These Bidder Terms & Conditions constitute the terms and conditions on which items in this sale will be offered by Quiquam, and/or on behalf of any consignor. By submitting your bid, you are agreeing to all of the Terms and Conditions. You agree to pay a buyer's premium of 15% and a 3% fee for payment processing. You agree your bid constitutes a legally binding contract. Bidder approval is at the sole discretion of Quiquam. All lots are sold as is and where is. Please review the condition statement in the description and all pictures posted on this lot. Attributions are an opinion only. Clothing may need to be cleaned and may have been in contact with allergens including cigarette smoke, dogs, cats, other pets, etc. From storage, clothing may have a musty odor. All measurements given are approximate and within industry standards and customs. No statement regarding age, condition, kind, value, or quality of a lot, whether in writing in this catalog or elsewhere, shall be construed to be an express or implied warranty, representation, or assumption of liability. Quiquam attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. By placing a bid you signify that you had the opportunity to ask questions and receive answers from Quiquam that you deem adequate. If you require absolute certainty in all areas of authenticity, or condition and the results of your evaluation leave uncertainty in your mind, do not bid on the lot in question. The terms Estimate or Estimated Value may be an arbitrary value and may not represent an actual resale value, insurance replacement value, or cost of a similar good. In no event shall Quiquam have any liability, exceeding the actual purchase price paid by Buyer, for any breach, or act of omission. Some lots may be subject to a reserve price. Reserve prices are always the confidential information of Quiquam and are not disclosed to bidders. All sales are final. Quiquam does not give refunds based on condition. These terms and conditions, as well as the respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Virginia. The purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the Commonwealth of Virginia. Payment Terms & Conditions: Invoices will be sent via Live Auctioneers to Buyers within 3 business days of auction end. A Buyer's premium of 15% will be added to the hammer price. A 3% fee will be added for payment processing. Payment in full for lots and shipping must be made by the successful bidder within 3 days of receipt of invoice. We accept MasterCard, Visa, Discover and debit card payments thru PayPal. You do not need a PayPal account to pay with credit or debit cards. We do not accept checks. All invoices must be paid within three (3) calendar days from receipt of invoice unless other payment arrangements are made at least 48 hours in advance of auction start. Ten days from invoicing, if no payment has been received, Quiquam will enter a dispute in Live Auctioneers and block the bidder from participation in future auction events. Once the payment is received, the dispute will be resolved on Live Auctioneers. If Buyer fails to pay by the thirtieth (30th) day after invoicing, lots are considered abandoned and Buyer forfeits all purchased lots. In the case of nonpayment, Buyer acknowledges and agrees that he/she shall have no right, title, or interest in and to any property in which Buyer was the highest bidder. Sales Tax: Virginia sales tax will be added to invoices for all Buyers with a Virginia shipping address unless Buyer has provided Quiquam with a current Virginia resale certificate prior to the auction. If a resale certificate is not provided 6% sales tax, or the current rate, will be charged. SHIPPING Terms & Conditions: Quiquam does provide packing and shipping services for most items. If you wish to make other shipping arrangements please notify Quiquam within 48 hours of auction end, otherwise Quiquam will ship your lots. If you do not see a shipping cost on your invoice you will need to make other shipping arrangements. As a courtesy we can provide you with a list of shippers or you can select a shipper of your choice. Winning bidders are responsible for all costs to ship their lots, including insurance for the value of the shipment. Shipping fees include the cost of shipping and insurance, signature confirmation where applicable, plus a $5.00 per lot packing fee. Where possible we use recycled material, which helps us to keep your costs down. At our discretion we may combine lots if we think the items will travel safely. Packing and shipping of auction lots is done in the order payment is received and may take up to seven business days after payment is received. Quiquam will ship lots to the Buyer at the Buyer's PayPal or Live Auctioneers registered address only, via our choice of either UPS, FedEx, or USPS. Insurance is included in shipping. On boxes valued over $200 (hammer price), a signature will be required. On boxes under $200 (hammer price), no signature will be required unless requested by BUYER. Quiquam can ship to international Buyers, however, in accordance with the law, Quiquam will declare the package value at hammer price and cannot declare lesser values for any international purchases. All international Buyers are responsible for knowing their country's laws on import, customs, and duties. All duties and tariffs are the responsibility of the Buyer. Quiquam does not ship furniture and other large items. If you do not see shipping on your invoice you will need to make other shipping arrangements. As a courtesy we can provide you with a list of shippers or you can select a shipper of your choice.. A Release document must be signed and returned before items are released to the shipper. This transaction is strictly between the Buyer and the shipper. Quiquam has no liability. If Buyer makes their own shipping arrangements lots must be removed by shipper within 14 days of auction end. After 14 days, unless arrangements with Quiquam are made in advance, a $10 per week, per lot, storage fee will be added to auction lots. Any lots not removed within 45 days of the sale date will be considered abandoned and forfeited by Buyer regardless of payment status.
