Conditions of Sale 1. RESERVES. Most items are sold unreserved. When reserves are present, they are normally set at or below the minimum estimated range. We reserve the right to reject any bid not commensurate with the value of the item being sold. 2. WARRANTEES: All property is sold "as is", and neither the auctioneer nor any consignor makes any warranties or representation of any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. Please see item No. 10 for further information regarding Condition Reports. 3. DISPUTED BIDS. In the event of disputed bids, the auctioneer shall be the judge in the matter to determine ownership. Normally, the auctioneer will re-open the bidding between the parties in dispute to determine the winner. The auctioneer shall also have the right to withdraw the article from the sale at his discretion. 4. PICKUP: While we expect all accounts to be paid within 1 week of the sale, we do allow more time for pickup or delivery to your destination. Generally, 2 weeks is our goal, but if this is not possible, please call ahead and we will do our best to accommodate your schedule (845-471-5660). We will not charge you for storage unless a long term solution is necessary requiring off site care. Also, since this service is provided as a courtesy for our customers, in all cases we cannot be held responsible for any damage that may occur for items left more than 3 weeks. 5. PAYMENTS: We accept cash(In House Only), checks, Master Card, or VISA. Out of state checks require prior approval 3 days before the auction and must submit bank letter of guaranteed funds before bidding. We reserve the right to hold any merchandise until the check clears. A liveauctioneers dispute will be open for All online invoices not paid within 1 week of sale unless we are notified in advance that more time is required. 6. SHIPPING: We provide shipping support but do not ship items ourselves. A list of shippers can be found on our web site www.hpcountryauctions.com. Upon your request, we will release items to the shipper of your choice who is responsible for picking up your item(s) at our auction facility. Hyde Park Country Auctions will not be held liable for any damage that may occur in shipping as this is done as a courtesy to purchaser. Purchaser agrees to pay in advance the required shipping and packaging fees directly to the shipper. 7. NY STATE SALES TAX: All purchases are subject to a New York State Sales Tax rate of 8.125% unless a valid NY State sales tax exemption certificate is presented before the sale. The rate will be applied to the buyers premium as well. 8. BUYERS PREMIUM: A 15%-18% buyers premium shall be applied to all in-house purchases (15% with cash or check and 18% with credit card). Online buyers pay 23% buyers premium regardless of method of payment. 9. REGISTRATION TO BID: In house buyers - Registration must occur before bidding is permitted. Two forms of ID must be provided including the purchaser's driver's license. By bidding at the auction either live, phone, absentee, or online, the bidder agrees to accept the terms of the auction, including this list of requirements, as well as any new information that may be announced prior to the sale. Online buyers - Registration takes place through liveauctioneers only. Anyone with outstanding dispute(s) with liveauctioneers auction houses, will not be approved to be at our sale unless a verifiable explanation is provided, or the dispute is resolved within 24 hours of our auction start time. 10. CONDITION REPORTS: Condition reports are provided as a courtesy only. While we will make every effort to ensure our condition reports are accurate, we cannot guarantee such and we should NOT be considered experts in any particular area of collecting. Also, condition reports are very subjective and when we say for example, that an item is in "Good Condition", that is our belief based on our examination but you may have a different opinion based on your background and experience on reviewing similar products. Further, box lots or group lots are only given a cursory review so if any particular item is important to you, please call for a more detailed report or request additional photos - items in box lots cannot be returned for any reason. Also, we advise all buyers to either inspect each item personally, or send a person to preview the item for you if you cannot attend the auction. In any case, neither Hyde Park Country Auctions LLC, or it's consignors can be held liable for any errors in description, photography, or condition reporting. EVERYTHING IS SOLD "AS IS" WITHOUT GUARANTEE. By signing up to bid at any of our sales, you agree to all Terms & Conditions as described here and earlier in number 2.

JEWELRY-WATCHES: All jewelry and watches are warranted as follows: The grading marks on jewelry and watches are guaranteed as marked, unless otherwise mentioned in the description - unmarked jewelry is guaranteed as described with the exception of stones; also, all stones attached to jewelry or watches generally have not been certified and descriptions are our opinion only, and are sold without warranty of any kind unless a statement of authenticity is provided in the description. Our guarantee of authenticity is only valid for 3 weeks after the sale date - no returns or refunds after this time due to payments to consignors. As such, all jewelry and watches should be paid for within 2 weeks of the auction otherwise this warranty is voided. Any jewelry or watches not paid within 2 weeks of the sale, may at our option, be offered to the under bidder and a non-removable dispute will be opened against the bidder. Unless otherwise known to us, all payment for jewelry or watches must be made via check, cash or bank transfer (a bank transfer fee of $25 will apply). Any disputed purchased items meeting these standards are subject to a complete refund, excluding shipping costs.
