AUCTIONEERS NOTE: WARNING: These items were removed from the walls and shelves of Fuddruckers restaurants. Items were glued, screwed, nailed, and wired to walls, shelves, counters, etc. Removal was difficult. Buyer should assume that every item has damage of some type. Terms: Cash (In House Only), Check, Visa, or Master Card BUYERS PREMIUM: A 12% buyer's premium will be added to each purchase. MINIMUM BID: There is a $20.00 MINIMUM bid on every lot. If the minimum bid is not reached the auctioneer reserves the right to seek a lower bid from the floor at the live auction until the item is sold. SALES TAX: Sales tax will be collected at .0675% unless bidder is tax exempt and forwards on the blanket form of exemption. WARRANTY & CONDITION OF ITEMS SOLD: All items are sold "AS IS, WHERE IS, with NO warranty expressed or implied. This Auction is also being conducted live with preview on Saturday July 21st from 10:00 AM - 3:00 PM. We strongly urge that you preview these items personally. The majority of these items have been nailed or glued to the wall. Descriptions are believed to be accurate but not guaranteed correct. Each item is described as completely as is practical. Due to the involvement in the live and online auction by our staff we ask that any additional information you request on an item be handled prior to the auction date. If you are not certain of the condition of an item, please bid accordingly. You are bidding on the described item, not the photo. The possibility does exist that the photo attached to an item may inadvertently be incorrect. SHIPPING: Bidders are responsible for the removal of their merchandise. Any item NOT picked up or, shipping requested with-in 3 days after the close of the auction, will be considered abandoned. Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please insure that movers or anyone picking up items on your behalf, have your paid receipt at the pickup location. Packaging, shipping and extra insurance is extra and will be added to the price of the invoice. All packages shipped by the auction company will be insured for $50. A minimum charge for handling will be $10.00 with additional charges for large or bulky items. Our staff will not ship large, bulky, or fragile items. Any controversy or claim arising out of, or relating to, this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Brown County Ohio. Liability: Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price. The above-stated Conditions of Sale can be altered only in writing by The Auctioneer. All announcements made from the auction block by the auctioneer take precedence over any previous verbal or printed material.
