The property offered and sold through Yasur LLC (hereinafter "Yasur," "We," "Us") public auctions (hereinafter "Property") shall be offered and sold pursuant to the terms and conditions set forth below (hereinafter "Agreement"). This Agreement constitutes the complete statement of the terms and conditions following which all property is offered for sale. Accordingly, by bidding at all auctions, whether in person, by agent, in writing, by telephone, internet bid, or any other means, buyers of the Property ( hereinafter "Bidder" "Buyer" "You") agrees to be bound by this Agreement. BEFORE THE SALE All prospective bidders must complete and sign a registration form and provide identifications before bidding. ALL NEW BIDDERS ARE REQUIRED TO SUBMIT A CREDIT CARD FOR THE REGISTRATION AND BIDDING APPROVAL PURPOSES, AND THE CREDIT CARD WILL BE CHARGED FOR THE INVOICE AMOUNT IF THE INVOICE IS NOT PAID WITHIN SEVEN (7) DAYS. In addition, a $1,000.00 DEPOSIT MAY BE REQUIRED IN ORDER TO APPROVE REGISTRATION. If the bidder successfully wins a Lot, the deposit will be applied toward the purchase price. If the bidder is unsuccessful in winning a Lot, the deposit will be returned to the unsuccessful bidder within 5-7 business days. Yasur LLC is acting solely as an auction broker, and unless otherwise stated, does not own the property offered for sale and has made no independent investigation of the property. Prospective buyers are strongly advised to personally examine any property they are interested in before the auction takes place. Condition reports are usually available on request, on lots with a low estimate of $300 and above. All lots are sold "AS IS" and without recourse, and neither Yasur LLC nor its consignor(s) makes any warranties or representations, express or implied with respect to such lots. Neither Yasur LLC nor its consignor(s) makes any express or implied warranty or representation of any kind or nature with respect to merchantability, fitness for purpose, the correctness of the catalog, or other description of the physical condition, size, quality, rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance of any lot sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. No statement, whether written or oral, and whether made in the catalog, or in supplements to the catalog, an advertisement, a bill of sale, a salesroom posting or announcement, the remarks of an auctioneer, or otherwise, shall be deemed to create any warranty, representation or assumption of liability. Suppose bidders require absolute certainty in all areas of authenticity, and the results of bidders' evaluation leave uncertainty in bidders' minds. In that case, we recommend bidders not bid on the item in question. WE DO NOT REFUND. All SALES ARE FINAL. Yasur LLC, in its sole and exclusive discretion, reserves the right to withdraw any property, at any time, before the fall of the hammer. Yasur LLC has the right, at our complete discretion, to refuse admission to the premises or participation in any auction and to reject any bid. We have no responsibility to any person other than a buyer in connection with purchasing any lot. Unless otherwise announced by the auctioneer at the time of sale, all bids are per lot as numbered in the printed catalog. Yasur reserves the right to determine any matters regarding the order, precedence, or appropriate increment of bids or the constitution of lots. The highest bidder acknowledged by the auctioneer shall be the Buyer. The auctioneer has the right to reject any bid, to advance the bidding at his absolute discretion. In the event of any dispute between bidders, the auctioneer shall have the sole and final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, Yasur's sale record shall be conclusive in all respects. Suppose the auctioneer determines that any opening or later bid or advance bid is not commensurate with the value of the property offered. In that case, he may reject the same and withdraw the property from sale. Upon the fall of the hammer, title to any offered lot or article will immediately pass to the highest bidder as determined in the exclusive discretion of the auctioneer, subject to compliance by the Buyer with these Conditions of Sale. Buyer thereupon assumes the entire risk and responsibility of Property sold and agrees to pay the total price, plus Buyer's Premium, therefore or such part, upon such terms as Yasur LLC may require. BIDDING SERVICES Reserves- Lots may be subject to a reserve which is the confidential minimum price below which the lot will not be sold. Yasur is under no obligation to disclose the amount of the reserve at any time to any Bidder or enquiring party. Condition Reports- Bidders assume responsibility for ensuring that the condition of the item(s) meets with their satisfaction before bidding. Any condition statement is given as a courtesy to a client, and is only an opinion and should not be treated as a statement of fact. Yasur LLC shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections, or aging. Telephone Bids - On lots with a low estimate of $500 or above. If a bidder makes arrangements with us before the sale's commencement, we will use reasonable efforts to contact them to enable them to participate in the bidding by telephone. Absentee Bids - As a service to those wishing to place bids, we may, at our discretion, accept bids without charge in advance of auction online or in writing on bidding forms available from us. "Buy" bids will not be accepted; all bids must state the highest bid price the bidder is willing to pay. Our auction staff will try to bid just as you obtain the item at the lowest bid price possible. In the event identical bids are submitted, the earliest bid submitted will take precedence. Absentee bids shall be executed in competition with other absentee bids, any applicable reserve, and bids from other auction participants. All Phone bidding and Absentee Bidder's Form are held in the strictest confidence and must be received 24 hours before the auction date. We require a credit card on file to register for bidding and a security deposit of USD 1500 paid ahead of a sale. You may call us at 1775-460-1562 to pay over the phone or complete the credit card authorization form. Yasur's auctions shall have the right to withdraw any item at any time for any reason and to void any sale in the event of an error or dispute. We make every effort to honor all absentee and phone bid reservations, but we are not liable for any losses incurred as a result of failure to execute absentee bids or failed phone reservations. Submitting absentee bids or bidding by phone does not imply an extension of credit. Internet bids- can be placed in real time through one or more of the following third-party services: LIVEAUCTIONEERS, INVALUABLE, AUCTION ZIP, EPAILIVE, 51BIDLIVE, YAJIAN, and others as may be designated by Yasur for a particular Auction. Yasur LLC is not responsible or liable for any problems, delays, or any other issues or problems resulting out of the use of the Internet generally or specifically, including but not limited to transmission, execution, or processing of bids. Yasur treats any third-party site bids as floor bids. Actual floor bids and telephone bids are always considered first over third-party sites bids, and floor bids are considered earlier than telephone bids. This is because all Yasur lots purchased through these third-party sites also include the Buyer's Premiums due to that third-party site. Your bid is submitted once you place and confirm your bid amount. You agree that a bid is final once it is placed and that you may never amend or revoke your bid. You are fully responsible for any errors you make in bidding. Bidding generally opens at or below the low estimate and increases in steps (bidding increments) to be determined at Yasur's sole discretion. We reserve the right to accept or deny any bid placed in any LIVEAUCTIONEERS, INVALUABLE, EPAILIVE, ARTFOX, or affiliate site. Lots may have a reserve, and Yasur LLC will bid against the reserve. If you do not agree with these terms and conditions, PLEASE DO NOT BID. We engage third-party online bidding platforms to collect or facilitate auction bids ("Bidding Platforms"), each of which levies a fee for their services and have their own rules on fees and how to bid and buy online using these Bidding Platforms. Yasur has no control over and assumes no responsibility for any Bidding Platforms' content, privacy policies, or practices. Your dealings with Bidding Platforms are solely between you and such Bidding Platforms. We encourage you to be aware of and read the terms and conditions and privacy policy of any Bidding Platforms that you visit. You expressly release Yasur LLC from any liability arising from your use of any Bidding Platform or other third-party website or service. Pre-Sale-We offer Pre-sale service for certain items, please contact us and complete Pre-Sale Purchasing Form, as in the event of identical offer(s), the earliest offer received will take precedence. The Pre-sale Buyers need to complete 100% of the invoice payment 24 hours before the sale starts. Without the full payment received from Buyers at the prescribed time, the Pre-sale proposal will be terminated automatically. Post-Sale- We offer Post-Sale service for certain items, please contact us and complete Post-Sale Purchasing Form, as in the event of identical offer(s), the earliest offer received will take precedence. The Post-sale offer(s) will be only valid for three (3) business days after the invoice is issued to the Buyer. Once offer(s) have been accepted, Buyers need to complete at least 50% of the invoice amount within three business days. The remaining balance must be paid off within seven (7) business days. Please note that we must have a credit card on file to process your offer(s). If alternative payment has not been received within seven (7) business days after an offer has been accepted, the credit card on file will be charged. Failure to pay the invoice in full at the prescribed time will cause the agreement to be terminated. Under the circumstances, our company will not refund Buyer's actual paid amount. SUCCESSFUL BIDS AND PAYMENT The sale agreement between Yasur LLC and the successful bidder is formed when the final bid is accepted, and the auctioneer's hammer strikes. The successful bid price is the hammer price, and we will issue an invoice only to the registered bidders who made the successful bids. Bidders must pay the purchase price, consisting of the hammer price, plus the Buyer's premium, plus any applicable duties and sales, use, or other applicable taxes. Payment is due no later than by the end of the seventh (7th) calendar day following the auction date, which we refer to as the due date. All payments must be made within seven (7) business days after the sale. We will only accept payment from the registered successful bidder. Once issued, we cannot change the Buyer's name on an invoice or reissue the invoice in a different name. IF YOU HAVE A CREDIT CARD ON FILE WITH LIVE AUCTIONEERS, IT WILL BE AUTOMATICALLY CHARGED 72 HOURS AFTER YOU RECEIVE YOUR INVOICE All payments or settlements shall be made in US dollars; buyers shall only collect the lots after total payments are made. WE DO NOT ACCEPT PAYPAL. Payments accepted include telegraphic/wire transfer, Business/personal check, Visa, Mastercard. Mastercard and Discover. Visa, Mastercard and Discover a 3% surcharge/ AMEX a 3.5% surcharge applies. Buyers must complete an authorization form and provide Identification and a copy of the credit card. Regarding Telegraphic/Wire Transfer, the Buyer is responsible for all charges. The Buyer must quote your invoice number when making a payment. According to Nevada State law, sales tax will be added to all sales picked up after the auction or shipped to Nevada addresses unless a resale certificate is provided. SHIPPING SERVICES Yasur LLC may, as a service to the Buyer, arrange to have purchased property posted and shipped at the bidder's expense. The packing and handling of purchased lots are the bidder's responsibility and are at the entire risk of the bidder. If, for any reason, a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, miss-delivered, or lost before delivery, etc. YASUR LLC SHALL NOT BE LIABLE FOR ANY AMOUNT IN EXCESS OF THAT PAID BY BIDDERS. IF BIDDERS DISAGREE WITH THE PARAGRAPH, PLEASE DO NOT BID. The packing and shipping fees are added to the final invoice. The charges depend on the value of the package, dimensional weight, material cost, and Bidders' specific location concerning our company. All packages will be shipped through USPS or FEDEX with basic insurance covered unless otherwise noted before the time of shipment. SHIPPING TIMEFRAME is the seventh (7th) to twelfth (12th) calendar day after invoices are fully paid. Larger packages and international delivery may exceed this period. Every shipment will be packed professionally in-house, and we ship worldwide. The tracking number will be emailed as soon as it becomes available. Please note that we do ship multiple items in a single package to minimize shipping charges when possible. If Bidders need additional insurance or arrange lots to ship by a specific shipper, Bidders need to contact us by emailing support@yasur.us. International Bidders are responsible for meeting customs/import-export regulations. We'll assist but cannot be held liable for international laws affecting the delivery of Bidders' properties. Please note that lots containing ivory, tortoiseshell, or other animal materials may be subject to regulations imposed by the Endangered Species Act and by the United States Fish and Wildlife Department. Some countries prohibit the importation of property containing materials from endangered species, and prospective purchasers should familiarize themselves with relevant customs regulations before bidding if they intend to import these lots into another country. Bidder is responsible for all CITES permits. BIDDER'S REMEDIES If the description of any lot in the catalog is materially incorrect (e.g., gross cataloging error), the lot is returnable if returned within five (5) calendar days of receipt and received by Yasur LLC no later than fifteen (15) calendar days after the Auction Date. This paragraph shall constitute the bidder's sole right to cancel the sale and receive a refund of the purchase price paid by the bidder to us. Yasur LLC will not, under any circumstances, be required to pay bidders more than the purchase price, nor will we be liable for any loss of profits or business, loss of opportunity or value, expected savings or interest, costs, damages, other damages, or expenses. No refunds shall be given for any items not returned to Yasur LLC. NON PAYMENT If Yasur does not receive payment in full, in good cleared funds, within seven (7) business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law: a.) to impose a late charge of one and a half percent (1.5%) per thirty (30) days of the total purchase price b.) to hold the defaulting Buyer liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees, and costs to the fullest extent permitted under applicable law c.) to cancel the sale d.) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without a reserve, and with the purchaser liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, or in the case of bank or cashier's checks, we have confirmed their authenticity. e.) to offset against any amount owed f.) to not allow any bids at any upcoming auction by or on behalf of the Buyer g.) to take other action as we find necessary or appropriate FAILURE TO COLLECT PURCHASES If the property is not picked up within seven (7) business days following the sale, whether or not payment has been made, Yasur LLC reserves the right to charge $10 per lot per day or to deliver said property to a public warehouse for storage at the Buyer's expense. Yasur LLC shall have no liability for any damage to property left on its premises for more than seven (7) business days following the sale. In addition, Yasur LLC reserves the right to impose a late charge of one and a half percent (1.5%) per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. For property that is not picked up after thirty (30) calendar days, an additional administration fee of $50 will be charged. Property which is paid for but left on our premises for any reason in excess of sixty (60) calendar days is subject to sale by us with the balance of any funds recovered in excess of storage charges and any other fees being remitted to the Buyer. ASSIGNMENT Bidders may not assign or transfer these Terms, by operation of law or otherwise, without Yasur LLC's prior written consent. Any attempt by the bidder to assign or transfer these Terms without such consent will be null and of no effect. Yasur LLC may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns. PROPRIETARY RIGHTS NOTICES All trademarks, service marks, logos, trade names, and any other proprietary designations of Yasur LLC used herein are trademarks or registered trademarks of Yasur LLC. Any other trademarks, service marks, logos, trade names, and any other proprietary designations are the trademarks or registered trademarks of their respective parties. LIMITATION OF LIABILITY BIDDERS ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, SERVICES, AND COLLECTIVE CONTENT REMAINS WITH YOU. NEITHER YASUR LLC NOR ANY OTHER PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE, SERVICES OR COLLECTIVE CONTENT WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE OR SYSTEM FAILURE OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE, SERVICES OR COLLECTIVE CONTENT, OR FROM ANY COMMUNICATIONS, INTERACTIONS OR MEETINGS WITH OTHER USERS OF THE SITE OR SERVICES OR OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE OR SERVICES WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT YASUR LLC HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, EVEN IF A LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT WILL YASUR LLC's AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE, SERVICES, OR COLLECTIVE CONTENT EXCEED ONE HUNDRED DOLLARS ($100). THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YASUR LLC AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. DISCLAIMERS THE SITE, SERVICES, AND COLLECTIVE CONTENT ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, YASUR LLC EXPLICITLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. YASUR LLC MAKES NO WARRANTY THAT THE SITE, SERVICES, OR COLLECTIVE CONTENT WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. YASUR LLC MAKES NO WARRANTY REGARDING THE QUALITY OF ANY PRODUCTS, SERVICES, OR COLLECTIVE CONTENT OBTAINED THROUGH THE SITE OR SERVICES OR THE ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OBTAINED THROUGH THE SITE OR SERVICES. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM YASUR LLC OR THROUGH THE SITE, SERVICES, OR COLLECTIVE CONTENT, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE AND SERVICES AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE OR SERVICES. YOU UNDERSTAND THAT YASUR LLC DOES NOT SCREEN OR INQUIRE INTO THE BACKGROUND OF ANY USERS OF THE SITE OR SERVICES, NOR DOES YASUR LLC MAKE ANY ATTEMPT TO VERIFY THE STATEMENTS OF USERS OF THE SITE OR SERVICES. YASUR LLC MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OF THE SITE OR SERVICES OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE USERS OF THE SITE OR SERVICES. YOU AGREE TO TAKE REASONABLE PRECAUTIONS IN ALL COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OF THE SITE AND SERVICES AND WITH OTHER PERSONS WITH WHOM YOU COMMUNICATE OR INTERACT AS A RESULT OF YOUR USE OF THE SITE OR SERVICES, PARTICULARLY IF YOU DECIDE TO MEET OFFLINE OR IN PERSON. INDEMNITY Bidders agree to defend, indemnify, and hold Yasur LLC its officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site, Services or Collective Content, or your violation of these Terms. DISPUTE RESOLUTION DISPUTE RESOLUTION Bidders and Yasur LLC agree that any claim, dispute, or controversy in connection with, relating to and/or arising out of the auction, participation in the auction, award of lots, damages of claims to lots, descriptions, condition reports, provenance, estimates, return and warranty rights, any interpretation of these Terms and Conditions, any alleged verbal modification of these Terms and Conditions and/or any purported settlement shall be exclusively heard by, and the parties consent to exclusive in personal jurisdiction of, the Superior Court of Washoe County, Nevada. THE PARTIES EXPRESSLY WAIVE ANY RIGHT TO TRIAL BY JURY. Any claim must be brought within one (1) year of the auction from which the claim arose or the claim is waived. In every case, the prevailing party shall be entitled to an award of its attorney's fees and costs. NOTICES Yasur LLC may change these Terms of Use from time to time, at any time without notice to you, by posting such changes on the Yasur LLC?s Website or Sales. We highly suggest you periodically check the Terms of Use. It is your responsibility to do so.

If you have not contacted Yasur LLC to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
