description, condition reports, and measurements are approximate and are professional opinions made by persons in the jewelry industry. EBID attempts to catalog every lot correctly and to point out any defects but shall not be responsible and liable for the correctness of the catalog or descriptions of the lots. These reports are available as a courtesy to our prospective bidders and should in no way be construed as a guarantee of any kind. 3. A range of estimates is given on each lot. Estimates should not be relied on as a prediction of actual selling or resale price. 4. Some items/lots in the auction are subject to a reserve price which is a confidential minimum price a bid should reach before it is sold. The reserve price is agreed upon between consignors and EBID corp. 5. We reserve the right to withdraw and/or combine any property during or prior to the sale and cannot be held liable for such action. 6. We reserve the right to reject a bid if the auctioneer feels that the bids are below the value of the lot. If the auctioneer does not receive or accept an advance additional bid, then he/she may pass and not sell that lot. Auctioneer may, at his/her absolute discretion, re-offer or reopen a lot for sale. EBID reserves the right to withdraw any lot at any time before, during, or after the auction without liability. 7. The price recorded by the auctioneer is official and final. The highest acknowledged bidder shall be the Purchaser of the item. The Purchaser assumes full responsibility for items at the fall of the hammer. In the event of a dispute between 2 or more parties, the auctioneer has final and absolute discretion to determine the successful bidder or may reopen the lot for sale. If a dispute arises after the sale, EBID corp. sales records shall be conclusive and irrefutable. 8. As a convenience to potential buyers who are not able to join the live auction, we may permit or accept absentee bidding in the form of a representative bid, telephone bid, internet bid, and written bid. We are not liable for any error, whether fortuitous or human, with regards to this form of bidding. We cannot be held liable in the event we cannot execute these types of bids. 9. ALL SALES ARE FINAL. No refunds and no exchanges 10. For all residents of New Jersey, a 6.875% sales tax shall be added to your invoice and will be due immediately upon purchase. 11. EBID Corp. accepts personal or business checks, cashiers checks, money order and wire transfers. We do not accept PayPal Payments but we do use in-house (liveauctioneer) merchant services for safe and reliable credit card transactions. EBID reserves the right to hold all purchases until the payment has cleared to the satisfaction of EBID and its bank. It is the responsibility of the purchaser to email us at info@ebidcorp.com or contact us at (347)241-7268 if you are unable to pay through our online check-out system. For items purchased online, an invoice shall be sent via e-mail within 24 hours after the auction. If we are prevented by any fortuitous events like theft, fire, severe weather conditions, or any other reason whatsoever from delivering any property to the purchaser, our liability shall only be limited to the sum actually paid by the purchaser for such property. 12. All domestic shipping shall be complimentary and paid for by EBID Corp. Every shipment shall be fully insured and once the package is received by the Purchaser, EBID Corp. shall be relieved of all liabilities and shall be held harmless from any claims. In international shipments, all expenses of such shipment including taxes, duties and insurance shall be paid for by the Purchaser. SHIPPING METHOD $1 to $1,000- USPS Signature Required More than $1,000- UPS/FedEx/Malca/Ferrari/Brinks Signature Required We do not ship to PO box addresses. 13. A buyers premium shall be added to the hammer price on each lot sold. For all purchases up to 50,000 USD, the buyers premium shall be 23%. For purchases above 50,000 USD, the buyers premium shall be 18%. 14. We protect the rights and privacy of all our bidders and consignors. We shall not disclose the identity of all our bidders and consignors to third parties unless only if mandated by law. 15. Once the purchaser receives an invoice and the purchased items, ownership/title to the property is hereby transferred to such purchaser. EBID corp. is hereby relieved of any responsibility and shall not be held liable and harmless from any and all claims.
