Payment We will accept payments onsite (Dublin) Tuesday, May 12th until approximately 1 hour after the conclusion of the auction. Payments will also be accepted until 12:00 noon, Wednesday May 13th at the Dublin location. After that, payments will ONLY be accepted at Clars Auction Gallery, located at 5644 Telegraph Ave., Oakland, business hours 9a.m. - 5pm. You must have made payment and have a receipt in hand to pick up your property at the Dublin location. Pickup Items will be available for pickup at the conclusion of the auction, Tuesday May 13th until 1 hour after the conclusion of the auciton, and Wednesday and Thursday May 14-15 from 10 a.m. to 4 p.m. All property much be paid for and removed by Tuesday May 15th, 2009 or it will be forfeited, no exceptions and no refunds! Risk of Loss In the event delivery cannot be made because of loss due to fire, theft, or any other reason, Clars Auction Gallery shall only be liable for the returns of deposits or payments made by the purchaser No Warranty All items are sold "as is". Clars Auction Gallery, and The Trustee and Creditors do not warrant any lot to be merchantable or to be suited for any purpose and they do not assume any risk, liability or responsibility for any description in auction catalogs or made by any person as to the authenticity, genuineness, source, origin, purpose, functionality or measurements of any lot.

Sales tax of 9.75% will be collected on all purchases picked up or delivered within the state of California. Those holding a valid California State Resale License must present a valid resale number.

Clars Auction Gallery offers online bidding as a convenience for clients and is not responsible for any inadvertent failure to execute bids, or for any error in the execution of bids.

Items offered are part of a live auction at Clars Auction Gallery. Items are offered in numerical order and are auctioned at a pace of approximately 100 lots per hour. p Absentee bids left with LiveAuctioneers are not the same as bids left with the auction house directly. They are executed from a proxy computer terminal in the room against other Internet bidders. Other competitive bids include bidders on the telephone, in the room, and left bids with the auctioneer. LiveAuctioneers does not provide the ability for auction houses to incorporate left bids from the Internet with those left directly with the auction staff. p In the event of a tie bid, the auctioneer has sole discretion to award the lot to the high bidder of his or her choosing.

It is the responsibility of the prospective buyer to inquire as to the condition of a specific lot before bidding. Any condition statement is given as a courtesy to a client, is only an opinion and should not be treated as a statement of fact. Clars Auction Gallery shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. Please review all of the information and photographs before requesting additional information. Additional condition reports are available on request and we will respond as quickly as possible. You are advised to make your requests well in advance of the sale in order to receive the information in a timely manner. All condition report requests must be made via email to onlineclars.com.
