BIDDER RESPONSIBILITIES Bidder is responsible for any and all activity, bids, and purchases involving Bidder's account. Once a bid has been placed, it cannot be lowered or deleted. CONDITIONS Brandywine Valley Auctions has endeavored to accurately describe the items being sold, but all property offered for sale is strictly "as - is" "where - is" with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition/authenticity of each item. BIDDING When Absentee bidding, you may accept the current asking bid or enter a maximum bid value. Live real-time internet bidding does not allow a maximum bid to be entered, only the current asking bid may be accepted. Absentee bidding is available before a lot has come up. Once a lot has come up, live auctioneers bidding is available on the website and absentee bids can no longer be placed. While we try to handle and store items with great care,Brandywine Valley Auctions will have no liability for any loss or damage to an item after the hammer has fallen.Brandywine Valley Auctions is not liable for any damages incurred if assistance with loading is requested. Once an item(s) has been paid for, we will place item(s) together for DAKS Global Logistics, LLC. to come over and pick-up items for packing and shipping at their building. LOADING Loading will be handled by DAKS Global Logistics, LLC. once the items have been paid for. Until that time, the items will be stored accordingly based on how many lots were won by a specific bidder. STORAGE Unless prior arrangements are made, payment within 5 business days, or a $25 per lot per day storage fee will be charged. ABANDONED PROPERTY Unless prior arrangements have been made, any lot(s) remaining at the Brandywine Valley Auctions more than 90 calendar days after the auction purchase date will be considered abandoned and no refunds will be given. Brandywine Valley Auctions is not obligated to notify the winning bidder of the abandoned lot(s). DISPUTES Any and all disputes resulting or arising in connection with this auction shall be heard in the County Court of Common Pleas of Chester County, Pennsylvania as the sole and exclusive venue.
