Though all description and commentary are believed to be correct, neither Auctioneer nor Consignor makes any warranties or representations of any kind with respect to merchandise. Buyer shall not rely on the Auctioneer, employees, the catalog description, or advertisements in any part, and must rely only on his own inspection and opinions of all items. No employee is authorized to make any warranties, expressed or implied, on behalf of Santa Margarita Auction Barn.. The Auctioneer is acting as agent only and is not responsible for acts of its principals. If any dispute arises, the Auctioneer's word is final. This auction is being conducted in pursuant to section 2328 of the commercial code, 535 of the penal code and all provisions of the auction license. In accordance to the California state law, all items are subject to a reserve unless otherwise stated. Auctioneer reserves the right to withdraw any lots from the sale or cancel a sale at the Auctioneer's discretion. The Auctioneer reserves the right to reject any bid or eject any person from the sale. Where the quantity of a lot is listed as more than "1" or if the Auctioneer calls a lot "times the money", the selling price will be multiplied by the quantity of that lot (such as sets of chairs). Santa Margarita Auction Barn and its employees shall not be held liable for any damages or accidents that may result from handling, lifting, moving, loading and packing of purchases. Absentee bids are accepted. Phone bids are accepted at the Auctioneers discretion. Santa Margarita Auction Barn shall not be held responsible or liable for bids that are missed or otherwise not executed. A buyer's premium will be added to the successful bid of 18%; these amounts will be added to the amount of the successful bid price for lots purchased at the auction. State and local sales taxes (8.25%) are applied to all purchases unless a valid resale number is on file or buyer is taking delivery out of California through a common carrier. Shipping is the responsibility of the buyer. Packing and shipping is offered on some lots by the auctioneer, acting as agent. Buyer agrees to hold auctioneer harmless for any and all damages. Prices quoted are for packing and shipping within the continental United States by a carrier of the auctioneers choice and does not include insurance. Buyers will have the opportunity to purchase insurance when available from carrier. Auctioneer reserves the right to refuse to pack and ship any lot. Buyer may use any third party packing and shipping service to deliver any purchases provided purchases are paid for within five days and picked up within three weeks. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his election, withdraw the lot or offer the lot for sale. Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, by Internet, or other absentee bid. To telephone bid, Bidders must complete, sign and fax a copy of the Telephone Bid Registration Form, which is available by calling SMAB. Telephone lines are limited, and available on a first-come, first-serve basis. Registration to bid by telephone must be completed by 5 p.m. the day prior to the auction. As a Convenience, absentee bids will be accepted, when properly executed and submitted in a timely manner. However, we neither accept any responsibility to an absentee bidder, nor any liability whatsoever for a failure to execute the absentee bid for any reason. In the event that identical multiple absentee bids are the highest bids received for the same lot then the earliest received of the competing absentee bids shall prevail at that bid amount. A bid by any person shall be conclusive proof that the person has made himself acquainted with these conditions of sale & has agreed to be bound by them. Prior to removal of purchases payment must be made in cash, or by other means as announced by the auctioneer before the sale.
