Buyers must accept the following Terms & Conditions to participate in Apollo Auctions ("the auction" "We" "Us"). These terms and conditions apply to all online bidding at auction sales conducted by or in conjunction with Apollo Auctions ("Online Bidding"). By registering to participate in an Apollo Auctions sale (a "Sale") via Online Bidding, you expressly agree to these terms and conditions. TERMS AND CONDITIONS 1. All sales are final. Title does not pass until payment is made in full. 2. All winning bidders "Buyers" pay Apollo Auction premium of 25% of the Lot's Hammer price. 3. ALL LOTS DESCRIBED IN THIS CATALOGUE ARE SOLD "AS IS" EXCEPT AS EXPRESSLY STATED OTHERWISE. THE AUCTION HOUSE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE MERCHANTABILITY OR FITNESS FOR PURPOSE EXCEPT AS OTHERWISE EXPRESSLY STATED IN THESE TERMS OF SALE. For each Lot, the consignor has represented and warranted to us that the consignor is the owner of such Lot or is acting as authorized agent of the owner of the Lot and has the right to transfer title to the Lot free of all liens, claims, and encumbrances. Neither the consignor nor we make any warranty or representation, express or implied, as to whether you will acquire any reproduction rights, copyrights or other intellectual property rights in, or with respect to any Lot. The Auction House retains all rights to photographs and other intellectual property contained in this catalogue. 4. The Auction House reserves the right to withdraw a Lot from auction for any reason and with no liability whatsoever for such withdrawal. 5. The estimates provided in this catalogue are neither a representation nor a prediction of the hammer price that will be realized at auction, price realized at a post-auction sale, or price realized upon resale, which may be substantially different from our estimates in this catalogue. We shall not be liable for any discrepancies between our estimates and a price realized. 6. BUYING. All successful bidders will be sent invoices by e-mail or mail (if we do not have an email address on file) within two business days following an auction. We charge a buyer?s premium on each Lot sold in amount equal to: 25% of the hammer price up to and including $25,000; and 20% on that part of the hammer price above $25,000 (the "Buyer's Premium"). 7. Apollo Auctions accepts cashier?s checks and bank wires. Personal checks are accepted only if agreed upon by Auctioneers before the auction begins. (The "Sales Price" is the Hammer Price plus the Buyer's Premium, plus applicable taxes). 8. Title to Lot and risk of loss or damage to the Lot passes to the Buyer when the Hammer falls. Apollo Auction shall have no liability for any damage to property left on its premises after the date of sale. 9. All property must be paid for and removed from Apollo Auctions within 10 business days of the auction?s end unless special arrangements are agreed upon in writing before the sale. Storage fees are charged beginning on the 11th business day. Beginning on the 11th business day, Buyer will be charged a daily storage fee of $50.00 per Lot; for 7 (regular, not business) days; a week?s value of $350.00, per Lot. On the beginning of the 16th business day, this fee increases to $100.00, per Lot; for 7 days (regular, not business); a week?s value of $700.00, per Lot. For example: Buyer wins 2 Lots at Apollo Auctions ending on a Wednesday. Buyer then has 10 business days (two weeks) to pay for both winning lots. On the beginning of the 11th business day, a Thursday, storage fees of $50.00 will be charged for each day (regular, not business) for 7 days. (example, Thursday day 1, Friday day 2, Saturday day 3, etc.) On the beginning of the 16th business day, also a Thursday, storage fees will be increased to $100.00 and charged for each day (regular, not business) for 7 days. (example, Thursday day 8, Friday day 9, Saturday day 10, etc.). In this example, the buyer has accumulated late fees of $1,050.00 for not paying/picking up artwork for 2 weeks after the due date (of 10 business days after the auction). If after 2 weeks from the due date of payment, (4 weeks after the auction has ended), if no contact and agreed upon resolution for payment occur, Apollo Auctions reserves the right to relist the winning lots, and charge the Buyer the accumulated late fees of $1,050.00 PLUS a 35% relisting fee of each of the winning lots. Relisting fee is 35% of the hammer price of each of the winning lots. Buyer is legally obligated to pay all fees incurred. 9. SHIPPING: Apollo Auctions has professional shippers on hand and will be glad to pack and ship your auction purchases for you. We ship via UPS and FEDEX, however can use DHL, or USPS upon Buyer?s request. The shipping charges are to be paid for by Buyer. Apollo Auctions will give out shipping quotes upon request. We will also not be responsible for any damage or loss that occurs if you choose a shipping method that we have advised against, and we will require a waiver from you acknowledging this. 10. TAXES. The Auction House will collect California sales tax on all Lots picked up from the Auction House's California premises or shipped to a California address. 11. Right to refuse sale: The Auction House reserves the right to refuse any sale due to unforeseen circumstances including, but not limited to: damage to an item, out of stock listing, misrepresented item, withdrawn consignment, or other such issues. In the event of a refused sale for which payment has already been received, a full refund will be issued equal to the purchase price of the given piece. 12. Withdrawal Prior to Sale: The Auction House reserves the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal. All starting bids and estimates are subject to change before the start of the auction.
