In these terms and conditions of sale, the words 'we,' 'us,' and 'our,' mean MØBLER | Home Décor, and 'you' and 'your' mean the bidder. All prospective bidders are required to register with us in advance of the sale. By doing so, you agree to be bound by these terms and conditions, which are the complete and only terms and conditions on which all lots are offered for sale. You agree that you have not relied on any guarantees, warranties, or representations, either express or implied, other than those made herein. In the event an item is lost or damaged while in our possession or otherwise unavailable, we reserve the right to cancel the sale and issue a full refund. We describe each lot to the best of our ability, including any damage we have found beyond age appropriate wear. If a condition report is available, it has been included in the description of the lot. Any statements made, whether orally or in writing, in the lot description or any condition report, are intended as statements of opinion only and are not to be relied upon as statements of fact. All lots are sold as is. No warranties or guarantees of any kind, either express or implied, are given, including, without limitation, as to the merchantability or fitness for any particular purpose of the items sold. All measurements are approximate. All available photos have been included. You are advised to examine the images closely, as they are part of the lot description, and inspect each lot before bidding to determine anything that may be of significance to you, including, without limitation, the lot's authenticity, quality, merchantability, fitness, value, condition, size, rarity, importance, provenance, historical relevance, authorship, and/or whether or not it has been repaired or restored. All sales are final. We do not accept returns or exchanges. However, if, within 14 calendar days after the purchase of any lot, you give us notice in writing that the lot was inaccurately described, demonstrate the same to our satisfaction, and return the lot to us in the same condition as when sold, then we will refund the full purchase price. All bids must be made online through the platform provided. We cannot accept telephone, Internet, or written absentee bids left with us prior to the sale. We have the right, in our absolute discretion, to determine the conduct of the sale, including, without limitation, to advance the bidding, to reject any bid, to withdraw any lot, to reoffer and resell any lot, and to resolve any dispute between bidders in connection with the sale. In any such case, our judgment is final and shall be binding upon all participants in the sale. A buyer's premium will be added to the successful bid price of each lot and is payable as part of the total purchase price. The amount of the buyer's premium is stated in the lot listing. By bidding at the auction, you assume personal responsibility to pay the purchase price bid, plus the buyer's premium and any additional charges that become due and payable in connection with the purchase of the property. Upon the fall of the auctioneer's hammer, you assume all risk of loss and damage to the property, in addition to any obligations, costs, and expenses relating to the handling, shipping, insurance, taxes, and export of the property. If you fail to comply with any applicable conditions contained herein, we may, in addition to other remedies available by law and without limitation, (a) hold you liable for the total purchase price, (b) retain any payment made by you, and/or (c) resell the lot at public auction without reserve or privately, and you will be liable for any deficiency in the purchase price, all costs and expenses, including without limitation handling and warehousing, the expenses of both sales, reasonable attorney's fees, commissions on both sales at regular rates, incidental and consequential damages, and all other charges due hereunder. In addition, upon default, you hereby grants to us a security interest in, and we may retain as collateral security for your obligations, any property in our possession owned by you. We shall have all of the rights afforded a secured party under provisions of the Uniform Commercial Code applicable in the State of Florida with respect to such property, and we may apply against such obligations all monies held or received by us for the account of, or due from us to, you. These terms and conditions of sale as well as your and our respective rights and obligations hereunder shall be governed by and construed and enforced in accordance with the laws of the State of Florida. By bidding at this auction by any means, you consent to the jurisdiction of the state courts of, and the federal courts sitting in, the State of Florida. If any provision of these terms and conditions of sale is held by any court to be invalid, illegal, or unenforceable, such provision shall be disregarded and the remaining terms and conditions of sale enforced in accordance with the original document and in accordance with applicable law. Under no circumstances in any sale will our liability to you exceed the purchase price actually paid.
