These "Conditions of Sale" are the complete and only understanding on which property in any PASEO AUCTION GROUP (herein called “the seller”) sale is sold. All property purchased from the seller is sold "AS IS" without any representations or warranties, express or implied, by Paseo Auction Group or its consignor(s) as to the merchantability, fitness for a particular purpose, or description of any property. BY BIDDING ON ANY ITEM YOU ARE ENTERING INTO A BINDING LEGAL CONTRACT. ANY ITEM THAT REMAINS UNPAID AFTER FIVE (5) DAYS OF THE AUCTION WILL MAKE THE SALE OF SAID ITEM VOID. IF THIS IS AN INTERNET SALE WE WILL REPORT THE BUYER AS A NON PAYING BIDDER. 1A.- Limited Return Clause: All items are researched to the best of “the seller’s” abilities; we offer no guarantees of authenticity, as per point 1 above, nor will historically descriptive information contained in descriptions be taken as a guarantee of authenticity of the work. If the item is materially different from its description or condition report, property may be returned, provided the written claim is received within five (5) days of BUYER RECEIVING MERCHANDISE. “THE SELLER” must receive credible evidence within 5 days of buyer receiving the item/items, and the property must be received by “the seller” within 10 days of receiving the item, in the same condition as when it was sent. Return shipping costs will be paid for by the buyer and and there will be no refund for any shipping, packaging, crating fees incurred by the buyer after the purchase has been sent. 2.- BUYER PREMIUM, SHIPPING, SALES TAX: a 17.5 % buyer’s premium fee will be added to the final bid price, and is payable by the buyer, together with packing and shipping costs if any, and Los Angeles County sales tax (8.25%), unless the property is shipped to a state other than California, or the property is purchased for resale under a proper State resale number, or other legal exemption. 3.- PAYMENTS: Credit Cards only through PayPal, cash, bank or certified checks, wired funds, personal or company checks, are acceptable forms of payment, and property may be immediately picked up or shipped by us (some of the previous methods will delay shipping up to 10 business days). At “seller’s” sole discretion, a sale may be nullified if payment is not received from the buyer within five (5) days of the auction close. 4.-RESERVES: this is a no reserve sale and the starting price is the minimum sale price that our consignors will accept for the merchandise. Time to time we might start the bidding of certain items at a lower than stated minimum price, if the closing price is lower than the starting price the awarding of the bid will be subject to consignor approval. 5.- MISCELLANEOUS: (a) all measurements and weights are approximate, (b) Seller has shipping capabilities of items within the UPS size limitations, and will ship purchases as requested-all costs paid by buyer including handling and packaging fees. (c) “the seller”, in its sole discretion, reserves the right to refuse a bid or withdraw property for any reason prior to the final auction close, (d) ) “the seller”, will decide any bidding disputes, (e) “the seller”, will not be responsible for computer breakdowns, viruses, interruptions, or programming errors, (f) if purchased property cannot be delivered by “the seller”, for any reason, the sale shall be deemed cancelled without any liability to “the seller”,. (g) Under no circumstance will “the seller”, liability will exceed the purchase price of an item. (h) legal matters will be governed under California law. 6.- BUYER'S OBLIGATIONS: (a) Pay promptly in good US funds, (b) buyer pays all shipping, insurance and packing costs, (c) buyer must remove or cause property to be shipped from “the seller’s”, premises within 3 days of the auction close. Storage charges of $10.00 per item per day will be incurred by the buyer beyond the 3 day limit and must be paid before the property is released, (d) promptly advise “the seller’s”, of any problems. 7. SHIPPING INFORMATION: You will receive a general email approximately three days after the last day of the auction notifying you if you have won any lots and asking you to provide a mailing address and payment information. It is essential that you provide a mailing address so that shipping quotes can be made. The quotes are estimates that may be adjusted. Allow two weeks for the delivery of your standard size packages. If you win an oversized lot that “the seller’s”, cannot ship, we can provide you the names of alternate shippers, at your request. All third party shipping charges and correspondence are the responsibility of the buyer. In this case, a prompt decision on which shipping company you wish to use for an oversized item must be made so that “the seller’s”, can receive the monies due for the lots before shipping will occur. INTERNATIONAL SHIPPING will be provided by UPS International service, under NO circumstances will international items be shipped via US Postal Service International mail. International buyers are responsible for all duties and taxes. Items cannot be refused by the buyer for duties and taxes due, and buyer will hold “the seller’s”, harmless for such.
