DEFINITION OF AUCTION: An auction is a legally binding contract offer by the high bidder to purchase the item being offered. All items are sold "as is / where is" with no guarantees or warranties, expressed or implied, of any kind, including but not limited to condition. ALL SALES ARE FINAL. You are bidding and buying based upon your own determination of the identification and value of each item offered, and you are making your own decision to bid based on that determination. We encourage you to attend THE ON -SITE PREVIEWS!! Here is how to do it REGISTER: Registering here enables you to participate and bid in ALL of our upcoming auctions. Please read these special terms and conditions. By registering, you are AGREEING THAT you have read, understand, and agree to abide by all terms and conditions, both in general as listed here, and specifically for each individual auction. All bidders are required to register on-line or onsite in order to bid. All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. YOU MAY REGISTER WITH A VALID DRIVERS LICENSE AND OR BANK INFORMATION: For absente bids on our live auctions some registration applies. We WILL not share this information with any outside sources. This is solely for your bidding participation with us. NOTE: You will be required to pay in full, within 48 hours of the auctions closing. (Please see payment terms below for methods of payment) Once you have registered, you are ready to participate in our upcoming auctions. All registration information the Bidder provides to the Auctioneer shall be current, complete, and accurate. All bidders must be 18 years of age or older. PREVIEW: There will be On-Site preview time. On-site PREVIEWS ARE VERY IMPORTANT! This is your only hands on opportunity to VIEW and make your own informed bidding decision. Although we believe the source of information listed about items being sold to be reliable, on-line listing & photo errors can occur. And all items are sold as-is, where is, it is important that the Bidder carefully inspect the items for sale at the on-site preview for each on-line auction prior to bidding. The pictures and descriptions placed on-line are limited, and in no way express any guarantee or warranty of any kind. We encourage you to attend the ON-SITE PREVIEWS!! THE ONLY EXCEPTION to the, as is / where is term, will be: when the auction description includes these words ("auctioneers opinion of condition") In the event an item is placed up for sale in an on-line only auction and no on-site viewing is available, the auctioneer at his/her discretion, may place his/her "auctioneer's opinion of condition" on-line. In this event should a discrepancy occur the auctioneer would consider a refund or partial credit, limited to the actual bid price and only on that specific item where the auctioneer's note is present. UNDER NO CIRCUMSTANCES will the auctioneer's responsibility exceed the actual hammer price of the item, and will not include the cost of shipping & handling or any other cost that may have occurred due to the purchase. the buyer agrees to be responsible for any and all additional cost that may have occurred that exceeded the actual hammer price if a refund is requested. PAYMENT TERMS: BUYERS PREMIUM: THE FULL WINNING BID PRICE PLUS A 5% Buyer's Premium will be added to each purchase. Example: You bid $100.00. At check out you will be charged $105.00 (plus State Sales Tax of) if applicable. If you registered with your DRIVERS LICENSE information: You will be required to pay in full the day of the auction for (live on-site), all absentee buyers must pay within 48 hrs. of the close of the auction. You will receive a winning bidder notification to inform you of items WON! You will receive A Phone Call or E-MAIL within 24hrs of the close of the auction. The Methods of payment we accept are, Visa, Master Card, Discover, American Express, debit cards, wire transfer, cash, postal money order, and good checks only. Credit card users are charged 8% Buyers Premium. Buyers with tax exemption, you must complete the tax-exempt form and email, mail, or fax to us before sale. Please do not enter a bid at a price that is greater than you are comfortable paying for any individual item. ALL SALES ARE FINAL. There will be no adjustments to the final bid price after bidding closes. IMPORANT: WHEN YOU BID ON ANY ITEM, YOU ARE ENTERING INTO A BINDING CONTRACT. IF YOUR BID IS THE WINNING BID ON ANY ITEM (S), YOU WILL BE CHARGED FOR EACH AND EVERY ITEM PURCHASED AND YOU WILL BE REQUIRED TO PICKUP YOUR ITEMS. All items are being sold AS-IS, WHERE IS, and WITH no WARRANTY EXPRESSED OR IMPLIED. Any notes or descriptions are for information only; you need to make your own decisions based on your own observations. If you want to have a high level of confidence you MUST inspect for yourself and make decisions based on this inspection. We strongly urge you to inspect on the pre-assigned inspection dates that will be posted for each individual auction on our website. There will be no adjustments to the final bid price should you find any problems with the item after the bidding closes. PLEASE BID WISELY: When in doubt, please don't bid, think, and if you still want to bid, bid accordingly. Definition of RESERVE BIDDING: The Seller has placed a reserve on one item in this event and reserves the right to use a reserve bid. *Bid rejection Ashcraft Auctions and Professional Services reserve the right to reject any and all bids if they so choose. *Bid retraction Buyer must acknowledge all terms of the auction and agree not to retract the purchase offer. If you cannot satisfy the terms of the auction please do not bid. PICK-UP/REMOVAL: Pick-up/Removal days/times are posted within each specific auction; any exceptions to the pick-up agreement must be in writing from the auctioneer prior to bidding. By participating and bidding in a given auction, you understand and agree to abide by the removal date/times for that auction. PLEASE DO NOT BID IF YOU ARE NOT ABLE TO PICK UP YOUR ITEMS AT the scheduled removal date/times. THERE WILL BE NO REFUNDS, items will be considered abandoned. YOU MUST BE AVAILABLE TO PICK UP AND REMOVE YOUR ITEMS AT THE POSTED REMOVAL TIMES. Bidders who do not pickup their items at the scheduled time will be considered to have abandoned their purchases and agree that they will not be entitled to any refund or adjustment. All Bidders are responsible for removal of purchased items. "ALL ITEMS MUST BE PAID FOR, IN FULL" PRIOR TO PICKING UP OR SHIPPING "ANYONE" PICKING UP MERCHANDISE MUST PRESENT THE ORIGINAL SALES RECEIPT. NO EXCEPTION! Any items NOT picked up by the set time will be considered abandoned and Removal shall be at the expense, of the purchaser. Please make sure that mover / anyone picking up items for you have your paid receipt in hand to present when picking up. Buyer shall be responsible for making arrangements for merchandise removal within two business days of the auction unless otherwise noted. Absentee winners, on live auctions, will be granted more time if required to work out details of pick up or delivery. IMPORTANT! Unclaimed items The Auctioneer will have the option of reselling, removing, storing or abandoning, at the expense and risk of the purchaser, any items not paid for and/or removed within the specified time. The buyer agrees to pay all deficiencies, legal, collection; transportation and storage expenses associated with delinquent accounts or abandoned items. SHIPPING INFORMATION We ship to the continental US via US Postal Services, UPS, and Fed Ex. If you have purchased items at one of our auctions and it must be shipped to you, we would be happy to do so for the actual shipping costs plus a $5.00 minimum-handling fee of actual shipping. The merchandise should be shipped within four business days of receiving payment. We are not responsible for the acts or omissions in our packing or shipping of purchased lots or of other carriers or packers of purchased lots, whether or not recommended by us. Packing and handling of purchased lots is at the entire risk of the purchaser. ADDITIONAL AUCTION TERMS *The auctioneer reserves the right to add or remove items from the auction. *legal courses of action: All bids are a contract; every legal remedy available will be used to insure the performance of winning bidders. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless each seller and auctioneer and their employees, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys' fees and expenses related to, arising from or associated with buyer's, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder. *Announcements All announcements made the day of the sale take precedence over any printed material and this website. LIMITATIONS: The Terms and Conditions of Sale cannot be altered, except in writing by The Auctioneer. Any discrepancies or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator's may be entered in any court having jurisdiction thereof. By registering, you are agreeing that you have read, understand, and agree to abide by all terms and conditions, both in general as listed here, and specifically for each individual auction.
