The conditions set forth below constitute the terms and conditions on which all property is offered for sale. Bidding at auction, whether online, or by absentee bid, the buyer agrees to be bound by these terms. 15% (Fifteen Percent) buyer's premium will be added to the hammer price of each lot. Catalogs and brochures are descriptive guides only, in which we have tried to provide the best information possible, but their accuracy cannot be guaranteed or warranted. Auctioneer will not be liable for any errors or omissions. All items are sold as is, where is, with all faults. There are no warranties or representations of merchantability, of fitness, nor of any other kind, express or implied. All items are available for your examination prior to bidding. Your bidding will signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. All measurements are approximate. Bidders acknowledge that all lots were available for inspection prior to the auction and that they relied solely on their own inspection of the lots and not on any information listed in the catalog or otherwise provided by the Auctioneer, the auction staff or Seller. Some items offered may be subject to reserve, which is the confidential minimum price below which such lot will not be sold. Our goal is to provide prospective bidders with accurate and detailed information. We recommend prospective bidders examine all items in which they have an interest. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you not bid on the item in question. We do not give refunds. All sales are final.
We accept absentee bids by phone, by mail, in person at the previews, via the Internet and by fax. Absentee bids are requested by no later than 9 AM on March 13th. Absentee bidding other than when placed online is a convenience offered to our customers and, while we will make every effort to execute your instructions, the Auction House is not liable or responsible for any errors or failure to do so. Auctioneer and the Auction Staff are not responsible for any failure to execute absentee bids of any type when failure is caused by human error, electronic or technical failure of any kind. If you place absentee bids with the Auction House, please follow the listed bid increments in the catalog, since we cannot accept cut bids or other increments.
Acceptable forms of payment include cash PAYPAL (payable to: info@oldhatauctions.com), and approved checks or wire transfers. Credit cards will only be accepted via the internet through PayPal, and with a verified address. The auction house reserves the right to hold property until checks clear. There will be a $50.00 charge to Buyer for a check dishonored by a bank for any reason.
Shipping and Pick up: Nothing in a lot may be moved from its location prior to being paid for by Buyer and Buyer must present a paid receipt. All lots must be removed from the auction site by March 30th. Shipping Arrangements for any item purchased through the internet on EbayLiveAuctions.com, by phone, live bid, or absentee bid, must be made within 10 (ten) business days. Any lot not removed from the site within this time will be deemed abandoned and be promptly disposed of or resold for Auctioneer’s account. In the event that the buyer of any lot fails to pay the purchase price thereof when due, the Gallery shall have the option, at its sole discretion, to (a) enforce payment by civil action or other proceedings against the buyer; (b) to void the sale as if said sale had not occurred; or (c) to exercise any other remedy or remedies available under the law, including but not limited to a second sale of said item, including the subsequent enforcement of any deficiency against the initial buyer. The Auction House reserves the right to require that advance bids received either by mail or by means of telecommunications including email be accompanied by a 25% deposit. All items forwarded to a shipper / handled will be at the purchaser’s risk. Shipping will be handled by a professional Shipping Company of Buyer’s Choice. Also available are DHL, FedEX Freight, or www.plyconvanlines.com. All shipping costs are the sole responsibility of the buyer. Buyer will pay actual shipping, packing and insurance costs as charged by the professional company of his/her choice. Buyer should request a shipping quote prior to bidding.
8.25%. Sales tax will be added to the purchase price of all purchases made by Texas Residents. A current sales tax resale certificate, including sales tax exemption number, must be presented to avoid paying sales tax.
