The following, as amended by any posted notices or announcements during the sale, constitutes the entire terms and conditions on which property listed in the catalog shall be offered for sale or sold by REGAL AUCTION GALLERIES. PLEASE READ THIS ENTIRE AGREEMENT. Terms and Conditions of Sale Please be informed that by placing a bid, you are entering into a legally binding contract with Regal Auction Galleries. If you are the successful winning bidder, you shall have a legal agreement to purchase the property bid from the seller. Place a bid only if you are serious and determined about purchasing the item. Any inquiries before bidding should be resolved by contacting Regal Auction Galleries. Regal Auction Galleries reserves the right to withdraw or combine any lots listed in the catalog at any time with no liability. The successful bidder is the highest bidder acknowledged by the auctioneer. Regal Auction Galleries and its auctioneers will have final discretion in determining the successful bidder and in resolving any dispute between bidders. In the event that any dispute arises after the sale, Regal Auction Galleries? sale record shall be conclusive. Successful bidders must pay for the entire invoice before any items are removed or shipped from our gallery. All items must be paid for and removed within TWO (2) BUSINESS DAYS from the date of auction. Buyer?s Premium Each lot sold at the auction is subject to a 20% buyer?s premium, in addition to the hammer price for each lot. All purchases in California are subject to California sales tax rate of 9.50% unless the purchaser has a valid tax exemption number that will be applied to the Invoice. Payment Payments for winning bids may be completed through PayPal, Live.Payments, credit card, or wire transfers. The winner of any lot will automatically be charged on the credit card on file with Live Auctioneers if no payment is made within 72 hours of winning a lot. No merchandise shall be given out prior to the end of the entire auction session. Regal Auction Galleries reserves the right to hold any purchase until all funds are cleared and received in our bank. Shipping, Handling, and Insurance Regal Auction Galleries provides handling, packaging, and shipping services merely as a convenience for our bidders. Regal Auction Galleries includes an ESTIMATED AMOUNT in the auction invoice after the sale. If an item is to be shipped, it is sent to our USPS, UPS, or FEDEX store location after the first three (3) business days. All US domestic shipments are insured at the total bid amount contained in the shipment (other add-on charges are not covered by insurance). We pay for insurance services at our own expense as a security for both our bidders and Regal Auction Galleries. Additionally, we require a direct signature from the bidder once the merchandise is received. Large, heavy, fragile or otherwise unusual items will acquire additional charges. We mainly use USPS Priority Mail Shipping on domestic shipments, which may take seven (7) to ten (10) business days. Under special circumstances, Regal Auction Galleries may ship items using UPS or FedEx Express Mail, private carriers or pack and ship enterprises, the cost of which shall be charged to the bidder. Regal Auction Galleries will not use lower classes of mail to ship sold merchandise due to increased risk of loss. Special shipping and handling requests may be accommodated on a limited basis at Regal Auction Galleries? sole discretion and may acquire additional handling charges. All costs charged to a bidder's original invoice are estimates and Regal Auction Galleries reserves the right to charge additional amounts if such estimates are exceeded. By acknowledging this agreement, the buyer agrees to any additional charges as it may be necessary to accommodate special shipping and handling requests. Shipping and handling charges to Hawaii, Alaska, US Territories, and foreign countries are higher and often require registry or express mail. The shipping carriers may also limit insurance coverage to foreign locations. Regal Auction Galleries will ship items to foreign locations using the same classes of mail and additional postal services that it uses to ship to US locations, to the extent that such services are available. Please be advised that insurance coverage may be limited or unavailable for those locations. To the extent, foreign bidders are aware of the alternative shipping arrangements, which may be desired to increase insurance coverage. We advise them to notify Regal Auction Galleries of such options. Regal Auction Galleries shall not be liable for any shortfall of insurance either on foreign shipments or on the non-coverage of additional invoice charges exceeding bid amounts. Jewelry Appraisal All jewelry items sold by Regal Auction Galleries are evaluated by third party appraisal firms where certified appraisers evaluate the weight, size, and grade of gemstone and/or metal to determine the replacement value of the item. Please be advised that all appraisals are done for insurance purposes only and do not determine the actual value of the jewelry on auction. The appraisals are done for the sole purpose of protecting the buyer in the event of damage or loss of purchased merchandise from Regal Auction Galleries. Regal Auction Galleries is not responsible for the opinions and appraisals of any third-party appraisal firms. GIA certificates are available upon request for gold pieces such as 14K, 18K, diamonds, etc (does NOT apply to .925 Sterling Silver pieces). Returns All property is sold AS IS, WHERE IS, with all faults, and ALL SALES ARE FINAL. Returns may only be made with written authorization of Regal Auction Galleries, in our sole discretion. To request a return, you must provide a written request fully explaining the basis for the return no later than three (3) days after your receipt of the lot. Under no circumstances will any amounts other than the winning bid amount be refunded. A restocking fee of 20% of the full invoice amount may apply. All authorized returns must be received in exactly the same condition as when originally shipped to the buyer, or they will be returned to the buyer at their own expense. Any unauthorized returns will be refused. Refusal to accept merchandise delivered by Regal Auction Galleries to the bidder constitutes an unauthorized return in direct violation of these general Terms and Conditions. Liability and Disclaimer Regal Auction Galleries and its consignors disclaim any warranties, express or implied, including but not limited to the Implied Warranty of Merchantability or Fitness for any particular purpose. No warranties are made that the property offered for sale is what it is described to be by the auctioneer or the catalog. Neither Regal Auction Galleries, nor its consignors will be held responsible for any descriptions of the rarity, quality, condition, size, importance, or provenance of the property. While Regal Auction Galleries? representatives, to the best of their ability, describe the items for sale, any statement, whether oral or written, by the auctioneer or by any Regal Auction Galleries representative are mere opinions and shall not be deemed a warranty or representation regarding the property offered for sale. The bidder is responsible for determining the age, size, condition, and value of the property before bidding. By placing a bid, you signify that you have examined the property to your satisfaction or have chosen not to examine it. If Regal Auction Galleries is prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, its liability shall be limited to the purchase price of the property as paid by the purchaser.
