By placing a bid at this Great Plains Gallery auction, which is conducted through LiveAuctioneers LLC / Ebay Live Auctions, you agree to abide by the following terms & conditions of sale:

1. A 12.5% Buyer's Premium is assessed on winning bids & is considered part of the purchase price.

2.Payment is expected from the winning bidder within 7 days of auction closing. All accounts are payable to Great Plains Gallery. Payment must be made in US funds. Items will not be released until we have received full payment. Great Plains Gallery reserves the right to rescind a transaction and cancel the sale if payment is not received within 7 days of the auction closing.
3. We will do our best to answer all questions sent to us by email or by phone until August 8, 2003 5:00 p.m. central time. All other questions given after that time probably cannot be answered.
4. Phone Bids and Absentee Bids: We can arrange these types of bids until August 8, 2003 5:00 p.m. central time.
5. Acceptable forms of payment for winning Internet bids are Visa, MasterCard, U.S. money orders and personal checks drawn on U.S. banks. If a personal check is submitted as payment, Great Plains Gallery reserves the right to delay sending the product until the check has cleared the bank.
6. Great Plains Gallery may, in its discretion and at a purchaser’s request, package and ship items as directed by purchaser. In such event, purchaser agrees that (a) all such packaging, handling and shipping is at the sole risk of the purchaser and that Great Plains Gallery shall have no liability for any loss or damage to such items, and (b) purchaser shall pay in advance, all packaging expenses, including labor, materials and postage and carrier fees, and all insurance charges.Handling, shipping & insurance costs are in addition to the purchase price. Rush orders will be charged an additional 15% buyer’s commission. Most items are packed and shipped by Great Plains Gallery. Items deemed by Great Plains Gallery to be excessively fragile or of high value will be handled by Fine Arts shipper Artworks of Kansas City (816.421.1223). ALL FURNITURE WILL BE COMPLETELY HANDLED BY AN OUTSIDE SHIPPER. Great Plains will only handle the transfer of furniture items to the agent. All o!
ther matters will be conducted between buyer and shipping agent.
7. Great Plains Gallery makes every effort to accurately represent items that it sells at auction, including size, age, restoration & authenticity. If a lot is found to be materially different than that which was described in the catalog (through the opinion of two or more recognized experts in the appropriate field) Great Plains Gallery will refund (at its own discretion) the total purchase price upon return receipt of the lot in its original condition. The lot must be returned to Great Plains Gallery Auctioneers with prior approval of the firm within 7 days of its original receipt by the winning bidder. In no event will the liability of Great Plains Gallery to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.

8. Photographs of lots on the web may have had size modifications or may have been trimmed to exclude framing, matting, and wide blank margins for display purposes.

9. Estimated selling prices are for your guidance only. Actual selling prices may be higher or lower than the estimated values.

10. All bidding is done in a competitive manner. The winning bid will always be one bidding increment over the second highest bid.

11. Some of the lots offered in a sale may be offered subject to a "reserve," unless the auction is specifically advertised as "unreserved." The reserve is a confidential price between the consignor and Great Plains Gallery below which the item will not be sold. In most cases the reserve will be set at a price well below the estimated value of a piece and is designed to offer the consignor some level of security. The reserve is never set higher than the estimated value of an item.

12. Great Plains Gallery reserves the right to reject any bid without stating a reason, and reserves the right to withdraw any item from the sale at any time without stating a reason.

13. Great Plains Gallery shall determine who is the successful high bidder and in the case of a disputed bid, shall have the sole discretion of withdrawing the lot for sale or re-opening the bidding on that lot. In the event of duplicate high bids, the earliest bid received will be the winner.


14. In no event will Great Plains Gallery liability to a buyer exceed the actual purchase price of a lot, plus shipping expenses.
