Bidding at auction, whether present, by absentee bid or online, the buyer agrees to be bound by these terms: Your bid is a contract. It is the responsibility of the buyer to obtain all possible information on interested lot prior to bidding. It is highly encouraged that bidders contact Carbone & Sons for more detailed photos, description, condition and weight, if needed. Prospective bidders should consult the bid increment scale to ensure their bids conform to our printed bidding increments. Carbone & Sons are not responsible for incorrect bidding. Please note: There are a few reserve bids in the sale. (A reserve means that there is a minimum price that the bidding must reach to sell.) Should there be any dispute after the sale, the record of final sale shall be conclusive. All sales are final. If the top bidder defaults on any lot, the backup bidder would be given the option to purchase the lot at their last recorded bid. If you are not completely satisfied with an item before you bid, please DO NOT BID. Detailed condition reports are not included in this catalog. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. All items shipped in-house will require insurance and items such as jewelry and silver will require a signature. Carbone & Sons will not ship paintings, china pieces or sets of china or glass as those items require special packaging. Please be patient as shipping quotes can take several days to obtain. As a Buyer, you will be invoiced a separate shipping and 3% processing charge for credit cards once you have paid for your purchases. Delivery: Carbone & Sons will deliver within 200 miles of Brooklyn, CT. Please call our office or email us for estimated delivery cost. Delivery based on number of items, weight of items, trucking fee and mileage. And again, buyer must pay for all items before delivery, not at time of delivery. Delivery fee must be paid for in full by or on day of delivery. Invoices must be PAID IN FULL, before items can be released to Buyer, or Buyers representative or to a shipper. Carbone & Sons reserves the right to hold merchandise purchased until your funds have cleared. All merchandise must be removed from the auction premises within 30 days or by Saturday, July 24th, 2021. Carbone & Sons will have no liability for any damage to property left on its premises after July 24th, 2021. On July 25, 2021, f the personal property is not picked up, Carbone & Sons has the right to retain ownership of the items and to liquify the items in a future auction due to breach of contract. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Carbone & Sons may exercise all of its rights and remedies under the law. A 25% buyers premium will be added to the hammer price of each lot sold through Liveauctioneers in our ONLINE sales. Buyers are required to pay sales tax on the total sales price, including the buyer's premium as well as a 3% credit card processing fee. All purchases are subject to the Connecticut Tax of 6.35% as applicable, unless the purchaser possesses a Tax Exemption Number that shows they are a reseller of the type of goods purchased. All invoices must be paid in full before any items are released, no partial payments on select items allowed. Please note: if you pick up your item at our location in Connecticut, and you are a CT dealer, you must have a copy of your CT resale number, and you will be required to sign a CT State Sales Tax Exemption Form, if not already on file. All bidders must email (carbone.sons@gmail.com) regarding their chosen shipper as well as an authorization for release of those items to chosen shipper. The purchaser must pay the shipper in advance for all packaging expenses, including labor, materials, postage, and, if applicable, insurance fees. If the property purchased is subject to laws governing export from U.S. or laws restricting imports into foreign countries, the granting of licensing for export and/or import of such goods is the responsibility of the buyer. Again, pick up times for shippers are by appointment only. Please be aware that framed works of art are costly to pack/ship, it is not uncommon for the price of packing/shipping to exceed the purchase price. Returns will NOT be accepted as a result of packing/shipping costs. We will not be held responsible for choosing a shipper in the event of any act and/or omissions in packing. We do not assume responsibility for damages. Regardless of shipping method, Carbone & Sons must have received cleared funds to release the personal property. If a loss or damage should occur during shipment, it is incumbent upon the buyer to file for recovery of any losses incurred. Under no circumstances can the claim exceed the hammer price (not including the buyer's premium). PLEASE NOTE: Shippers refuse to acknowledge the buyers premium as a requisite part of the sale amount.
