All property offered and sold through The Atkinson Collection shall be offered and sold on the terms and conditions set forth below which constitutes the complete statement of the terms and conditions on which all property is offered for sale. By bidding at the auction, the buyer agrees to be bound by these terms and conditions.
1.Unless otherwise indicated, all Property will be offered by The Atkinson Collection as an agent for the Consignor.
2. The Atkinson Collection reserves the right to vary the terms of sale and any such variance shall become part of these Conditions of Sale.
3. All bidders are encouraged to view images of Property carefully to understand fully what it is they are bidding on and purchasing.
4. All bidders are encouraged to email The Atkinson Collection at info@theatkinsoncollection.com with any questions or concerns they have about Property before placing bids.
5. Bidders, bidding on Property without contacting The Atkinson Collection with questions or concerns will be assumed to be bidding with full and complete knowledge of the Property in which they are bidding on.
6. The Atkinson Collection in its sole and exclusive discretion, reserves the right to withdraw any Property, at any time, before the fall of the hammer.
7. The highest bidder acknowledged by The Atkinson Collection shall be the buyer.
8. Property shall be paid for by the buyer within five (5) days of sale. The Atkinson Collection reserves the right to impose and the bidder agrees to pay a late charge equal to 5% of total invoice plus a standard $50 per lot storage fee on the next day after invoice due date. Bidder will be sent an invoice showing these charges. Both invoices must be paid in full to receive items.
9. Buyer's that have not paid in full, their total auction invoice(s), including Hammer Fees, Buyer's Premiums, Shipping Fees and (if applicable) any earned late/storage fees within ten (10) days after the end of sale understand that they forfeit the Property back to The Atkinson Collection and have no further claim to property or moneys paid. As property will be considered abandoned. On the eleventh (11th) day after the close of auction all lot winners with unpaid invoices will have a dispute filed against them. Disputes will not be retracted until all invoices are paid in full. If property is still available, winning bidders will receive the item won. If item is no longer available, winning bidders will recieve a credit equal to the hammer price of won lots, redeemable online at www.theatkinsoncollection.com. This credit will only be redeemable 30 days after being issued.
10. All Property offered and sold in auction has been thoroughly inspected and evaluated by The Atkinson Collection's team of experts as well as our third party appraisers.
11. All valuations are a recommendation based on our team of experts and third party appraisers and should not be considered when bidding on Property.
12. All Property descriptions and valuations are provided as a courtesy by The Atkinson Collection, its team of experts and third party appraisers and are based on career experience, previous sales and artists, manufacturers and cosigners provided descriptions. Items listed as Estate or have a Provenance listed as Private Collector come with no guarantees of authenticity and/or quality of items including gemstones.
13. In no event shall any liability of The Atkinson Collection to the buyer exceed the Hammer Price paid by the buyer.
14. To provide for the safest shipping of Property. Some artwork, at the sole discretion of The Atkinson Collection will be shipped without any framing. Artwork will be professionally removed from framing and shipped rolled. This is to provide minimum stress to the artwork during transport and is meant to help ensure all pieces arrive safely and undamaged.
15. Bidders and buyers understand that they are bidding on and purchasing only the artwork and not the framing.
16. All buyers understand that they are bidding and purchasing Property that have been described as accurately as possible and photographed as a convenience to the buyer. All bidders and buyers further understand that all property is purchased as-is and all sales are final.
