Super Auctions Terms and Conditions for the Live Onsite and Online Auction being conducted on October 17 & October 18, 2009. This Auction is being conducted under Section 535 of the Penal Code and Section 2325 of the Commercial Code of the Laws and Acts of Auctioneering. Announcements made the day of auction will take precedence over any previous communication. 1) A 15% Buyer's Premium will be added to the final high bid price for each item purchased Live Onsite. An 18% Buyer's Premium will be added to the final high bid price for each item purchased online via LiveAuctioneers. 2) Applicable State, County and Local Sales Tax will be added to all items purchased. It is required by the state to charge sales tax on the Buyer's Premium and the Buyer's Premium is part of the total purchase price. The current Sales Tax Rate for LA County is 9.750%. All residents of CA are responsible to pay the current sales tax rates unless a valid resale permit and exemption form is submitted to Super Auctions prior to or at the time of registration. If your items purchased will be shipped out of state by a freight forwarder you will be exempt from paying sales tax only when a valid bill of lading is submitted to Super Auctions. 3) Payment is Due In Full each day of the auction for all Live Onsite purchases made. Payment is Due In Full within 24 hours of receiving your invoice billing notice to your email address on file for all purchases made Online via LiveAuctioneers. Acceptable Forms of Payment are American Express, Cash, Discover, Master Card, PayPal and Visa. 4) It is the sole responsibility of the purchaser to remove their items purchased from the auction location, each day of the auction up to 10:00 PM and only upon Payment being made in Full, unless alternate removal arrangements have been made. For those who have prearranged shipping arrangements with Super Auctions, your items will be shipped within 7 business days after full payment has been received by Super Auctions. For all items that are not Paid in Full by the requirements stated above, you will be charged a $25.00 storage fee per item, per day. If you have paid your invoice in full and have prearranged pick up and removal of your items, if you fail to remove your purchases within the time frame arranged, you will be charged a $25.00 storage fee per item, per day. 5) Please be aware that for oversized items which cannot be by shipped by regular means, you may utilize a freight forwarder of your own choosing; however, all freight forwarders must provide to Super Auctions proof of liability insurance prior to any removal or packaging work that they may do at the auction site. If you require assistance with freight forwarding arrangements, you may contact James Schneider directly at (714) 345-9532 and he will assist you with your freight requirements. 6) Super Auctions make no warranty as to accuracy of the item descriptions or to the condition of the items being sold and shall both, as one in the same, not be held liable for any defects, description or condition of the items being sold. The item descriptions and photographs are only being provided as guidance for you. Public Preview and Inspection of all items will be held on Friday, October 16 between the hours of 11:00 AM and 7:00 PM; as well as, the morning of each auction date between the hours of 9:00 AM and 11:00 AM. It is the buyer's sole responsibility to inspect all items being offered for the auction sale and you are encouraged to attend one of the auction preview dates listed above in order to view and inspect your items of interest. All items will be sold As Is, Where Is with No Warranties, No Guarantees and Without Recourse. 7) There will be No Returns or Exchanges for items purchased that you may not be fully satisfied with. There will be No Exceptions to these terms of the auction sale. Super Auctions shall not be held responsible by buyer for any visual, written or spoken discrepancies in color or in the size or measurement of the items. Colors may slightly differ due to photographic reproductions. 8) Due to production requirements, there may be multiples of any given item that may have been used in the making of the referenced film or television shows. Super Auctions makes no claims regarding the condition of the items listed in the auction catalog, either Live Onsite or Online. Please Do Not use your items purchased for any functional use as Super Auctions does not guarantee any items being sold at this auction sale. Bidder hereby understands and agrees that bidder assumes all risks of loss, damage or injury; whether personally, by others or damage to personal property arising from the use of items being sold and purchased at this auction sale. Furthermore, bidder hereby releases Super Auctions from any and all such damage, loss or injury incurred. 9) If a dispute arises between two or more bidders, it will be at the sole and absolute discretion of the Auctioneer to reopen the bidding between the two bidders in dispute and/or to cancel that sale and reopen the bidding to the public. In the event of a tie bid between a Live Onsite Floor Bidder and an Online Bidder, the bidding offer received by the Live Onsite Floor Bidder will take precedence and the Auctioneer's decision will be binding and final. 10) The Auctioneer and Auction Clerk will keep a written record of each item sold and their written records will absolute and final in any and all disputes. Super Auctions will not be responsible or held liable for any error in or failure to execute a successful bid or sale for any and all items in the above referenced auction. 11) Shipping that has been arranged for smaller items may take up to 3 weeks from the date payment is received in full to be received by you. Please contact our office directly if you would like to receive Expedited Shipping of your purchases. An additional fee for expedited shipping will be incurred. Standard Shipping and Handling to the Continental U.S. will be offered either through the United States Postal Service, United Parcel Service or Federal Express. Please advise of us of your smaller item shipping preference in advance of submitting your payment to us so that we may bill your shipping costs accordingly. Please contact us directly for International Shipping Rates, Rates to Alaska, Hawaii or Puerto Rico. 12) If you elect to bid on an item, you will be held responsible for the final cost of the item including all related shipping fees and insurance. All items being shipped International are subject to additional duties, taxes and fees, which will be billed directly to you. We will not claim a lower value on a lot in order to avoid Customs charges on International Shipments to you. 13) Articles of Clothing and Electronics may no longer be shipped to Mexico due to current revisions in Customs Regulations. 14) Bidding in this auction, whether in person or online indicates that you have Read, Agree To and that you will Abide by all of Terms & Conditions which apply hereto. 15) You as the auction buyer ('Bidder') hereby accept all Terms and Conditions for this auction sale and acknowledge and agree that you have read, understand and agree to all of the Terms & Conditions in order to take part in this auction sale, to be able to register as a Bidder either Live Onsite or Online in order to submit your offers ('Bids') to purchase your item(s) of interest in the above referenced auction. ©Super Auctions 2009 Auction Terms and Conditions
