All property offered and sold through FORELAND ARTS LLC shall be offered and sold on the terms and conditions set forth below. By bidding at the auction, whether present in person or by agent, by absentee bid, telephone, internet or other means, the buyer agrees to be bound by these terms and conditions. BEFORE THE SALE Please note that all lots are sold subject to our conditions of Business for Buyers. Condition reports and detail images in nature light are encouraged to inspect the property at the pre-sale review. The auctioneer group endeavors to provide the bidder details as much as he or she can. Not with standing the report or any discussions concerning condition of a lot, all lots are offered and sold "AS IS" in accordance with the actual item. We urge you to consult with a restorer or conservator of your choice who will be better able to provide a detailed, professional report. The absence of reference to the condition of a lot in the catalogue description does not imply that the lot is free from faults or imperfections. Pre-sale estimate are intended as a guide for prospective buyers. Any bid between the high and low estimate would, offer a chance of success. However, all lots can realize prices above or below the pre-sale estimates.The estimates displayed in web or printed in the catalogue do not include the buyer's premium. BIDDING IN THE SALE Bid should be placed in USD. Absentee bid form prospective buyer should be submit at least 48 hrs before the sale, proof of identity might be required. AFTER THE SALE Payment (Auction results are usually available on the next business day.) The successful bidders should pay the final amount that will include the hammer price and the corresponding buyer premium after the auction. For all purchases, a buyer's premium will be add to the hammer price and is payable by the buyer as part of the total purchase price. This is a fixed amount unless further agreement provide by auctioneer. The buyer's premium is 25% of hammer price up to and including US$10000; 22% of any amount in excess of US$10001 up to and including $20000; 20% of any amount excess of $20001. The buyer should pay in full to the company within seven working days from the auction (inclusive the date of the auction if in workday). All purchases are subject to the Texas sales tax (currently 7%) unless the purchaser possesses a Texas sales tax exemption or resale number and registers that number with the company or has purchases shipped out of state. If the client cancellation his or her bid after sale, a cancellation compensation is requested. The company reserves the right to refuse payment from the source other than buyers. Payment is due in US Dollars, please consult auctioneer if payment is to be made in other currencies. Payment may be made by the following methods: Wire Transfer, PayPal, Bank Cheque or Cash etc. Foreland Arts reserves the right to hold the purchases until the cheque has been clear. Please note that transaction fee happens during the payment including but not limited to 4.99% commission charged by PayPal, $25 charged by local banks shall bear by clients. Please accurately refer relative Lot Number and Invoice Number at the memo of payment. For mainland China Bidders, we accept the payment in RMB for your convenience. The process of payment should follow Foreland Arts' instruction. Buyers should consult and decide the payment method to process transaction. FORELAND ARTS LLC reserves the right of the final explanation and revision for the terms and conditions. All properties are sold as is, all sales are final. NO RETURNS. NO EXCEPTIONS. Marks, stains, dirts, patina, abrasions, or luster cannot be reason to effect condition of the pieces. Foreland Arts doesn't have responsibility with the surface condition. Though all description and commentary are believed to be correct, neither the auctioneer nor the consignor makes any warranties or representations of any kind with respect to merchandise. Buyer shall not rely on the auctioneer, employees, the catalog description, or advertisements in any part, and must rely only on his own inspection and opinions of all items: we offer a preview and high-resolution photos for potential buyers to review and make their own conclusions about the piece. NO GUARANTEE OF PROVENANCE: Foreland Arts LLC is not responsible for the research and provenance of each item. Foreland Arts LLC is not responsible for authenticity, genuineness of, estimated selling price of, or defects in any lot, and makes no warranty in connection therewith. No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold as is and without recourse. All items are sold to the highest bidder as acknowledged by the auctioneer. The auctioneer has the right to reject any bid. The auctioneer is the arbiter of any disputed bid. He may reopen bidding at his discretion and reject bids deemed inappropriate. The auctioneer reserves the right to withdraw any item and to re-offer the item at another time. Every effort is made by the auctioneer to execute all bids, including floor, absentee, and telephone and internet bids. We are not responsible for any missed bids. Foreland Arts LLC reserves the right to cancel any sale or bid before, during, and after the auction. SHIPPING Due to the in-house working procedure, lots will be available for shipping up to 10 working days after the payment complete. Foreland Arts LLC has the right to decide whether to accept the Buyer's request for packing and handling service. Item will not be release without the consent form filled by purchaser. If the Company's employees pack and handle the Lot as requested by the buyer, the said packaging and handling shall only be deemed service provided by the company to the buyer, so any risks and losses shall be borne by the Buyer. Under no circumstances shall the Company be responsible for damages and loss of the frames or glass, drawers, bottom pads, trestles, mountings, insert pages, scroll heads or other similar accessories due to any reason. Where the Buyer requests the Company to help collect the Lot purchased in the form of postal delivery, express delivery or transportation(packing, postal and transportation costs to be borne by the Buyer), the Company shall be deemed to have delivered the Lot and the Buyer shall be deemed to have collected the Lot through normal procedure once Ingenuity has delved the Lot to the postal, express, transportation entities or companies and their employees/branch organizations, the risk involved in the process shall be borne by the buyer, and postal, express, and transportation processes are not insured unless the Buyer has specially indicated and bear the insurance premium. The Company shall not be responsible for all errors, omissions, damages or loss caused by the packaging company and postal, express, transportation entities or companies which the Buyer designates or the Company recommended. Some property that is sold at auction can be subject to laws governing export from the United States, such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer.
