The Auction Gallery of Florence, LLC Terms and Conditions of Sale Bidder Registration: All bidders must register their name, permanent street address, and phone number, prior to the auction. Registration requires two forms of ID to include a current valid government issued photo ID. Registering bidders will be issued a copy of our Terms and Conditions of Sale. Bidders are required to read, sign and date this document signifying that all Terms and Conditions of Sale have been agreed to, prior to receiving a bid card. ( Any assistance needed with this process will be provided by our staff.) Upon acceptance of a bid card, bidder is further signifying that all personal and contact information is valid as presented by you and that all winning bids placed are binding and contractual agreements with The Auction Gallery of Florence. On Site Bidding: A bidder card is held up to signify a bid. After a lot is identified, if a bidder wishes to bid, the card should be held up until the bid is won, or until the bidder's final limit has been exceeded. By leaving your card raised, the bidder ensures that their bid will be seen prior to the hammer. If the hammer drops prior to your bid being seen, the last bid taken before the hammer will be the prevailing bid. All buyers must inspect lots and find that they are to their satisfaction prior to bidding. By bidding on an item, the bidder is signifying that the item has been fully inspected to the satisfaction of the bidder and that the bidder is placing a bid with full knowledge of condition and description of item. No warranty or guarantees are expressed or implied as to the functionality of any firearm. Firearms should be inspected by a professional gunsmith before attempting to discharge. Descriptions of functionality are strictly based on appearance, and not on testing of the firearm. Once a bid has been made, the bidder is contractually bound to the purchase. All purchases must be paid for at the auction, unless prior arrangements have been made. Sealed Absentee Bids: If you are unable to attend the auction, you may submit a signed, sealed bid to our office and it must be received no later that 24 hours prior to the auction. Absentee bids must be accompanied by a 30% check deposit. Checks will be verified and processed prior to bid being carried out. If the absentee bid is unsuccessful, the funds will be released back into the bidder's account in full on the first business day following the auction. The Auction Gallery makes no guarantees concerning the rate at which funds will again be available to you from your bank. Full description of item condition is not guaranteed to be printed in online or catalog descriptions. Before placing your bid, we urge you to request a description of condition of any item or items you wish to bid on. Upon request, our staff will provide you with a condition report, to the best of our knowledge No warranty or guarantees are expressed or implied as to the functionality of any firearm. Once you have authorized us to place your bid, you are contractually bound to the purchase, if you have the prevailing bid. Full payment will be required within 72 hours of the auction. A check must either be mailed or brought to us, or a bank to bank wire received or scheduled within 72 hours of the auction. Telephone Bids: Bidding by telephone is available for pre-qualified buyers. A signed bid form, accompanied by a check for 30% of the bidders highest intended bid, must be received no later than 24 hours prior to the beginning of the sale. Checks will be verified and processed prior to bid being carried out. If the absentee bid is unsuccessful, the funds will be released back into the bidder's account in full on the first business day following the auction. The Auction Gallery makes no guarantees concerning the rate at which funds will again be available to you from your bank. Telephone bids are set on a first come first served basis. It is recommended that a sealed absentee bid also be placed in the case we are unable to contact you for any reason to carry out your bid via telephone. Once the telephone bid has been approved, a member of the auction staff will call the bidder approximately five minutes prior to the lot of interest being sold. If the telephone bid is the prevailing bid, full payment must be received per the approved bid agreement no later than 72 hours after the sale. By bidding online, you are accepting the terms and conditions stated herein and are bound to the same as if bidding in person. Please refer to "On Site Bidding" for terms and refer to all other information pertaining to fees, shipping, and acceptable funds, as they are applicable to online bidding as well. Fees: All purchases made online will be accompanied by a 15% buyers premium and will aldo include all state and local taxes which apply to the sale. (Shipping fees address separately.) All purchases made on-site at specialty auctions will be accompanied by a 10% buyers premium, and will also include all state and local taxes which apply to the sale. All shipping and handling charges, duty fees, and shipping insurance, if applicable, will be billed to the buyer in addition to the above noted fee and taxes. Shipping Terms: The Auction Gallery will have all items professionally packed to the extent we feel the item or items are extremely well protected. Insurance must be purchased for full value of item when shipping, unless otherwise stated in writing per request of the buyer. The Auction Gallery is not liable for any damage or loss incurred to the item or items while in postal transit. Items will not be shipped to a PO Box, unless no other possible address is available. Items shipped will be sent requesting signature verification from the buyer. The Auction Gallery is not responsible for fraudulent representation by anyone signing for the item or items. All items will be shipped within 10 business days of receiving cleared US funds. Item Pick Up: Items may be picked up by appointment from The Auction Gallery of Florence after US funds have cleared our bank. All items not removed from The Auction Gallery within 10 business days, will be subject to a storage fee to be determined by The Auction Gallery. Forms of Payment Accepted: For customers inside the US only: Payment methods include wire transfer (bank to bank only), approved bank draft, cashier's order, cash or check. All payments will be bank verified immediately. Anyone choosing to use wire transfer is requested to pre-register with us, by contacting us no later than 48 hours prior to sale. All information necessary for wire transfer will be provided at that time. For International Customers Only: Payment methods include wire transfers, bank to bank only, and must be received in US funds. We request that all international bidders pre-register with us, by contacting us no later than 48 hours prior to sale. All information necessary for wire transfer will be provided at that time. All purchases made by international customers, must have payment arrangements made within 72 hours of auction close. Items purchased by known clients of The Auction Gallery may be cleared for removal day of sale. Items purchased by new bidders will only be removed day of sale if paid for with cash, or approval has been made prior to sale for item removal. The Auction Gallery reserves the right to use it's discretions when approving items for removal prior to US funds clearing. Liability: The Auction Gallery of Florence warrants the accuracy of description of the general viewable condition of the items sold given day of sale, or given per request of "condition of item report" only. The Auction Gallery of Florence presents the rarity, condition, historical relevance, or provenance of any items sold, as such statements are provided to the Auction Gallery of Florence by the consignor(s). Any items being sold having signatures, handwriting, markings, or contents which have historical significance, have been photographed in detail and posted for the bidders' inspection. All items purchased based on significance of handwriting, signature, markings, or content, are available for physical inspection to all interested parties by private appointment prior to sale. Any bidder purchasing an item based on the significance of handwriting, signature, markings, or content, by bidding, is signifying that either prior inspection of the article has been made and has been found suitable for purchase as represented, and/or the buyer is satisfied with the provenance and detail stated day of sale to the best of the knowledge of the Auction Gallery and the consignor. The Auction Gallery staff has conducted basic historical research concerning all provenance provided, and posted published relevant information and links to give the buyers/bidders more insight as to the potential historical relevance of the item or items being sold, in an effort to assist the buyers in helping to further identify people, markings, handwritings, etc Information is posted to the best of our staff's knowledge and to the knowledge of the consignor(s). Information may change as it is found. Any further authenticity or verification provided for items by associates of the Auction Gallery of Florence, or our staff will be provided day of sale, and are viewed "in progress" only on our website. The Auction Gallery has presented such information to the best of our knowledge and is in no way liable for any historical research information found to be inaccurate. Buyers must make certain of what authentication, verification, or provenance details accompanies each specific item for sale. All accompanying information will be provided day of sale, or can be requested in writing prior to sale. Once a bid has been placed, the bidder/buyer is signifying that all information posted and expressed day of sale, or in a requested description report, or by means of personal physical inspection, meets their requirements for bid. All items are sold "as is" and "where is". All sales are final.
