Payment: if you have a card on file with Live Auctioneers, it will be charged automatically 48 hours after invoice are sent. Bidders are advised to examine lots that they are interested in, if possible, before the auction. Condition of items are noted in the description. All lots are sold AS-IS, where is with no refunds, no returns, no charge backs. Alfred's Auctions will take reasonable care to describe items for sale. In addition, we reserve the right to impose a late charge of one and half percent (1.5%) per month of the total purchase price if payment is not made in time allotted. A sale will not be canceled because of shipping costs. See shipping below.
Acceptable forms of payment are cash, VISA, MasterCard, American Express, Discover, or wire transfers, payable in U.S. dollars. Invoice must be paid in full. Alfred's Auctions reserves the right to hold merchandise purchased until the funds have cleared. If a purchaser is in breach of their obligations, including their obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Alfred's Auctions will charge the card on file. If it becomes apparent that the purchaser is in default Alfred's Auctions will exercise all of our rights under the law. This may include canceling the sale and applying payments made by the purchaser toward the damages caused by the purchaser's breach. Offering at public auction, without reserve, any item for which the purchaser has not fulfilled their obligation, including its obligation to pay in full the purchase price, and holding the purchaser liable for any deficiency plus all related costs of the sale.
The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. We sell used merchandise, therefore, we do not make any warranties or representations, expressed, or implied with respect to attribution, condition, culture, genuineness, historical significance, importance, material, medium, origin, period, provenance, quality, rarity, or size of any lot sold. Oral or written statements shall not be a warranty or an assumption of liability. Do not guess, we are here to help. Prospective buyers must complete and sign the registration form and provide identification before bidding and have a credit card on file with Live Auctioneers. When bidding, a bidder is accepting personal liability to pay the purchase price, including the buyer's premium, all applicable taxes and shipping if necessary.
Reserves: Some lots in the sale are subject to a reserve. This is the lowest price which the seller will accept. The reserve will not exceed the estimate. The auctioneer may open the bidding on any lot below the reserve by placing a bid on behalf of the seller. Again, the auctioneer reserves the right at his sole discretion to refuse any bid or bidder, to advance the bidding in any manner as he may decide, to withdraw any lot, and in case of a dispute to determine the successful bidder, to continue the bidding, or to cancel the sale and resell the item in dispute.
Title passes upon the fall of the auctioneer's hammer to the highest acknowledged bidder. In addition to the hammer price, the buyer agrees to pay Alfred's Auctions a buyer's premium and the applicable sales tax added to the final price. The buyer premium is 18% of the hammer price. Buyer must pay the entire amount due by 48 hours after invoicing. Payments are to be made in U.S. dollars and may be made with wire transfer or credit card. Alfred's Auctions reserves the right to hold merchandise until the funds are received.
Pick up: Once funds are received the buyer may collect purchases the on the allotted pick up days. Out of area purchasers may use our inhouse shipper or a shipper of their liking. Again, no items will be released until payment in full is made.
Packing and Shipping: Removal is the buyer's responsibility above and beyond the purchase costs. Affordable Pack N Ship +1-732-294-7790 will provide shipping services at the buyer's expense. Please note, items that are large and/or heavy and/or need special packaging or shipping requirements, may have additional shipping costs. Contact them before the auction about your intended purchases.
Failure to Pick Up Purchases: If purchases are not picked up within the allotted pick up time, regardless of payment made, Alfred's Auctions reserves the right to charge $25 per lot per day after the pick up period. Alfred's Auctions assumes no liability for any damage to property left on its premises for more than three (3) business days following the sale for purchases that are not picked up after ten (10) calendar days, an additional administration fee of $75 will be charged. Purchases that are paid for but not collected for any reason more than twenty (20) calendar days will be subject to sale to recover storage and administration fees. The balance of any funds will be remitted to you.
Liability: Alfred's Auctions will not be responsible for errors in descriptions, or of any statement concerning lots for sale, whether written or oral, or for any other errors or omissions in description or for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees, or agents, give any representation, warranty, or guarantee or assume any liability of any kind in respect of any lot about merchantability, fitness for a particular purpose, description, size, quality, condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature, or historical relevance. Except as required by law, any warranty of any kind whatsoever is excluded by this paragraph. We cannot accept liability for equipment failure, inability to access the internet or software malfunctions related to online bidding. Alfred's Auctions reserves the right to refuse participation to any bidder, in any auction, for any reason, and reject any bid from said bidders.
Purchased Lots: If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, misplaced or lost prior to delivery, Alfred's Auctions will not be liable for any amount more than that paid by the purchaser.
Legal Disputes: Any disputes that require civil action shall happen in the jurisdiction of Middlesex County NJ, where the auctioneer is located.
