Daniel Buck Auctions - Terms and Conditions of Sale The property described in this catalog, as stated by the auctioneer or posted in writing at the time of the auction, will be sold by Daniel Buck Auctions as agent for the consignor (s), subject to the following terms and conditions. By bidding at auction, whether present in person or by an agent, by written bid or telephone bid, or by any other means, the buyer and all bidders agree to be bound by these Terms and CDaniel Buck Auctions - Terms and Conditions of Sale The property described in this catalog, as stated by the auctioneer or posted in writing at the time of the auction, will be sold by Daniel Buck Auctions as agent for the consignor (s), subject to the following terms and conditions. By bidding at auction, whether present in person or by an agent, by written bid or telephone bid, or by any other means, the buyer and all bidders agree to be bound by these Terms and Conditions of Sale. 1.) All Property is sold "AS-IS, WHERE-IS AND WITH ALL FAULTS" and neither the consignor or Daniel Buck Auctions make any guarantees, warranties or representations of any kind or nature, with respect to the Property or its Value, and in no event shall they be responsible for Correctness of Description, Genuineness, Authenticity, Authorship, Attribution, Provenance, Period, Culture, Source, Origin, Completeness, Condition of the Property or Estimates of Value and no statement, oral or written, made at the sale or in the catalog, or elsewhere shall be deemed such a warranty or representation, or an assumption of responsibility or liability. 2.) Daniel Buck Auctions reserves the absolute right to withdraw any lot at any time prior to the commencement of bidding for such lot. 3.) Estimates provided in this catalog represent that range which, in the opinion of Daniel Buck Auctions represents a fair and probable auction value. Actual prices realized for items can fall below or above this range. 4.) If the auctioneer decides that any opening bid is below the value of the lot being offered, the auctioneer may reject that bid and withdraw the lot from sale: and if, after having acknowledged any opening bid he decides that any advance thereafter is insufficient, he may reject that advance. Some lots are offered subject to a reserve, which is the confidential minimum price agreed upon by the consignor and Daniel Buck Auctions below which such lot will not be sold. No reserve will exceed the low estimate of the lot. A representative of Buck will execute such reserves by bidding for the consignor. 5.) Except as provided in paragraph 3 above, Title passes upon the fall of the auctioneer's hammer to the highest acknowledged bidder subject to the Terms and Conditions of Sale set forth herein. 6. Upon acknowledgement of and by the highest bidder, such bidder thereupon immediately assumes full risk and responsibility therefore and will pay the purchase price as follows: The total purchase price to be paid is the amount of the successful bid price plus a premium of 20% for Online Bidders. 7.) In the case of a disputed bid, the auctioneer shall have sole and final discretion in determining the purchaser and may also, at his election, withdraw the lot or re-offer the lot for sale. If any dispute arises after the sale, the Daniel Buck Auctions sale record shall be conclusive. 8.) Payment is due at the end of each sale, or upon receipt of an invoice. Acceptable forms of payment are cash or certified, cashier's or good check, payable in U.S. dollars. Checks will be acceptable only if credit has been established with Daniel Buck Auctions prior to the sale date, or if a bank authorization has been received guaranteeing the check. Daniel Buck Auctions reserves the right to hold merchandise purchased by personal check until the check has cleared the bank. The purchaser agrees to pay Daniel Buck Auctions a handling charge of $25.00 for any check dishonored by the drawee. 9.) Daniel Buck Auctions may impose, and the purchaser agrees to pay, a monthly interest charge of 1.5% of the purchase price of any lot or item not paid by the purchaser with thirty-five (35) days of the date of sale. 10.) All purchases are subject to Rhode Island sales tax unless the purchaser holds a valid resale number, and a certificate of same is on file with Daniel Buck Auctions. Resale certificates from other states are accepted in Rhode Island if presented with a copy of your permit or a business card. 11.) All merchandise purchased must be paid for and removed from the premises the day of the auction. No lot may be taken away unless the purchase price thereof including buyers' premium and any applicable tax have first been paid in full. All items sold to an online bidder will need to be paid in full, and checks must be cleared through the bank, before removal of the item to the shipper. All packaging and shipping expenses will be paid for by the purchaser and will be handled through a local UPS shipping store. Any item not removed by the purchaser within three (3) business days after the sale, Daniel Buck Auctions may impose, and the purchaser agrees to pay a minimum of $5.00 per lot per day or the merchandise may be transferred to and stored at a bonded public warehouse and the purchaser agrees to pay all transfer and storage expenses. Daniel Buck Auctions shall have no liability for any damage to property left on premises for more than three (3) days following the sale. 12.) Special Conditions related to Modern Firearms: The purchase of any "Modern Firearm" requires a Federal Firearms License. Any non-FFL licensed individual wishing to purchase a "Modern Firearm" will need to have the firearm transferred through a Federal Firearms Licensed dealer, the charge will be $20.00 per firearm. Any firearm requiring registration will be noted with an *Asterisk. in the description of that firearm. All licensing, delivery, shipping and storage charges must be paid by the successful bidder prior to the delivery of the firearm. 13.) If the purchaser breaches any of its obligations under these Terms and Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, Daniel Buck Auctions may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and (b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale, and including reasonable attorney's fees. 14.) Bids which are submitted to Daniel Buck Auctions in writing or are otherwise left with Buck prior to an auction for execution at or below a specified price, are entertained and executed by Daniel Buck Auctions for the convenience of bidders, but Daniel Buck Auctions shall not be responsible for failing to execute such bids or for errors relating to the execution of such bids. 15.) Daniel Buck Auctions and its consignor(s) make no warranty or representation, expressed or implied, that the purchaser will acquire any copyright or reproduction rights to any lot sold. Daniel Buck Auctions expressly reserves the right to reproduce any image of the lots sold in this catalog. 16.) In no event will the liability of Daniel Buck Auctions to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.onditions of Sale. 1.)
